Several years ago after two incidents in London involving TFL licenced vehicles mounting the pavement and mowing down pedestrians I contacted ROSPA informing them that uber and the other taxi apps required drivers to interact with their phones whilst driving. Even worse is that some require you to be the first to touch accept on the screen as jobs are sent to several vehicles at the same time, the quickest to hit accept gets the job. They agreed it sounded very dangerous and would look into it. When I contacted them again 6 months later they said it wasn't dangerous. Same goes for the licencing authorities who's duty it is to make sure the vehicles, the systems therein and passengers are safe. They were not interested. I got the feeling that the interests of big business was more important than public safety.

Some might argue that all the electronic 'aids' in a police car that the driver can see and operate also constitute a distraction. Many times on TV police programs you see a police pursuit where the police driver is more or less giving a running commentary of the pursuit on their radio .... the police cannot claim that that does not distract their officer's attention from driving.

@@mal6232 You might argue that electronic aids are distracting but those aids are only accepted for use after a detailed evaluation and police drivers are trained thoroughly in their use and constantly assessed in their competency. On balance the safety benefits of the equipment outweigh the risks from using it. On the subject of commentary, you are flat out wrong. I have undergone RoSPA and IAM driver training which is based on Roadcraft, the Police Drivers Manual where commentary is part of the car driving test. Civilians need only give a short commentary but police drivers are required to give constant commentary and will fail their test, and be unable to drive a police vehicle in emergency conditions, if they fail to produce a satisfactory commentary. It makes for safer driving in a number of ways. First it allows the instructor to get a clear picture of what the driver is thinking and how they are planning their drive. For the driver it focuses attention on what they are doing and why. Good driving is not about fast reactions and racetrack skills, it's about accurately assessing hazards to inform a clear plan of action which is constantly updated as conditions change. I would thoroughly recommend either joining your local RoSPA group for advanced training or at least watch a few Reg Local videos on advanced driving and commentary then give it a go if you feel up to it. In emergency service situations it allows a constant risk assessment from someone not wrapped up in the thrill of the chase who can call off the pursuit at any time if things appear to be getting out of hand, which is a massive safety improvement. It also allows other vehicles to be coordinated to more safely intercept the subject of a pursuit, by getting ahead and deploying stingers for example or boxing in on a motorway. So not only can the police claim it does not distract their officers' attention from driving but they can demonstrate evidentially that it does exactly the opposite by focussing attention on constantly changing road and traffic conditions to ensure they have the best possible plan of action to safely mitigate road traffic hazards. Add to that the oversight given by the controller on the other end of the commentary and safety is greatly improved in what will always be a difficult and dangerous situation but the alternatives are almost always far more dangerous.

My nephew drove through a town in South Wales at 4am the morning my mother died and was flashed by a static camera at the traffic lights. He wrote to the a police and sent in my Mother’s death certificate (Police had attended as it was a sudden death) and thankfully he did not have a further action taken. I've mentioned this on another video of yours. You can also be done for drunk and in charge even if you have no intention of driving the vehicle. We parked in a train station car park next to a club. Paid for a ticket and went clubbing. Had a few drinks, came out, ordered a cab in the office next door, as it was going to take an hour we decided to wait in the car to keep warm. Police pull up and do my mate for drunk and in charge even after they checked with the cab firm that we had ordered a cab. Lost so much respect for the police that night.

One of my friends had a similar situation when he'd been drinking at a pub. He asked the landlord if it would be OK to leave his car in the car park overnight. The landlord agreed as long as he left the keys behind the bar. So he unlocked the car, handed the keys over to the barman, then returned to the car to wait for the minicab. He then got prosecuted for being drunk in charge but was found not guilty as he didn't have the keys with him. The barman stood as a witness for his defence. My advice would be, if you have the keys with you just refuse to get out of the car because "I don't have the keys and I'm locked in"

I quite agree - why has touching the screen on a mobile in a cradle been made a criminal offence but its perfectly ok to touch a built-in screen? I was recently quoted £800 to replace my old cd/radio unit with a modern touch screen. Seems if you have the money - you can tap away (and distract yourself) to your hearts content. Ofc i learnt to drive in the '60s when after passing your test, unless you had a helpful passenger you had master the knack of extracting a ciggie from a packet and lighting it as you drove along.

