I found the pre-trial arguments (concluded yesterday) very interesting. Counsel's application to have most of the police evidence declared inadmissible pursuant to s 138 of the Evidence Act - a very tricky argument which may or may not succeed - would likely destroy the Prosecution's case, if successful, thus making a full trial unnecessary. However, if it fails, the police evidence is a bit of a gift to the Defence - it clearly shows the unlawful conduct of the police, and it's difficult to see how a properly informed jury could fail to hold up the Defence's argument that Nick&Co's conduct was lawful self defence.
