The legal battle between the head of the label ADOR and its parent company HYBE continues and for more on the latest events I have Yun Seokchun a partner at Peter & Kim live on the line.

1) Seokchun, let's begin with the latest development on the legal front regarding the dispute between ADOR CEO Min Hee-jin and parent company HYBE.
2) Seokchun, NewJeans members, for their part, have filed petition letters in support of Min Hee-jin.
How does this reality look to affect the court's decision?
3) Seokchun, what events can we envision following the court's decision ?
4) Seokchun, in a fresh twist to the ongoing dispute between ADOR CEO Min Hee-jin and HYBE, ILLIT's label has sued Min for defamation.
Do give us some background and your thoughts on how this legal battle looks to unfold.
5) Seokchun, the hiring of an entertainment dispute lawyer by the parents of NewJeans has sparked quite a bit of speculation about a possible confrontation with parent company HYBE.

How do you explain this fortunate reality?

If you don't have the ability to listen and judge Korean directly, the first step to understanding the culture of that country is to perfect your Korean proficiency. ☞In a fable, three blind men touch an elephant and each describes something different... Just as the blind men need to open their eyes and see the elephant, if you're not at the level to listen to and understand Korean directly, it's better to stay quiet. Have you ever thought about why Korean people support Min Hee-jin? You can't grasp the true essence without knowing Korean... It's like trying to enter a highway but not finding the entrance and just wandering around aimlessly on the side.

@@finnlinnsone it could be but similar concepts are very, very common in kpop. They could sometimes be considered as "trends" but others would take it as far as to call it plagiarism. If anyone should be considered as someone whose work/idea is plagiarized, then it should be the first one who did that particular hairstyle, or that particular clothing style, or that specific concept. Unfortunately, it's not MHJ or NJ (no hate to those innocent girls) but the people from whom they got inspiration from. There have been lots of times when BTS's concepts were imitated but no one in their company really burst a vein with plagiarism accusations. If she's confident with her group and everything that goes with it, imitations of concepts shouldn't bother them or shake their confidence. The imitator who appears weaker would only look sloppy.

MHJ is a manipulative woman who met with potential investors behind HYBE’s back in order to back her in stealing ADOR. Luckily those investors went straight to HYBE and told them about the meeting. And here we are today. The court must allow the dismissal of MHJ so that HYBE can move past this debacle she created.

@@jennierose4736 You don't need to be a lawyer to understand that Min Hee Jin seeing investors to secretly acquire ADOR is not going to look good on her. Especially when those same investors came running to HYBE ratting her out because they don't want to be involved in something criminal that could get them in trouble. And this is on top of her trying to contact the accountant in charge of BTS which she has no business in contacting in the first place. Both sides still have time to send evidence into court by May 30 but I can't imagine how she's going to explain herself with what HYBE has already submitted. Edit: Whoops, last day to submit evidence and arguments has already come and past which is on May 24. May 30 is the shareholders meeting date and the court should render their decision before that.

finally, arirang! you got a couple of resource speakers who provided credible scenarios of possible outcomes in the dispute of min heejin against hybe. unfortunately though, min heejin has set a bad example for corporate korea to overseas investors. who'd want to partner or invest with a korean if min heejin sets the example of someone who uses the money & resources of others for his/her benefit and then leaves the partner/investor empty while engaging in a malicious negative PR campaign to destroy the image & reputation of the partner/investor? with her unprofessionalism on show to the entire world, can koreans really be proud of min heejin as korea's poster girl for good business practice?

@@MrRdlv The profit does not come from MHJ, but from NewJeans. MHJ didn't write a single musical note or a single verse or a single dance step of their songs, she just gathered the staff and said: "This group is called Jeans, copy the music, the concept and the choreography, you bitches bastards".

