@@TopMusicAttorney hello it seems like there's not alot of distribution companies that are not that great I started with tunecore then I left them and went to distrokid I didn't like the additional fees like promoting, youtube i.d and etc you would have to pay for annually currently I'm with cdbaby so far I don't have any issues I noticed they partner with the mlc if you get a chance can you do a video on that. Also I have a question when submitting your music to these music licensing companies I notice they have a section called playlist names. What is that? Do I have to write in that section the mood of the song, the genre of the song or what my music sound similar too like justin timberlake or bruno mars I hope to hear back from you take care.

Question: I was thinking , if a company or someone promotes another company or individual, wouldn't somebody paying for streams or something just be another way of promoting? I don't know much about this stuff but that was my surface thought when I first heard it. Another thing if someone created something , it's simply not right for anyone to keep their fruits from that. Just because someone creates a bad contract and someone falls for it, it doesn't make it ok to take the creators money. In that case people could just make up stuff to unjustly enrich themselvrs or their company .

I hope you will deal with the Copyright Royalty Board that sets rates for small Internet radio stations and streamers. They have pretty much shut down small stations while over-the-air radio stations don't even have to pay any royalties. That limits the ability of small artists to be heard and small Internet stations to exist. I was an Internet Radio pioneer since 1998 when we uploaded using 33.6 modems!
@TopMusicAttorney6 ай бұрын
Love that you were a internet radio pioneer! Especially with Independent college radio, there is not a lot in place collections wise, and certainly a lot of misunderstanding, which ultimately ends up resulting in artists not getting paid their public performance royalties. Appreciate you being here!
@TonyThomas100006 ай бұрын
@@TopMusicAttorney Yeah, I started in college radio when I was in high school. I went to broadcasting school out of high school but did not get my first radio gig until I moved to LA in 1979. I loved back to CLE in 1989 and worked at 3-4 radio stations including almost 10 years at a jock on Soft AC stations. Around 1998, I was with Internet Radio DAER for a few years. Around 2008-9 I was with Legato Cafe. Internet radio pretty much died off when the royalties came in. They could not make enough $$$ to survive. The only platform that seems to be surviving is Live365 and to have a decent reach, the base price is around $100/month.

All of the big 3 (4?) services have issues. Distrokid is quite possibly the worst of all. They're still distributing another artist's music to MY official channels. I told them to remove their stuff from MY channels, and their reply was "Sign up for a membership and pay us, or we won't remove the other artist's work from your channels." How exactly is it legal to distribute anything to someone else's channels when you're not their distributor... and then refuse to stop?

1:20 The distributor would not need to return any money to the DSPs or advertiser because the distributor would already discount say the price of the advertisement by the expected percentage of fake/botted streams. I.E. Spotify knows 5% of its streams are bots, so it charges advertisers 95% of the actual cost to account for the 'missing' 5%,. How this discount is applied will vary, but if someone pays for 100k people to view an advertisement, Spotify can reasonably expect 95% to be real views, so they give out 105,264 impressions of which 95% will amount to 100k real views. To micromanage the distribution of botted/fake plays seems way too dense of a task to even be financially feasible. I think advertisers are happy with the assumed percentage
@TopMusicAttorney6 ай бұрын
I also believe that if a DSP suspects bot plays, they will withhold the royalties. I'm perfectly fine with there being mechanisms in place to prevent fake streams, but a part of the problem is that no one is proving the streams are fake. Just simply saying it and then withholding artists' money.

As part of my content creation, I want to create videos that primarily feature music paired with my images. These videos are intended to provide a music listening experience to my audience, where the visual elements serve to enhance the musical atmosphere without overshadowing the music itself. Does DISTROKID offer a service allowing me to use your music and my images to post on KZbin? I aim to monetize these videos on my KZbin channel, which is not affiliated with any major corporation.

Not that I am aware of. The labels and publishers have separate agreements with TikTok and other social media platforms to collect royalties. But if you saw recently, universals license with TikTok expired, so as of now the music owns by universal is not allowed to be on TikTok platform, and if it is, proper payments are not going out to universal. Blah, blah, blah... Time to pull the trigger! you tried to negotiate. got nowhere all that is left is to say I tried and give up, or you can file a lawsuit. Put your 200k law degree to work, take them to court. You may not make much if any money off your lawsuit unless you can get punitive damages but if you win you may get some big dollar clients in the future, also after they are served you may hear from them that they want to talk again and will take you seriously now.

Love your channel, love your content and advice, really appreciate it. Would you mind stopping that weird random cuts in and out of the same shot thing on your videos. It's super distracting and makes it hard to focus on what you are saying. You will never see that on a professionally edited show. Nobody cuts to a closer closeup of the same close, It's just not professional. Try slow pan ins or cut away to an insert before re-framing your close up. It will look 100 times more professional. Everything else about your videos is super professional. If you stopped the (maybe auto randomly generated) close up cutting, your videos would be as professional as your content. What's that you say? Other KZbinrs do it. Yes they do and it looks equally bad and amateurish on their videos too.
