Great video 50% of retail price for wholesale is industry standard. Licensing is usually between 2-20% depending on the client and product. This is with the company producing the actual product. Some fabric companies try to do 1-2% - super low. 😢

What a useful video! I only just discovered you last nite and Ive been binge watching because you are so inspirational. You worked sooo hard to get where you are, it was so amazing to watch. You've lit a fire in my belly now, I hope I too can do something so rewarding for myself. Could you please explain about royalties - do you get paid every time an item sells? If someone sells 2000 hair clips with your design on them, do you get paid 2000 x 5% of the price? How do you know they are disclosing the correct number of sales? If there is no time limit, I'm assuming even after a decade if theyre still using your design they have to pay you. How do you make sure that's happening honestly?

I would love to hear more about exclusive vs non exclussive licenses. Do exclusive licenses just cover one type of product? I was under the imptession that an exclusive license would mean we can't use the image for anything else until the contract is up. Thanks in advance!

Exclusive licenses may refer to the art being exclusive to the company for use on ALL products OR one just one product, so just be careful to read what your contract says! Everything in contracts can be negotiated and changed!

How do you write your contracts? Do you have an attorney who does that for you? And how did you learn about contracts, like options such as them owning the license only for the puzzle and it reverting back to you in two years? Super smart and I’m not sure I’d consider all the options!

I went to law school! I took contracts as a class and 5 more classes on intellectual property as well, so I learned a lot from that!

Best guesstimates! Theres no formula, but knowing the size of the company, I was certain they would sell no fewer than 1000 copies of that puzzle. I’d wager that is very low, but I wanted to be conservative with the estimate!

Hi Elyse! I have a potential “collaboration’ with a local, small company for a coloring book depicting our small town. It’s 15 pages. I didn’t think to consider this to be a licensing deal since they called it a collaboration. They didn’t want to do a flat rate and I asked for 50/50 profit split and they agreed. Is this fair to them or should this be more of a license? It’s 15 designs/pages. I will be working on an agreement soon so I’d love your thoughts!

When I hear music in a video, my brain thinks "oh it's the intro or outro, nothing important to pay attention to. So just enjoy the music". I end up listening to the music and the person talking becomes background noise. After a few minutes I realize I have no idea what the person said. 😢
