After a nearly 13-hour marathon session, the U.S. Senate approved by a party-line vote the rules for the impeachment trial of President Trump. This marks just the third presidential impeachment trial in U.S. history. The Senate trial comes a month after the House impeached Trump for pressuring Ukraine to investigate his political rival Joe Biden. Under the rules, each side will be given 24 hours over a three-day period for opening arguments. Senators also agreed to automatically admit evidence from the House inquiry into the trial record. Republicans rejected 11 amendments from Democrats to subpoena witnesses and documents at this stage in the trial. Democrats were attempting to subpoena documents from the White House, the State Department and the Office of Management and Budget. Senate Minority Leader Chuck Schumer spoke early on Tuesday laying out the Democrats’ case for impeachment. “President Trump is accused of coercing a foreign leader into interfering in our elections to benefit himself, and then doing everything in his power to cover it up,” Schumer said. “If proved, the president’s actions are crimes against democracy itself. It’s hard to imagine a greater subversion of our democracy than for powers outside our borders to determine the elections from within.” For more, we speak with Manisha Sinha, professor of American history at the University of Connecticut and author of “The Slave’s Cause: A History of Abolition.”

That's just a bluff. They'd actually have to name the evidence they're covering with privilege. To do that, they have to submit documents. They haven't, and won't. The president is clearly guilty.

The Chief Justice conducts the trial but doesn't write the rules. Once the trial rules are established, then the CJ applies them. The Chief Justice will be able to set some rules as interpretations to fill in gaps.

Looks to me like our conservative chief justice is avoiding being put on the spot by deferring to the Senate majority. Thus, a show trial, to make most of the people think justice will be done.

Do you imagine this hyperpartisan impeachment will have any different outcome than the hyperpartisan impeachment of President Clinton? The Democrats voted to not impeach and have kept Clinton in high regard ever since. The Republicans will do the same with Trump. I would say the Democrats are delusional to see it any other way if they think they have proved their case and people will revile Trump because of their failed impeachment.

I'm no lawyer, but executive privilege is where the president may have privileged communication under some circumstances it is not absolute, and the judical or legistlative branch can provide a showing, it may be pierced. It does not mean ultimate power - the power of a monarch - the very thing the founders feared most. Seculo, pettifogging? Absitively!! [corrected: original cited power of executive orders, oops]

@@Hughster49 Have you read the transcript? I have. The constitution, it too is worth reading it informs executive privilege through separation of powers. Scotus has ruled it may be used under certain circumstances and can be outweighed if the branch seeking documents can provide a showing to the merit of the release of documents. It's about privileged communication - not absolute power. The whistleblower testimony provided the showing.

Intersectionality is a theoretical framework for understanding how aspects of one's social and political identities (e.g., gender, race, class, sexuality, disability, etc.) might combine to create unique modes of discrimination. It aims to broaden the agenda of the first waves of feminism, which largely focused on the experiences of white, middle class women. The broad agenda means that intersectionality is used to find combinations of injustices that are felt by members of society. Alan Dershowitz, scholar of United States constitutional law and criminal law in answering a question on the criticism of Israel by intersectional movements, he stated that the concept of intersectionality is an oversimplification of reality that makes LGBT activists stand in solidarity with advocates of Sharia, even though Islamic law denies the rights of the former.
