Hi @anthonymarinac fantastic content.... you have taken what could be an extremely difficult concept to grasp and broken it down to its nuts and bolts again.....The title of "The Great Explainer" was already taken (Richard Feyman RIP) however I think his spirit is still alive. Gratias tibi ago

We need a domain an website that Anthony can run courses direct to the law students those that are interested in learning law an those that have the time to study retirees in a second career .He is the best this country has love his work an abilities matchless by far.

Thanks again Anthony. Just to clarify, and I understand that you may not have the time. Why do you think Justice Brennan does not refer to, or consider in his ruling the paragraph in the crimes act s.23-(3) “Conduct of the deceased does not constitute extreme provocation if- (a) the conduct was only a non-violent sexual advance to the accused.” As stated by Justice Kirby the non violent sexual advances of the deceased would cause no reasonable person to act as Green had. Did this case create a precedent that violent retaliation is defendable as provocation if the perpetrator has a history of sexually abuse and reacts to unwanted advances in the same way as Green did?

Hi Jase, I haven't watched this video in a long time, but unless I am completely off the mark, I'm pretty sure that the provision you mention there was inserted by the parliament *after* Green's case, in response to that case. I remember that the time that the majority of people were appalled at the High Court decision. There was still a lot of homophobia in Australia at the time, but even people uncomfortable with homosexuality could see that a homosexual advance shouldn't excuse murder.

Fabulous video.. but appeal allowed doesn’t necessary mean success, does it? In you second screen, it’s appeal allowed and dismissed. 🤩

Ah. You're thinking of leave to appeal. So sometimes a court will grant leave to appeal, but then dismiss the appeal. "Appeal allowed" means the appelant wins
