It is part of our fundamental belief that a person should be considered innocent until proven guilty -- and that a defendant should be able to help with his or her own defense. The person may have to mortgage his or her home to post bail, which gives a strong incentive to return in order to receive the bail money back, and not lose the house. Bailbondsmen guarantee that the defendant will appear for court -- they put up their own money, and track down any "runners". It is in their interest to keep track of the defendant, lest they lose their money. Some states (Wisconsin is one of them) do not allow for bailbondsmen. In such a situation, if the defendant is unable to raise bail, he or she remains in jail. The problem with the Minnesota Bail Fund was that it was donated money. When it was lost through the commission of a subsequent crime or through the failure of the defendant to show up for court, no one was hurting -- it was in no ones interest to prevent the defendant from committing additional crimes.
