As long as the lawyer argued the issue, he could appeal based on the argued issue. So he didn't draw the bored jury back to listen, and his opponent didn't have the opportunity to argue the issue. Is it the lawyer's strategy?

Is it common practice for a hospital not to report that a patient had a fall in the hospital that may have contributed to the death of that patient resulting in the declination of autopsy then later learning that a fall was involved, the Medical Examiner reversed the initial decision and agreed to perform a forensic autopsy? Is this standard practice?