I've always said it's not the phone in your hand or the blue tooth device that can cause you to have a accident, it's the concentrating needed on the incoming message that distracts.. Radio's are just back ground noise that can be ignored when needed, messages need you to be interactive and concentrate.

When I worked for the Met Police in the 90s, if a vehicle was parked for a non emergency, we used to call hazard lights "come book me lights". They just drew attention to the fact that the vehicle was (mostly) parked somewhere it shouldn't be. If it was found to be a genuine emergency, no problem and we'd offer assistance, but otherwise it was like a homing beacon and received our attention (and a ticket) in double quick time.

When I worked for the Met (recently retired), my "homing beacon" was outside Schools with a crossing. Parents seemed to think that Contravening the pedestrian crossing with a stationary vehicle was OK as they were just dropping off little Jonny for School. Never mind the other small children crossing the road who could not see oncoming traffic, Jonny being on time for School was much more important. Ticket, £100 fine and 3 points.

The day my elderly neighbour phoned me in distress that he had two burglars enter his property from the real garden after breaking window locks, and tied him up and gagged his mouth with a brown tape, after they took whatever cash he had on him, and untied him and left by his front door, he therefore managed to remove the tape from his face and called me for help, I called the police but they said it would be about an hour before anyone could attend to him, I was about 6 miles away at mate's house, it was the early hours of the morning, so immediately I jumped in my car and headed straight back home, I was myself scared of the fact these burglars may still be lurching about, any way the point I wanted to make was that as it was early hours of the morning like 3am, I met so many traffic lights at red, I was hesitant whether to jump or not, even though I could see all the roads were completely empty, but those cameras on top stopped me from getting to this distressed man, I feel absolutely gutted that I did not take a risk with fines, but I would not take risk if there was traffic. So I kind of chickened out from getting fines and reached home a bit late to see to this man, who needed comfort and I brought him to my house and gave him tea until the police arrived.

I am also disheartened by how many near misses I have with people using a phone while driving, including hands-free. A lot of them are tradesmen, often in white vans, and a lot of them are young women, sometimes with a car full of kids on the school run.

I was falsely accused of speeding by a mobile speed camera van. Before i emerged from the roundabout, i had seen and recognised the van, and then a week later i somehow had a ticket for 48mph in a 30, that exact time and place. Took it to court, eventually won the case. There was no way i could have been speeding due to the circumstances, but proving that against these apparent accurate and flawless devices is near impossible. Look up 'slip effect' for these mobile speed cameras, it can create a huge mistake, its well known, and yet theyre still given home office approval.

My secondary Speedo in my car, and my primary speedo on my motorcycle are both GPS, have both been confirmed as accurate by my local Police .... whereas my VW Golfs factory installed Speedo reads 10% incorrectly at anything over 25 MPH, and my BMW Motorcycle read 5 % incorrect over 20MPH

Years ago when I used to drive a Citroen 2CV and often used to take my dear old Nan to Bingo. My Nan was a large Lady , I guess around 18 stone . it was a tight squeeze for us both at the front and she was always held the belt across her . What I'm fed up with is the gradual creep of the reduction of road speeds. Roads that were national speed limit are now 50 mph. Those that were 50 are now 40 and 30 now 20mph in parts of Wales. Drivers can't be trusted to drive safely these days. The amount of distractions in a modern car is crazy. I've seen drivers speed past a camera van at nearly twice the speed limit and not flinch, as if they either don't care or don't know the court summons is about to drop through their letter box.

My own town has recently been blanket bombed (an apt description I assure you) with 20mph speed limits, most of which are not on roads that require them. The aim of the council (and they have been open about it) is to frustrate and delay drivers to such an extent that they will be 'encouraged' to use alternative forms of transport.

Personally, I'm a real stickler for phones and driving and screens in general in cars. For safety, I think all car interfaces should be tactile controls like buttons and knobs. The need to go through menus and sub-menus to do something as simple as demisting the windscreen is just dangerous. Also, phones have the tech and the connectivity in them nowadays to know with good enough accuracy when you're driving and could go into some sort of muted driving mode. Maybe that's a bit much but the screens in cars has got to stop. Or at least TOUCH screens.

