Today I have a wander around Sheffield, on the previous Sunday I went past Hermes the delivery people and saw a counter balance fork truck operating illegally on a public highway.
I asked the driver if we was on a public road, and he confirmed we was. So I decided to go back today and pay them a visit with my camera.

@@andrewbird1977 If the truck was on the public highway, uninsured then it is everyone's affair. There are 3 scenarios that may or may not apply in this case. 1) The truck is operating illegally on a public road but there is no incident. 2) The truck strikes a car. Police prosecution for no insurance and company pays for the damage. 3) Truck hits car/person when uninsured. Driver goes to prison if a person is killed.

@@motiveintentionsincerity no, it ain't illegal at all as they are not road vehicles. They are machinery so no licence plate required whatsoever. Hence trailers, caravans and such do not need them not the insurance. Fork lift trucks are designed for limited road travel. Hence Moffat trucks that are carried on the back of a trailer which is lowered to carry a pallet from a truck down a narrow country lane. Again without any number plates. They have serial numbers clearly visible on the machine as they do not have log books. The insurance is covered by the company's public liability insurance. All the require to travel on a road is a flushing beacon, green or Amber. Serial number not a registration plate. And white driving lights on both front and rear and the driver be licensed in the operation of that type of machine. You see, I worked previously in road policing. I currently work in transport. So I know all the rules and regulations regarding this issue. Now toddle off and tell your mother you are a naughty boy

When I was working, forks were allowed to cross a public road, if the journey was less than 2/3 mile (I think). It would be covered by the firms blanket insurance. In the case of a Moffett, I'm sure they are covered by the insurance on the truck.

It’s sometimes easier, and cheaper for a hire company to register all equipment to be full road registered than to have some that are, and some that are not, it doesn’t however change the fact that a non-road registered one could legally go on the highway within the short distance allowed without being road registered.

It will also be excused from the Road Vehicles Regulations for any distance below 1000 yards. What requirements are needed? If you’re plan on operating a forklift truck on a public road, then you’ll need to adhere to certain requirements: The forklift must be registered with the DVLA. It must be taxed and insured for road use. Registration plates must be displayed on the forklift. These are the rules that apply to all mechanically-propelled vehicles that are being used or kept on public roads, in accordance with the Vehicle Excise and Registration Act 1994. Of course as the operator of the forklift you must have: A full UK driving license. Passed a forklift operator course. Keep in mind, certain age restrictions will apply to the operator of the forklift depending on the different weights of the truck when it’s fully laden. Be careful not to assign an operator to a forklift who is technically underage. The forklift will also need to be fitted with appropriate lighting for use on a public road. For example, if the truck is going to be travelling at under 25 mph then it will need to have an amber beacon that lights up. If the total weight of the truck, which includes its load, exceeds 3500kg, then it will be classed as a HGV. If it comes it at a weight under 3500kg, it will be classed as a light goods vehicle. Hey up Pete - you are 100% correct unless the tractor and trailer has a forklift on the back within the 18 meters - this would have its own plates at times - if you look at the yard, it is rammed, but there is no reason not to reverse the trailer, into the actual yard to unload, simples - all about the 5th wheel... Dont think he was resting/night out in the cab do you? ;-)

Its classed as a "works truck" and will be travelling less than 1000 yards (.9km ) and is quite legal to do so. It has only to be registered with the dvla and insured( not required to have it displayed on the vehicle) and have an Amber flashing light on the back. 👍👍👍👍

I always thought that forklifts have to pay road tax insurance etc and as you say display a number plate we'll spotted young man and the Mercedes tractor unit should not be parked on the side of the road as it states on the operators licence the hgv can only park in the designated yard so they are in breach of their goods vehicles operators licence I'm sure DVSA would have something to say

Fork Truck aint operating illegally as they are allowed to access to the roadside for the purpose of loading and unloading vehicles. Hence you get trucks with moffets on the back which is a fork lift mounted on the rear of a truck.

A moffett has a vehicle Reg plate, and it is taxed and insured. He wasn't just unloading at the roadside, he was going from one sit up the road to another

@@PJAudits no, a Moffet do not have a reg plate, the reg plate that is on the moffet is that of the truck it is attatched too. Plant machinary do not need to be road registered if there travel on public roads are restricted and is for the sole purpose of loading and unloading (in the case of a fork truck) or performing any other duty attatched to its business such as machinary used in road works or farm vehicles accessing another part of their farm where they need to cross and traverse a public road. All they need is a serial number. They can also use red diesel too. Not everything that uses a road requires a number plate as cyclists do not have number plates and they are more likely to cause damage or injury to property and pedestrians such as the lad who got sent to jail for causing a death of a pedestrian by riding his pedal bike dangerously.

Listen, much as I don't get the point of you doing this, I'd appreciate you blurring the license plates of the cars. Those aren't courier cars, they're the van/truck drivers and warehouse staff cars and South Yorkshire has a bit of a problem with cloned plates at the moment. Mine is in there and I'd love to reduce the risk, since I know it's not possible to remove the risk without stopping driving.

Doesn’t the law allow the use of a forklift for up to 1/4 mile from the permanent base? If not, could you point me to the law that specifically outlaws forklifts from doing this?

If you’re planning to operate your forklift on a public road, or use it to travel along a public road, your vehicle must be registered with the DVLA, taxed and insured. The Vehicle Excise and Registration Act 1994 specifies that all mechanically-propelled vehicles, when used or kept on public roads, must have appropriate registration and taxation, along with the display of registration plates.

Appropriate lighting is also needed for public roads, including an amber beacon that lights up (this is for occasions when the forklift will be travelling below 25mph). License plates will also be required, like any other road vehicle.

Like the twat in London who harasses motorists in favour of law breaking cyclists, something he would never dare do in his native South Africa, if he did, he would never have been able to run away from there to the UK, he would have been shot or worn a tyre necklace. you are the saddest guy on youtube.....going on like you know the rules and regs ..... if a forklift is traveling less that 100 yards It will fall under the category of ‘work trucks’ if it is using public roads for passing between premises/sites in distances under 1000 yards, delivering goods between private premises in distances under 1000 yards, or if it’s working on roadworks. Any distance below 1000 yards, and you may be excused from the Road Vehicles (Construction and Use) Regulations, meaning that fewer modifications might be needed - but the vehicle must still must be insured and registered.