Wow MHJ tricked the whole country and still New Jeans' new song already appointed as plagiarized. What a mess 🤦‍♀️ Pointing that everybody plagiarized her when she was the one that does the "copy and paste" as a master. I never saw NJ thank Hybe in any of their award acceptance speechs, they were probally instructed to not do that. The parents blinded by greedy. Let's not forget she mentioned a lot of groups in a negative light. That's not ok. It created a wave of hate for these other groups. Crazy mess 🤦‍♀️

Exactly, these girls never thanked Hybe in any award show or interview. I would think they were instructed not to. But whose resources are they using. Who provided them the luxuries they have now. They even uses the name of BTS to promote themselves. And then a member having the gall to complain that Bang PD did not greet her. Am pretty sure MHJ and her minions concocted all these. The parents should have known better by shielding their daughters instead of taking part on MHJ's ploy. Either they were clueless that they were being manipulated or now that their daughters started to be famous, it has gotten to their head and no humility left in them.

There are other fan bases involved. Bunnies and Ador involved other groups into this fight. This entitled behavior leaves a bad taste for others. New Jeans and MJN didn't invent anything they took what came before from groups in Mexico and Japan and built on that. To pretend anything else is to insult fans of other groups and the groups from other countries who New Jeans work was based on..

Good one! And to add to this --- we all know Pop Music is a formula that goes way back into Michael Jackson and even the Beatles. Because thats whay Pop culture is --- building on what has worked with mass audience (ie. POP-ular taste) and giving it your own flair in accordance with the evolving palate of the market. And KPOP has copied it from JPOP and the West as well. This girl is crying wolf just because she wasnt given her bottle of milk. Pretty sure no one would want to work with her after this.

@@MrRdlv I never saw a Korean singer in Western media before Gangnam Style, and I didn't see one again until BTS. Maybe SNSD (I googled them, not knowing who they were) were broadcast on Korean radio in the West.

Not even close. 1st and 2nd gen paved the way. 2nd gen groups (especially SNSD, 2NE1, BIGBANG and SHINee) are the reason why K-pop even managed to go from niche to a globally loved genre. They were the Hallyu wave boom that paved the way BTS walked on. BTS' accomplishments are incredible, but please stop misusing the term "paved the way".

​@@finnlinnsoneBTS paved the way. Bang Chan from Straykids, Jihyo from Twice, and Sunmi said it. BTS paved the way kpop to western country. Psy have only one hit song and general public at that time did not know he is from Korea. Many people think he is from China. BTS have many hit songs and have many real fans. They even made their fans visit to Korea. A university in Korea did research the economical impact of BTS including turism. It is the fact, regardless you like or not.

MHJ 's defense is that she's in a 5 yr contract which ends 2026. But I would think there would be clauses in the contract for grounds to terminate. So Hybe needs to provide strong proofs that such conditions were violated. I see her as a cunning, greedy and devious person. Just with her plot to takeover Hybe is already a big reason for Hybe not to trust her.

MHJ caused the financial loss of Ador and Hybe shares, working with a person like that is like having landmines in the office corridors. If Hybe had not been tipped off, MHJ would have made a hostile takeover of Ador causing Hybe to lose hundreds of millions of dollars. If Korean justice takes her side, it means it's just a jungle there.

MHJ will be fired either way, because if they lose the injunction. They still can fire the 2 directors, and replace them. Then remove her as CEO, in which she will only be a director then. That is legal standards since CEO’s are voted into position by the board of directors (which will be the 2 replacement directors). She won’t have any power that can’t be blocked at that point. She may want to resign at that point. I’m glad too, just too much drama for a business setting. Hybe gave her too much power, when she had no experience in corporate rules of conduct. She’s guaranteed nothing, if she doesn’t know how the business rules are laid out. Hope Hybe learn from their mistakes in this situation. She was giving way more leeway than what she would have received here in the US, regardless of her Theatrical actions.