Absolutely right. There's HCI (human-computer interaction) research that shows that adding unnecessary dimensions to a control makes it harder to use. The best way to control something that can only be on or off is a switch or a button. If it's a variable control, then a dial or a slider. And physical feedback is important! I disagree with the pettiness around dishing out points for using a phone in stationary traffic - the risk of a serious accident is negligeable, and no driver will have their eyeballs glued to the car in front as if they're doing 70mph on the motorway while they're idling at a red light. But once the car is moving, yes - any control that requires you to look at it to know whether or not you've activated it is a serious hazard.

Yes, I've read that recently in the highway code. Rule 116. I checked because I get frustrated particularly by "professional" drivers who put their hazard lights on prior to undertaking a risky manoeuvre and thus actually giving NO CLUE as to what they're intending to do. Hazards must never be used while a vehicle is in motion, except as you have suggested.

The current push towards touch sensitive controls in cars is utterly stupid. Just because it is more technologically advanced does not make it better. Frequently used car controls should always be findable/useable by touch alone, independent of vision.

In Norway, we do actually have a legal defence for speeding. Not in the traffic code, but in the criminal code. Though you will have to be able to argue a genuine emergency, like taking someone to the hospital for a genuine medical emergency. Typically, to be able to use this defence, you will need to show that you called emergency services and acted in accordance with their advice. Also, police will typically be alerted to the emergency so that they may assist if possible. Obviously, simply being late to an appointment won't cut it.

I should probably mention that the cases I have seen in the media have been about fines issued by speed cameras. If police catch you speeding "in person" in a genuine emergency, odds are the will assist in resolving the emergency rather than issue fines.

I think that people getting confused over short distances with no seat belt perhaps comes from it being ok to remove your seatbelt when performing a manouver that involves reverse (unless that law has maybe changed now?) Also there are instances you can use hazards on the move, for a quick example many modern cars now automatically activate them in a sudden/heavy/emergency braking scenario. Great video as always.

Interesting point about the use of a mobile phone in a cradle - especially with modern cars where you are now almost exclusively obliged to use a touchscreen to regulate even simple things like the de-mister or even the dashboard vents... I would venture that those are just as dangerous but are seemingly tolerated by the authorities when granting roadworthiness certificates to new vehicles.

My car is designed with a digital interactive screen with multiple pages which requires the user to look down at it in order to firstly select the desired screen and then carry on with the selected page, to alter or adjust a setting. For example … select the environmental screen, then select the air-conditioning to on, then select desired fan speed and finally select the vents to deliver that air. All on a touch screen which the user has to touch the correct part of the screen in order to achieve the desired outcome. So how come that’s ok ???

I think it's only mitigation, you'd have to hope the police were compassionate and dropped it if you were caught, obviously most people would speed if someone needed urgent medical attention, I definitely would and have in fact done so in the past when a very young child had what looked like a serious head injury, thankfully it looked much worse than it actually was, but at the time there was no way to know, it could have been life threatening.

I have a Tesla, the following operations require me taking my eyes off the road, glancing down to my left and pressing a touch screen: -Adjust wiper speed or turn off wipers (auto wipers are useless) -Adjust cabin temperature, heated seats, blower speed etc -Adjust headlights (from auto to manual modes) -Turn on fog lights -Any form of sat nav operation Although admittedly, a recent update has made the voice control for all these functions work perfectly in the UK. Still if for whatever reason it doesn't understand you (say a thick accent) then it can be very distracting having to adjust basic functions from a touch screen whilst driving. If I were to be strict and not distract myself with these touch controls on what is in effect a massive phone stuck to a cradle to the centre of the dash, then I'd be driving round unable to see out of my windscreen when raining, freezing cold (or boiling hot) and blind as a bat in fog.

I have contested 3 "speeding" NIPs and won all three. The stationery cameras are NOT well calibrated and are now set with a much higher upper tolerance before snapping you. My tickets were for 34 in a 30 and twice 58 in a 50. I paid the fine and then asked for calibration tests. Each time the fine was returned to me and the matter dropped. Large transgressions will get you bitten on the hand or ankle. The ones on bridges over roads tend to be well maintained due to the hard life they lead. I still have had no points on my licence since passing the Test 5 days after my 17th birthday 40+yrs ago. I intend to keep it that way, despite the State's best efforts to ruin my blemish free driving for over 4 decades.

There a few exceptions to the seatbelt rules, reversing, parcel deliveries but essentially you should ALWAYS wear it, for your own safety is a great argument unless traveling through the windscreen face first is something you'd like to try.

