Okay, and what's your point about vaccination. You don't think people should have them.
No, if you want a vaccination by all means like go get one. But I think that coercing people is like threatening termination and a job ought to be illegal in the United States. You can't make someone receive a medical like operation or anything like to work somewhere, can you? So why should we force people to get vaccinated to stay employed?
What would you be comfortable going to work if you knew that someone there had leprosy?
I think if someone is covid positive.

Note on the AIDS pandemic: you are legally required to disclose that you are AIDS/HIV positive to someone before you have sex with them. You're also not allowed to donate blood. There are plenty of legal restrictions based around people who may transmit AIDS/HIV, so this guy's point falls flat

The epidemic happens to a single country. Pandemics are international. AIDS was a disaster because of Reagan bit AIDS was managed better by many other countries. Reagan murdered gay people left and right and only after millions died from AIDS and it was all over the straight community did we act.

I’m in my 30s and STILL know there is MUCH to learn. I used to be left leaning but have definitely come to the center. The right is wrong most of the time, but definitely not all. Both sides think they’re right, but that of course can’t be true. When it comes to keeping your mouth shut, don’t. Asking questions is the best way to gain more knowledge. Trying to figure out what is BS and what is not is the challenge.

Don’t keep your mouth shut kid, being involved in open honest discussion is critical to learning … But more so, having respect , empathy and truly trying to listen to the other persons viewpoint and wanting to understand it. If you can do that last bit you’ll be a good person who can make a difference … And hey don’t worry about being wrong, you can learn more off that often then being right , but if you try and understand other peoples views who you may not agree with rather than just dismissing them because they are different to yours is the key … keep debating - with respect …

I am not in any sense of the word conservative, but I have not had the Covid-19 vaccine. I told my GP, who has given me all my vaccines, including the shingles vaccine, that I am unvaccinated with regards to Covid, but will get vaccinated against Covid-19 as soon as she can administer the vaccine. When I told her that I have been exposed to Covid at least 4 times in the past few months, but have not got Covid, her response was, it is very unlikely that I have not had Covid. My dentist, who I would also accept the vaccine from, agreed, and added that he, who is vaccinated and boosted, has probably had Covid, but doesn't know because he has never been tested. About two weeks ago, I was at by brother-in-law's retirement party, and my youngest niece, who is vaccinated and boosted, was gibing me hell because I'm not vaccinated. Now she and her hysband both have Covid, but I still haven't had Covid, to the best of my knowledge. BTW, I am 68 years old, and will soon be 69 years old.

Honestly. And even if you want to approach the issue from the capitalist's side: should an employer not be able to institute rules to ensure the operation of their business? If a covid outbreak happened in your factory and suddenly half you staff are out sick or quarantined, that's a big problem. Should that business owner not have the right to put rules in place to prevent that from happening? I think it's the shittier argument but might be more likely to get through the skull of some selfish libertarian type.

It's different when vaccines are harmful but the authorities are lying about the risks and covering it up. It's not true that everyone exposed to polio virus gets it. There are holistic approaches to these diseases and holistic solutions that work. The risks need to be fully disclosed and people deserve the freedom to choose. Where there is risk there needs to be a choice.

Almost everything this guy says is ignorant, and I don't know why HIPPA is part of the convo. When I was 22, I knew people who WISHED the polio vaccine had been available when they were kids, because they lived through it. I knew people who WISHED the government had mandated measles, et al vaccines, because of family/friends who would have lived. Today there are living people who might have died, and dead people who would have lived, but for the Grace of Choice.

People with no knowledge of what a covered entity is or a business associate love to throw around HIPAA in contexts that make zero sense. In this call's case, a company that is interviewing a prospective worker.

The caller is clearly misinformed. But Sam's statement at 12:53 seems out of line with current practice. When does Sam imagine an employer asking a candidate, "Do you have any communicable diseases?" The US Equal Employment Opportunity Commission makes clear that a question like that should only (if ever) be asked after an offer is made, i.e. without contingencies.

Not to mention that “natural immunity” isn’t permanent, especially for highly transformative diseases like the Flu, the common cold (which always mutates) and now Covid. Guy is immune from a strain of Covid, which loses its effectiveness within 6 months.

It’s actually natural to go ‘well what about this’. It’d be nice if everyone took the time to acknowledge other peoples points where and when they have them but in reality most people associate being wrong with negative consequences and obviously seek to avoid them. A lot of brain stuff but basically when you are ‘proven wrong’ in conversation it is natural to trigger a fight/flight response. But to your credit it would be nice if more people could learn to anticipate these reactions and hopefully be able to think more clearly during interactions.