@@MrRdlv Yes, but now NJ’s parents have put NJ in a bad spot by supporting MHJ. They should have stayed out of the drama. By going to an attorney to draft those petitions, means that they have taken a side. What do you think you would do if someone or group took a side against you when you have supported everything for them even asking BTS to support them. The contract will be honored but they have created an issue for themselves now. Understand that all presented information was shown to the parents in a meeting but they still are pushing the narrative. The girls are too young to understand the importance of their actions. The parents however knows what they’re encouraging the girls to do. There will be a cost for their actions. I hope the best for them though. Stock holders were watching all of this as well, and they have votes into what happens in the company they invest in. New rules will be introduced because of this case. Loyalty is important, they have given the perception that they’re not happy with what was generously offered them. Which was better than any Korean rookie teams offer.

@@deniselee6334 their concerns are valid. After consulting with park jiwon about this matter, he said he would bench new jeans for 1,5 years. Also the parents kinda owed min heejin a lot, NJ already got the bag, 5 million USD each. Bang sihyuk actually collected 100 million USD from 11 million investment, I don't know why he debuted ilit after collecting new jeans money.

@@MrRdlvThat may have been because they were aware of MHJ already. They weren’t blaming anyone but MHJ, then later they mentioned that they felt that MHJ was tricking the parents & the girls. They may have only wanted to deal with the MHJ issue first, then later address the parents issues internally. Remember previously every discussion was going through MHJ. They would worked out everything but MHJ added other demands not related to NJ to the discussion. She knew she was in trouble, then blasted HYBE publicly to protect herself, affecting NJ in the process. Hybe had to file charges because they’re a corporation, that’s legal standard. They could have gotten into more trouble with stockholders if they didn’t do it the legal way. The parent should have tried to talk to them to better understand the legal issues involved. Hybe followed corporation law standards,while trying to manage public opinion stirred up by MHJ PR campaign. I 👏 👏 at how they handled everything . Understand that they have international stockholders watching all this. SK was not looking good internationally.

I'm telling you right now that international fans can see how corrupt Min Hee Jin is. She has chats saying calling a female employee going to her for sexual harassment name and saying she wants to "murder" said female employee and called a New Jeans member a derogatory term. Please report on that. Also, many fans internationally are dropping New Jeans because of Min Hee Jin's corruption. Many of us don't understand why Min Hee Jin's hostile takeover isn't being reported fairly in Korean media.

I was hoping NJ would of stayed out of it. I had no issues with them personally. But since they chose the side blindly might I add. I lost all respect for them for biting the hand that fed them. So no I hooe they don't continue. There are better out there. And they parents should ve ashamed of themselves. Maybe that's harsh on the girls since they are teens but then they should of shut their mouth and stayed out of it. Even with all this stuff HYBE was still helping them with promotions. I'm so disappointed.

The lawyer didn't provide much analysis, just gave a summary. Didn't even answer the question at 4:25 well, just listed the only 2 possible outcomes which we already know. The 2nd guest is purely speculating and doesn't back up her points well with examples so they just sound like her personal delusions.

What i find weird is people thinking that the impact of change might be an issue yet the toxicity of mhj staying at hybe would be too much. Btw if i am mhj and you seek to sack me, i would just resign and sue. Yes, the girls sadly will be impacted. However, just like children lose a teacher, if they have resilience and talent, they will survive. If they have only been relying on 'plagiarism of foreign acts', they will crash.

Court's verdict On Thursday,5/30/24 the Seoul Central District Court stated that Hee-jin had "clearly" sought independent control of ADOR. However, she didn't progress to the actual implementation stage. The court further stated that it amounted to "betrayal" but not "breach of trust" as claimed by HYBE

It is greatly amusing to watch Korea go through its endless series of entertainment/business "scandals," which are basically nothing more than another arm of the overall entertainment experience, in which the media plays its part as ringmaster and hype-facilitator. I think HYBE has the right to forcibly fire Min Hee Jin, but since there are so many points to discuss, I think the dismissal meeting should be postponed for about two months. Min Hee Jin has a strong personality and I don't like her, but I hope we don't live in a society where people who express their opinions to powerful companies are immediately treated as criminals and forced to pay compensation. I speculate that the main reasons for HYBE's stock price decline are weak group management, including allegations of fraudulent marketing, involvement with religious groups, and sloppy concept management. (I don't think the court will be able to make an overall judgment unless they also investigate HYBE's suspicions.)