I'm now in my 58th year of driving.. never been involved in a moving traffic accident but still collecting speeding tickets.. the one 'accident' I was involved in, I'd been sitting stationary for a full minute to allow two ladies and a pushchair across a pedestrian crossing, a squealing of tyres alerted me to an approaching vehicle which a moment later slammed into the back of my Audi, £11,000 worth of damage.. in fact it was written off. The woman driving said afterwards that she'd been attending to her toddler in the back.. (no you stupid woman, that's not what you do driving through a village).. were our wonderful police interested? Not a bit.. there can't be much better evidence of driving without due care and attention than a written off £20k Audi but our useless police are too focused on sitting on their far R SS staring at radar readouts of drivers driving perfectly safely in excess of some arbitrarily imposed speed limit.. Out of the 85 countries that I traveled to, worked and lived in, this is the only country where the police cannot be bothered to prosecute drivers causing accidents.. unless of course there's an injury involved...

Last week we had an issue with a neighbour who had been taken ill over night. When we found her she was in some serious distress and in incredible pain. We were informed there would be a 4 hour wait for an ambulance. After seeing that she was completely loosing control of her body I took the decision to take her to hospital myself. It's in Cambridge rush our which can be VERY slow. Trying to navigate as quickly as possible i needed to get over a very slow traffic crossing , I took the decision to cross the red light sounding my horn and waited till i had been seen and all traffic had stopped before driving through. Thankfully after an emergency operation she is now recovering in Hospital. I'm wondering if I were to receive a penalty for running the light would i be in my right to claim mitigating circumstances. Or will I have to just suck it up?

If you run a red light in an emergency and get prosecuted the court _may_ take the circumstances into account. Be aware that the blue light services can't run red lights with impunity either - they have to treat any stop condition as a give way, and exercise appropriate caution and consideration for other traffic. Drivers of emergency vehicles are meant to turn their siren off at junctions where the traffic light is red. This is to avoid prompting other drivers to run a red light, which is illegal under any circumstances.

As I understand it can use your hazards whilst moving in certain circumstances, for example when you’re driving on an M way and you see the traffic ahead is braking and slowing down very fast, you can then put on hazards to make those following you aware of the situation.

Just to ask one of those ark ward questions. As a now retired Electronics the moment I hear that Electronic Items are tested and calibrated. My first thought is one, what is the maximum period recommended between testing? Two, what are the dates of the the last two tests? You will be surprised when asked and to provide proof of such tests you may receive a lot of blank faces, plus a lot waffle. Very often this important duty is over looked.

After 30 years as a Road Policing Officer you get to hear most excuses, and reasons why people are doing the crazy things that they do. However If you could only take them and show them some of the fatal and serious injury RTC's that you have attended over the years, as a result of these "minor" !! road offences, ( "Officer I cannot believe that you are prosecuting me for that!" ) and the misery it causes the families, and some individuals who have life changing injuries, they probably would not do what they do.

I know it's a old post but a little tip .if you pull over ie in a lay by or on the side of the road and you want to use your phone MAKE SHURE YOUR ENGINE IS TURNED OFF AND THE IGNITION KEYS ARE REMOVED .because even if your engine is not running ie turned off .you can still get done if your keys are in the IGNITION switch.

Also to note, you “CAN” drive without a seatbelt for medical reasons that prevents you from safely using a seatbelt (although in my opinion if you can’t use a seatbelt safely then it is unlikely you can drive safely but would apply if you there a passenger) or if you are reversing you are able to remove your seatbelt and then re apply it before going forward. This was the case when I did my license 17 years ago I am unaware that this has changed.

@BlackBeltBarrister I use to work as a subcontractor driver for pharmaceutical company in South Ruislip in the 00s called AA Pharmaceuticals. On a number of occasions I was legally allowed to drive very fast but very safe as they were life saving drugs and the operation couldn't start until I got to the hospital. Sometimes I would meet up with a police escort but not very often. On a number of occasions the police would give me a ticket after I delivered the drugs to theatre in the hospital or I got a ticket through the post from a speed camera. I never once went to court or had any points on my licence due to the importance of getting there as fast as possible a potentially saving someone's life. The police knew I was genuine still had to follow me an issue me with a ticket just in case but was also very helpful especially when it was a hospital I didn't know.