I'm actually surprised Sam didn't catch this, but HIPAA laws actually only apply to people in the healthcare industry and anybody asking someone about their medical history isn't a violation. HIPAA laws involve the protection of your private medical information from the servicers and the people who store that information. Ex: A hospital cannot share your medical information with anyone without your consent. But if someone ASKS YOU your medical information and you tell them, you have therefore consented to having them know. Now of course you don't have to provide someone your private medical information if you don't want to, but they also reserve the right not to provide you with a job if you can't verify that you are not a medical danger to the other employees around you.

Have you looked at the Pfizer documents that have been released so far. The only reason why Pfizer is releasing the documents now is because they were ordered to by a federal judge. The 4th dose gives no protection against infection after just 8 weeks and this was a study that came out of Israel. If the vaccines worked so well we wouldn't be having 500,000 Covid cases per day. We have more infections today then we did before we had vaccines.

My parents for an example got the J & J vaccine and they both say they are not getting any booster shots and who can blame them they were told that the J & J vaccine was a one and done deal.

How righteous of you. That’s the result when someone has a flawed argument or is incapable of coming up with a better argument. For example, from a public health stand point a forced COVID vaccine would remotely make sense of it’s proven that a vaccinated person was unable to transmit the disease. However, studies show that COVID is just as transmissible from a vaccinated person from a non-vaccinated person, thus an argument for why a vaccine mandate isn’t necessary. This guy was unprepared for a discussion. Many other individuals could have easily wiped the floor with Sam on this topic.

@@Ariaga_II That’s not the entire point. Yes, someone can still pass COVID with a vaccination. But there is an INFINITELY higher chance they recover from it without BEING SENT TO A HOSPITAL OR DYING. Not to mention the fact that it lowers the risk OF CATCHING IT IN THE FIRST PLACE. Keeping up, ding dong? The data bears everything I just said out. What’s the evidence you have that proves the vaccines aren’t effective. And effective in this case means: lowering hospitalization rates, lowering deaths from COVID, and reducing the overall amount of COVID cases among majority vaccinated populations. Go on. Try.

Thats not a right wing thing, that's a radicalized thing. When people are too right or too left they make up their minds before even thinking about the issues. I have a radical leftist friend who has told me many times that I should lose my right to vote because I always vote conservative (we live in Canada) and all others like me. He believes the only people that should be on the ballot running are liberals. He's also said multiple times that anyone not believing in liberal ideology should be force by law. I've explained to him that he's describing a dictatorship but he says that impossible because it would be a liberal government. There's radical politics on all sides.

You can't force people to be vaccinated (except in cases were a person's freedoms are considered void, such as in military service), but that doesn't mean you are forced to allow them to freely endanger others with unrestricted intermingling.

This is not entirely true - your employer's Benefit Administration team may have access to your PHI (via sign up sheets and billing resolution documentation, for example) and if/when they do, they are thus covered by HIPAA laws. However, an employer asking about your vaccine status does not run afoul of any HIPAA laws. The caller is completely wrong in his understanding of HIPAA.

Exactly. I love when people bring up HIPAA around things like this. It clearly shows they just learned an acronmym and throw it around wherever they want. HIPAA only has to do with confidentiality with your doctor and third parties. Any Joe Schmoe can walk up to you on the sidewalk and ask about your health and they aren't going to be violeting any law. You have every right to keep that information to yourself, but HIPAA has nothing to do with it whatsoever.

Many businesses and employers do not care because they are putting profit over lives which is fine because this is capitalism. I don't see to many businesses in my area enforcing any mask or vaccine requirement. The businesses were very eager to lift all the restrictions as soon as the mandate went away, so obviously they were being forced by the government.

@@opencommentsbbcnewsnight1704 No, the logic is consistent. "my body, my choice" is in reference to a women's right to choose whether or not to have an abortion. The logic is that the government shouldn't have any sort of say over what women will do with their own bodies. The logic holds for the COVID vaccine, because the government never forced anyone to get a vaccine at all. That was your employer applying coercive pressure. The government mandated that the corporations TEST their unvaccinated employees for the safety of said employees. The corporation would rather force you to get vaccinated, or fire you, than PAY to get you tested every day. At the end of the day, private corporations acted fully within their own rights to willingly fire people rather than pay a little extra to keep their vaccine-skeptical employees around.

Exactly! Yet even the mainstream, neoliberal media chooses to feed the fire by continuing to refer to the workplace regulations as "vaccine mandates". And it was funny to see this kid say he was against vaccine mandates because employers don't have the right to demand their workers undergo medical procedures - but then immediately say he was also against testing. Even though employee testing (for drugs) IS standard, accepted operating procedure throughout multiple industries.

Even with vaccinations they would still be required to do mandatory testing, as far as COVID goes. The CDC said that even if vaccinated, you can still catch it, spread it, and get sick from. The shots just mitigate the symptoms. Hell, CDC had to redefine "vaccine".

