From the Report of ASP CPL Steven Roberts, ( Split up for Video Relevancy)
: On July 27th, at approximately 10:26 AM, I was patrolling Interstate 40 when ASP dispatch advised me of a BLK '07 Lexus 4-Door driving recklessly, east on Interstate 40 near the mile marker 231. It was passing other traffic on the shoulder, at an extremely high rate of speed, and forcing other cars off the roadway. Dispatch advised the driver was failing to maintain a lane and was potentially impaired.
I stopped at the 239 eastbound exit ramp (where video begins) and waited for the car. After a few moments I observed a black Lexus, and as it passed my location, I noticed it following another vehicle at a close and unsafe distance. The driver appeared to be waiving his hands but I was unsure of what he was doing. I pulled onto the Interstate and began to follow the vehicle. The driver failed to maintain his lane and repeatedly, drove across the left, yellow, fog line. I advised dispatch I was behind a BLK Lexus that dis not have a plate, but matched the original vehicle description. Due to heavy traffic and my location, I advised dispatch I was going to stop the vehicle at the 246 Mile Marker.
As we passed the 246 mile marker, I activated my blue lights and attempted to conduct a traffic stop. the driver acknowledged me by waiving his hands in the air. I assumed the driver was going to pull over, but instead, he accelerated as he changed lanes and continued east. I advised dispatch I was in an active pursuit. I advised dispatch the driver was a BLK Male wearing a tan beach hat. I could not see more than x1 occupant in the vehicle. The driver began to drive very recklessly as he passed other vehicles at speeds above 100 mph. I attempted to remain with the vehicle, but due to traffic, I was unable. I could see the car as it continuously passed other traffic on the inside and outsides of the shoulders. I advised dispatch I could still see the car but couldn't keep up with it. Lt. Phillip Hydron of the ASP asked me if this was the car that dispatch had given out. I told Lt. Hydron that it was, and I observed him driving carelessly before my pursuit started. Lt. Hydron told me to continue after the vehicle even if I lost sight, but to make sure my emergency equipment stayed activated. I told him it was, and I could see the car whenever he passed on the shoulders. As I approached the 259 Mile Marker I caught up with the car, when it got caught in traffic. The car passed several other vehicles as it drove on the left shoulder. I advised dispatch that I was directly behind the vehicle again. I observed the driver place his hands outside of his sunroof, but could not see what he was doing. The driver continued to pass on the left and right shoulders as I attempted to stay with him. As we passed the 263 Mile Marker, the driver suddenly and without warning came to an immediate halt in the median of the interstate. I exited my car and the driver was taken into custody without further incident.
The driver was advised his MIRANDA RIGHTS and I asked him if he understood his rights, he said YES SIR. I asked the driver identified as STEVIE DWAYNE MAXWELL by his Mississippi DL, why he did not stop. He said "y'all trying to kill me." MAXWELL was placed in the back of my patrol unit. I again asked him why he did not stop when I turned on my blue lights and he said "people have cars that look like police cars and that they were trying to kill him."