If the court does not issue a ruling on May 31, the shareholders' meeting will follow the usual rules, according to which obviously all shareholders vote. You can't change the law just for MHJ. Possibly, afterwards, MHJ can challenge the dismissal in court, if she believes it is unfair. If the law prohibits firing an employee for her protests, the dismissal will be canceled; but I am almost certain that in Korea there is very broad freedom of dismissal. It sounds like you're being misled by the size of the employer, but if it were a convenience store with a complaining (and stealing) clerk, it would be the same thing. Hybe will fire her with some reasons: if they are valid, MHJ will not be able to oppose the dismissal. Maybe you will never have an employee in your entire life, which is why you are on the employee's side; but if one day you have him, I hope he will do to you what MHJ did to BSH. But you will have to wait two months to fire him, if you have any dignity.

All of those things you are talking about like religious cult, fraud, etc. are recent allegations or trumped up rumors that could all be part of the PR scheme that MHJ is said to be plotting. Allowing her another 2 months to continue the campaign and ruin Hybe is just playing into her hands. I would hate to see Hybe end up in her hands or those of Lee Min-Soo. They would destroy it and all the artists involved.

The situation is straightforward: it all comes down to how the court rules in the end🤨. If HYBE had any written documents to definitively prove Min Hee-jin's fault, this wouldn't have dragged on for so long. Using LINE conversations as evidence? That wouldn't be sufficient in Taiwan either. HYBE is wealthy and can wage a public opinion battle, being a publicly traded company. The most despicable part is that they deliberately leaked conversations involving BTS to provoke the BTS fandom's reaction. Would Min Hee-jin do such a thing? The company gives you two choices: comply or resign. You choose a third path and blow things up. This is purely fictional. Any resemblance to real persons or events is purely coincidental.

The beginning of this incident was initiated by HYBE. HYBE, Bang Si-hyuk, and CEO PARK JI WON wanted them to comply. The stock options were given as a condition for their recruitment, and Min Hee-jin wanted to work hard to grow 'NEW JEANS'. However, HYBE and CEO PARK JI WON had been preparing for a long time to oust Min Hee-jin, who had been independently growing 'NEW JEANS' and not following their directives. If you work in a corporate setting, and you're a CEO for a sub-company, there are "directives", company procedures, processes and policies that one (MHJ) MUST adhere to as part of a bigger umbrella/corporation. At the end of the day, she doesn't own that sub-label. She was appointed by Hybe and its stockholders to run it profitably while adhering to company policies. If a CEO violated company rules, policies, breached trust, etc. the employer has every right to fire this person. With your statement in mind, I guess you have no experience working for an organization. In the future, try to do what MHJ did--NOT FOLLOW COMPANY DIRECTIVES--and I promise you, you'd land out of their door so fast.

If you see how she’s packaged NewJeans, she’s clearly inferencing BTS starting with how they were packaged as BTS’ little sisters, BTS’ endorsements, even the name of their fan base the Bunnies… common now, who’s the most famous Bunny worldwide???? . MHJ broke the contract, therefore HYBE shouldn't have to stick to the 5 year agreement. From reports on the internet, there is evidence that MHJ has acted against HYBE, broke rules & acted criminally (embezzlement) therefore breaking the contract, therefore, she can be dismissed. I as an international fan of certain types of Korean content also look at South Korean news. I do not care who is more popular, who cries, who has the most money, or who didn't greet me correctly. Contract and law are the bottom line. In HYBE, a contract was signed and there is the South Korean law. Did MHJ break the contract and or broke the law? Conspired against her employer? That is the bottom line. If any of that happened then she should be kicked out of the company and have to pay back all the money loaned to her. New Jeans ( and parents) have their choices. If you take away all the noise, here's the gist: The investor/owner wants to remove a ceo in a subsidiary, where they own majority stakes, for breach of trust. The breach of trust in question, the ceo was mapping an exit strategy with the subsidiary by meeting other potential investors, because it is claimed she believes she is being treated unfairly, both professionally and financially. If there's sufficient evidence to show for breach of trust, it will be laughable if judgement favors the employee. No amount of public mud slinging, public opinions, character assassinations, plagiarism accusations, emotional scenes can nullify it.

