Well said! My wife and I were hit by someone who blew over .20 on her BAC while we were stopped at a red light. The other driver did no even step on her brake (she was going at least 45 mph). She said that she was “checking her GPS”. It was disheartening to see the legal process peel down the charges and the penalties. No doubt in my mind she’ll offend again. Meanwhile, I’ve got medical issues that I’ve got to remind me of her stupidity every time I go to bed and every time I’ll wake up the rest of my life. She was underinsured-I had to sue my own insurance company to cover my current medical bills and my attorney fees. I’m on my own for any further complications.

We used to do that all the time when I were a kid, if the fire traveled up you let go and ran away like all hell was about to be let loose and of course everyone else were at a safe(ish) distance, good times. But we were trying to get big flames, explosions etc, our parents would have blamed us for our stupidity if we got hurt and we knew it, but we did get an understanding of what to do when flammable fluids ignite, how to not use water etc, being responsible. I don't think we gave a fuck about the warning labels either. My dad told me he and a couple of friends were flicking lit matches onto this "empty" oil drum, suddenly one of his buddies gets one to land just right and it falls down into the hole in the barrel, turns out that fuel drum had some splashes of fuel left or fumes at least, the thing went off and sent metal shrapnel in all directions, some hitting that friends face/eyes damaging them for life. They fucking knew what they were doing were kinda dangerous, although they assumed it was empty, no warning labels there either, no lawsuit, because you know, common sense, socialist healthcare and such.

I was an FF/EMT. I use to get frustrated having to “rescue” stupid people who texted or talked on their cell phones while driving. I once had to testify in court on why we, myself and another EMT, hadn’t transported a patient in an accident sooner. We were trying to stabilize the patient before transport with two sets of hands instead of one in the ambulance. We were being sued because the patient wasn’t satisfied we’d done enough at the time. The patients attorney asked me on the stand if I didn’t have a moral, as well as professional obligation, to do the best for the patient. I said, “ no more than the patient had to not be texting while driving which was why he’d been in the accident to begin with”, the attorney immediately wanted my statement stricken from the record and the jury to told to ignore my response. Surprisingly the judge didn’t do it. This was a lesson to me about frivolous law suits. Now I’m retired and I don’t stop for accidents involving stupid people unwilling to do their best behind the wheel, I got tired of rescuing “stupid”.

I'll tell you a little story. I'm originally from small-town Pennsylvania. Back in the late 1980s I was traveling with my dad going to various places and we would stop at diners and talk with people while we were in between locations. Often, these were the owners of those diners. At this time any of them were facing severe economic hardship. I saw a good many of these very places shuttered not long after. You see, there were lawyers from New York who would come to Pennsylvania, and stop purposely at these diners. At some point, they would go into the restroom with a tape measure, and examine everything in that restroom. You see, they had copies of the state statutes regarding safety, and federal statutes regarding safety, so they looked for violations. A week or so later the attorney would come back to these diners with papers. These papers were in the form of legal complaints. They would tell the owners they were in violation because of log X Y and Z and would be liable for fines in this amount that amount and the other amount. They were all ready to file these papers, which would shut these restaurants down. Unless... For a fee like $3,000 or $4,000, the same attorneys could be placed on retainer to protect them from such complaints until they should actually have things rebuilt to compliance with safety codes. Faced with this (which, as you can see, was actually nothing more than extortion), they would have to pay the attorneys for really nothing more than being scammed-- on top of additional cost that they would incur for all this construction work. many of these cases were because they were informed they had to have equal access handicapped ramps-- which would eat up sidewalk and parking space. As I said, I saw many of these places shuttered very soon thereafter. That is how attourneys have caused a great many small town places to shut down across the state and even the country. Fast forward to 1998, when I go to New York City. The hometown where all these vultures operate from had terrible access to the subways, which were often the only practical means with which to get about. access to most of these stations was still about what you would find back in 1910-- and much of the construction was nearly as old as that, and crumbling. ... it turns out the MTA had hired the really big guns to represent them through which they managed to work out a deal. People who would need handicapped access were not given handicapped access but instead were permitted to use something called Access-A-Ride. a car would be sent to pick up the customer and take them to where they needed to go. Sounds good, right? Not so fast. In practice, One driver would go around and pick up five different people. one would think they would pick up people all going to the same general destination, say Somewhere in Brooklyn. Having spoken at length with people who I worked with who use these access-a-rides, it became evident that they would set up a schedule in which the driver would pick up people from widely scattered destinations, then take their time going on what would look like the most circuitous route. You see, all the MTA was required to do was to provide A ride, - -NOT necessarily the BEST ride on the BEST route. MANY times, this would lead to missed appointments-- which would often have to be reset, only to be missed again because of the driver. ....as you may imagine, very few people take advantage of acces-a-ride. I'm sure some lawyer gave them advice on how to make this happen. So yes, this is exactly why we hate lawyers AND New Yorkers.