Yeah, not really. He was dismissive and condescending, as is his habit. I liked the part where Sam either revealed or pretended that he believes that the government regulating how companies impose upon the rights of individual citizens is equivalent to the federal government doing the same. That wasn't a solid trap. That shows a gross misunderstanding of how rights function, and the government's prime directive to safeguard and respect them.

This aged well, first off masks did not work secondly these specific vaccines work but don't work basically to save 1 hospitalisation you have to vax around 160 thousand people to prevent 1 death it's around 3 or 4 hundred thousand need vaccinating. It doesn't stop transmission either, you can argue we didn't know that but some Dr's and scientists did tell us all this early on.

The pandemic taught me that massive retirement communities like those in FL are dangerous. During a widespread contagion where all the elderly folks are afraid to go out, there are no younger neighbors around to check on them or bring stuff to their porches. And they are well within their rights no longer employ you if you do not have the vaccine. You can find work that doesn't require it. A fetus doesn't show consciousness until nearly 5 months in. It doesn't know it exists. It is wholly dependent on the mother for survival and it's body cannot sustain life without her. The "spark of life" is derived from religious text and has no place in law in this country. As far as counting covid deaths... Even if 10% of the deaths were misreported, which is highly unlikely, it's still more than 900,000 deaths. Claiming that the numbers are bogus is ignorant at best. I'm assuming you're just spouting the Republican talking point about the guy who died in a motorcycle accident in Florida. He tested positive for covid post death and so it was listed as a contributing factor. Well the CDC reviewed that case and rejected it so your point is moot.

Here is what needs to be explained to these "rights" advocates. Rights do not exist in a vacuum. You as the individual are not the only one with rights. Other people have rights too. That's where things get tricky, where those rights intersect with one another. That's where rules and law have to be created - to sort out which rights get prioritized over which other rights in certain situations. The common phrase is "Your right to swing your fist around ends at someone else's chin". Yes, right to privacy about your medical information is a real right. And he asked Sam "where should that right end??" Well this actually isn't a tough one. Your right to medical privacy ends where it affects others around you. In other words, when you may have a communicable disease which affects others. It's really not that complicated. In conclusion, you're not a "champion of rights" if all you're capable of doing is focusing on PARTICULAR rights and completely unable to think about OTHER PEOPLE's rights (the right to not be killed is a pretty important one). Even a junior lawyer wouldn't be that ignorant, but of course most of these people are 24 year old know-nothings like Sam said.

He seems to believe that employers can’t ask you your vaccination status because he has “HIPAA rights.” There is no “rights.” The legislation is directed to those who are tasked with keeping your PHI from being released. Regarding an employer asking his vaccination status, he does not need to answer. But he’s not going to keep/get the job.

The caller having "biracial" children is demonstrative of not caring about white demographics since his own personal choices have the effect of reducing white demographics. The way for him to have biracial children is with his non-white wife who he identifies as black. Even before the vaccines rolled out, the pandemic could have been over within a couple months at most if people had simply not chosen to be assholes, worn masks, and practised social distancing. The vaccines wouldn't have become necessary to start with. Masks and social distancing is just the bare minimum one could ask for, barely even registering as inconveniences, but instead people chose to throw fits in stores or wear "masks" that literally have holes cut in them. Even the US's complete balls-up of a response to the pandemic still reduced flu rates to about 1% of what they were in 2019.

Mothers commonly dying during childbirth was also something that was "a fact of life" a long time ago, but we realized that we need to learn how to better prevent that. It's weird how some people point to past generations who didn't have access to what we have readily available now and say that's the real goal to shoot for.

I"m surprised Sam wasn't immediately aware that an employer asking questions about your medical info is not a violation of any HIPAA laws. HIPAA prevents the hospital from sharing your data without your permission. It doesn't stop anyone from asking you to volunteer it to them.

It also doesn't stop schools or employers from requiring proof of vaccination. which i suppose is a form of volunteerism as no one is forcing you to go to a public school or have a certain job.

"Maaaa Hippuh!" is a right-wing talking point that might have generated from the great American philosopher Marjorie Taylor Greene. It was BS when she first blurted it out, it kept being BS the next dozen times she yelled about her "hippuh" and it still is BS now that it has been adopted by junior philosophers like this caller. (Well, it's not HIPAA that is BS but it's not applicable in the context in which it has been and keeps being evoked by these folks.)

Only one issue here. As far as I’ve been able to determine, there was no effective vaccine for influenza during the 1918 Spanish Flu Pandemic. There was a vaccine against a bacterial agent incorrectly believed to cause influenza. Influenza wasn’t isolated until 1933, and the first influenza vaccine was developed by Jonas Salk in 1938. If anyone was vaccinated in 1918, it wasn’t effective against the pandemic flu.

COVID is no joke. I had the vaccine and booster and was really sick for a few days with a fever of 101.5 and it took me almost two weeks to completely recover. I’d hate to know what it would have been like without the vaccine.
