Applause erupts in Cleveland court as 1987 murder case dismissed after man spends decades behind bar

After spending more than three decades behind bars, Dwayne Brooks is now a free man.
Applause erupted in the Cleveland courtroom during an emotional hearing Friday as Cuyahoga County Common Pleas Judge William McGinty dismissed the case against Brooks in which he was convicted of aggravated murder connected to a shooting that happened at Luke Easter Park on Aug. 17, 1987.
Fast forward to April 12, 2023, when Brooks was granted a new trial as court records declare it was found “that several exhibits were not disclosed during the discovery phase prior to trial in 1988. The Court specifically found three exhibits to be exculpatory, and three other exhibits to be favorable to the defense.”

It's nice they freed him, but applause in the courtroom is prohibited. Applause is prohibited anytime, my man. You do it, you do time. It's a felony.

Perhaps you should follow the case. He was convicted on the testimony of two people that avoid the death penalty in a deal struck by prosecutors to say this man pulled the trigger. They each spent less than 15 years in jail and one was a target of a federal investigation that went away. A good deal for them. Meanwhile, Cleveland Police took eyewitness statements from two women that saw two men jump from a van and shoot the victim. Brooks was not one of the two men - they testified against him - and the accounts conflict - the assailants have an extra person in their version - Brooks. The women could not pick Brooks out of a lineup. Prosecutors at the time read discovery to the defense attorneys. The prosecutor couldnt recall if he read this; the defense counsel was adament he did not hear that - it destroyed the states case. The case prosecutor said the police must have forgotten to turn over a police report clearing the man. Mr Brooks was wronged.
