Thanks I ended up doing research and in NY its mandatory for the employer to provide short term disability benefits for non work related injuries!

I have been a state employee of Georgia for 4 yrs... I have short and long term disability, in the last 4 months I have been diagnosed with severe sleep apnea..I am now using CPAP machine..I have fallen asleep at the wheel twice and have 2 formal write-ups in my file.. I was told by management if it happens again I'm fired..I started a 2 week vacation today..I have to have a narcalepsy test, during this 2 week period.... Do I qualify for short term disability and if so, how do I apply..I have doctor's appointment on Monday to schedule narcalepsy test..

First and foremost, you would need to know what coverage you have with State - and who is writing the policy. We would not be able to determine if you would be eligible for benefits without knowing additional information, specifically, your medical documentation and doctor support. It depends on your short-term disability plan. You should review your disability policy carefully to see if injuries occurring from work are covered.

If I go on long term disability from work am I entitled to Social Security benefits? I am on short term disability at the moment and my doctor thinks that this will be a permanent disability. Thanks in advance

SSDI has its own set of rules and guidelines in order to be deemed disabled by the SSA. You would need to consult with an attorney who handles SSDI claims in order to best assess the likelihood of success in securing SSDI benefits through the government.

What if your employer has no disability coverage and no Family leave and sick leave is exhausted but there is vacation time accrued and employer is not paying vacation time due.

Most companies and disability admins have Essential job functions lists for each job code per company client. Soo I think there is some bias against admins and insurance companies because denials happen, but really gets claims denied a huge percentage of the time is not getting paperwork in by due date. As well lack of objective findings, which if some MD's can't answer certain questions to have chart notes turned in for review. Disability insurance is great and there has to be a fine line between just approving and having objective evidence for approved pay outs. There is no point approving if you and the provider can't prove why you can't do at least one or more of your job functions based on your disability plan underwriting.