I don't think they're to long. The problem with these newer nozzles is they're a pain to open and use. They have these slide, move type nozzles that work like crap and end up spilling more gas then anything one you can get it to release the gas. The 3 old Plastic Gas can I have, I just unscrew the top cap, and pull right out the flex nozzle and it seals up at the end. It's quick and easy to use. Then I have this small plastic tank for use with my Chain saw and other devices that need a gas/oil mix. The Nozzle for that. I have to unscrew the top, flip the nozzle from inside to outside. It has some twist lock thing on the bottom and some small spring. I have to push the nozzle down to get it to open so the gas will even flow out of it. It really does SUCK!!! I have one at work I got about a year ago, a 1 gallon size and it's almost as bad. It's how these cans are now made for the CA market!!! I don't just if it's just as bad outside of CA or not? My old cans I'll keep forever as I can't replace them. Not without getting ones with a crap nozzle for them. I don't think any of them are to long. You clearly should be dumb enough to start dumping gas onto a fire, let alone directly into a fire. That is natural selection at work.

This video hits the nail on the head in this video about the Blitz vs. the new "safer" gas cans. I used to have one of the Blitz cans. Just a plain old simple gas can that poured great. Now all I can buy is one of the safety cans which are horrible. You have to stick the spout in the filler hole and use the rim to depress a tab which allows the gas to pour. It is very awkward to use and the gas splashes all over the place. That smug lawyer knows nothing.

First thing I do with a gas can is disable the crappy "safety" features of the spout.... Cut off the ratcheting tab that gets in the way of removing the spout. Clip the lock on the spout that keeps you from easily dispensing fuel and then wire the valve open. They've messed around with gas cans and car gas fill caps to where you have to use a transmission fluid funnel to put gas in your car using a gas can. We have to defeat all of the "safeties" in order to actually do what we want the gas can for...

I love his comments about "leaving it up to the Jury.." Why? Because lawyers intentionally relieve or excuse the most intelligent ones they can get away with disposing of leaving 12 of of the most common folks they can find in the box. The defense seeks not to prove anything, merely to confuse one person in that jury box. I have personally watched IT professionals and Software engineers tossed of Civil Jury's in which the case was directly related to the IT industry and software patents. Lawyers didn't want anyone with a clue in that box.

I don't know what the truth is, all I can do is argue for what I believe to be true; it's up to the jury to decide what's true. Bilk someone . . . they come to an attorney, not the other way around; it's a voluntary transaction. I don't know the circumstances surrounding that event, so I don't know if it's dubious or not. Overwhelming or beguiling a jury, if that is a course that a counselor takes, is a valid one. It is the jury's responsibility to see through the smoke screen, or to allow themselves to be blinded by it. After all, everyone is entitled to a vigorous defense conducted by a zealous advocate. Jurors, while perhaps not perfect, are not stupid. Some of they may be, however, many juries attempt to serve justice.

There ought to be classes taught in public schools about navigating life. Teaching everything from Tylenol poisoning to how fumes from gasoline can travel along the ground and cause a huge flash fire from static alone. But that makes sense and some lawyer will figure out how to sue that too.

Darrell Emerick, the new cans with their crazy valves and nozzles are almost impossible to use without spilling at least a few drops or getting some on your hands or gloves..

It should be the law that you must pay for the other defendants legal defense if you bring a lawsuit and it fails. But guess what? All the law makers are Lawyers... Lawyers even have government lobbies.

The grand jury system has to be totally revamped. The lawsuit system has to be thrown out. We live everyday from the remains of these vultures.

One way to reduce outrageous injury lawsuits is to do something about our ridiculously expensive health care system. Sometimes people sue everyone because it's the only way they're not going to lose their home if they get hurt.

Kauko Laurinolli and then you'd be next. Just like in Soviet Russia or communist China. If you don't believe in the law, perhaps you should go there. The problem is that the people do not consent to their government.

A few years ago, I went to buy a gas can as my old one sprung a leak. With the only one I could purchase, you could not pour gasoline out of it; instead you have to press the outside part of the nozzle against the gas tank aperture to open a valve, so gas could come out.

Lawyers should get paid a flat fee, especially in class actions law suites. Their percentage is more then the sum total paid out per person.

What is needed is 'loser' pays. Blitz won their court case and still had to pay $2.5 million. If the person who sued had to pay Blitz' costs, Blitz would still be in business. Most of this lawyer nonsense would go away.

I could write a book on all the reasons I disagree wirh John Stossel but I happen to agree with him on this topic. Lawsuits have increased the cost of all goods & services tremendously, especially prescription drugs.