The single "Bubble Gum" released on April 27 reached 8.5 million views on YT in 24 hours. The single "How Sweet" didn't reach 6 million yesterday. The drop in views of over 40% is due to the absence of the international army, after they presented the petition in court. Of course their fans will say that Hybe boycotted them, a pathetic excuse. NJs are supporting MHJ and are now starting to see the consequences of relying on a narcissist. They will lose everything if BSH can't get them back by the hair.

I watched MHJ presenting the facts for her side of the story and its hard not to emphatise with her plus ALL nj members n their parents backed her. The prob is whether hybe timed it to create buzz for itself, nj n illit to boost all these entities popularity n profits. In any case cud the court manage Ador or appoint an entity to do it so the interest of ALL parties are protected. The court's interim entity/ceo wud ensure current and future activities n profits of NJ n Ador are maximised. No 1.5 year of hiatus for NJ like what Hybe wanna do unless MHJ on nj want it. I think a win2 situation is to separate Ador and let MHJ team helmed it. Hybe shd agree as it will profit from divesting its shares. Refusal to do so wud entail a forced separation by the court and all losses of future earnings for MHJ n NJ are taken into account. No exit penalties too. If i am Illit parent i ll exit hybe too n get my kid under MHJ. Dont wanna get them traumatised when taking the lift with BullSHit.

First, let’s acknowledge the difference between MHJ being guilty by a fair trial and guilty by public opinion. The legal proceedings are still ongoing, so until the official investigations are complete and the judge makes a ruling, MHJ is still innocent until proven guilty. It may be so that she’s guilty of everything that HYBE is accusing her (including trying to steal ADOR from HYBE), but we won’t know until later. The problem, which I was alluding to in my original comment, is that the Western (international) audience seems to already see her as guilty before HYBE even sued MHJ. The Korean public, in contrast, has shown a much different response to the overall allegations (which are a combination of previous baggage and the recent accusations). First, they don’t have the same grudge against MHJ as international fans have had for the past 2 years. I won’t go whether or not she deserves that, but let’s just say Koreans in Korea have not vilified her for the pedophilia allegations nor gone on a crusade to cancel her. Second, we have to acknowledge that part of the hate towards MHJ is that kpop fans hear “BTS, LS, Aespa… etc” and seem to miss the forrest from the trees. Based on what was actually said, she has not tried to drag down these bands (she said more about the HYBE management than the Kpop bands). Third, the Korean public watched that press conference that albeit raw, seemed to really resonate the frustrations that the public experiences with toxic management in its society (from the choice of words, to the context, a native speaker will just understand the full message). So that begs the question, is the International audience all of a sudden that much smarter than the Korean audience, or is it possible that MHJ at least deserves to go thru a legal trial before being vilified? Is it possible that the international audience could be conflating their dislike for MHJ and the actual facts of the case (which as of today have not been validated and gone thru court)?

She cried with no tears. She walked away sneering. She deflected all the questions. She was being attacked and bullied? Yet, she threw shade on everyone and accused everyone else. She dressed like a bum (even then her clothes were all expensive brand name) when she is a millionaire. The actual receipts of her actions show otherwise. For her, it’s all talk and tears, or”just a joke”. Her greed consumed her and the people around her. She is hurting the ones she claims she wants to protect by using them as a shield. We have a saying, “She will never shed a real tear until she sees her own coffin.” Everything she has done will catch up with her, only then she will cry real tears that come from the gut.