Yeah! I worked in Theatres, 20/30 yrs ago I've seen transplant doner vehicles get tickets after delivery. Literally, police standing outside Theatre airlock waiting. It was quite common a few years ago (Not so much now, likely due to the matrix signs on motorways) to see motorists in front throw on the hazard lights after spotting a hazard in front of them and following traffic to follow suit and so on. It always seemed like a sensible thing to do in my opinion and I have done it too. Obviously, these are all moving vehicles, so having watched your video, I assume everyone doing this is committing an offence. Is this correct?

Straight from the highway code, item 116: You MUST NOT use hazard warning lights while driving or being towed unless you are on a motorway or unrestricted dual carriageway and you need to warn drivers behind you of a hazard or obstruction ahead. Only use them for long enough to ensure that your warning has been observed.

One thing Billy Barrister omitted that is a VERY common offence of passing a Red Light when the Emergency Services are behind you. Many people (for the best of intentions) will edge past a Red Light to let them through. You should NEVER do this, doing that is a PURPOSEFUL transgression of the law and there is no excuse accepted. So don't do it, not even if a Police Officer (of any rank right upto and including the Chief Commissioner) waves or gesticulates for you to do so, no officer has the authority to over-ride a set of WORKING TRAFFIC LIGHTS, this applies to Firemen and Ambulance or paramedic crews. Some lights are 'set back' from the outer radius of a roundabout or a X-road, enough for a car to get out of the way you may think, but again you are breaking the law to let any Emergency Vehicle through if it means you jump that solid white line. ALL Emergency vehicles should, if they cannot pick their way through without you jumping that solid white line, switch off the "pressure" to break the law, ie Switch off their lights, extinguish all sirens and wait. People have lost their licences not heeding the law on such occasions.

Ian, if a Constable in uniform is giving you a clear direction which is in contradiction of a traffic signal, then common sense should tell you that his direction takes precedence. Consider a scenario whereby the light is stuck on red and an officer is tasked to perform traffic duty until the traffic lights are fixed. So you are telling me you would sit stationary, even though the officer is directing you to proceed?!

@@geordiewishart1683 The lights by law have to be disabled. He/she must COVER/DISABLE THE LIGHTS before he/she can take over. I WOULD GET OUT MY CAR AND HELP HIM DO THIS. He should in fact ask me to assist him in doing this if I am the 1st car in the queue. So no, I would NOT pass that red light. When Traffic Lights fail the Police have jackets that go over the lights saying "Caution. Disabled" but temporary covers are enough for him/her to take over.

I have seen it proven how much even the smallest amount can impair driving; I was at a police exhibition years ago and they gave a guy a reaction test; then gave him (he was a drinker by his own admission) a teasponful (yes a literal teaspoon) of whisky; when they did the reaction test again a few minutes later his reaction time had tripled. it took him over a second to react to the hazard.

I thought this was all widely over-stated too. Then (this is decades ago) in the social club I was playing table tennis against my mate. He had to drive home, I didn't. So he was drinking beer sparingly whilst I was cheefully guzzling away. Sober I was consistently the better player, beat him every time. We have to be aware that it's not just alcohol use that affects our reactions and behavior. There will be loads of things, currently not legislated, that can impair. Tiredness, particularly for people with some sort of neurological peculiarity, is absolutely lethal. Just the act of driving, but particularly in the rain with the wipers going, would send me into that pre-sleep brainwave pattern and it was only the adrenaline releases (in response to the fact that I was getting hypnotised by windscreen wipers), that kept me awake. I don't drive any more - you will be pleased to hear.

That would never catch on here in Australia as the Police are immune from prosecution for all traffic offences with the sole stipulation being that that are performing duty. There is no requirement for them to be involved in an emergent situation. My view is that if an action is reckless for one, it should apply to all.

The hazard lights one was a surprise to me, not the park anywhere aspect of course, but the misuse part. Been driving for 36 years and whenever another driver lets you in while changing lanes, a quick flash or two of the hazards has always meant "thank you". Not in the highway code but an unwritten rule, (Yes, I acknowledge if it unwritten then it's not a rule), but even police cars have done this to me as I let them in. Same with flashing you head lights once, officialy its a warning as to your presence like the horn, but again, unwritten and done once, it's a thank you signal or indicates your willingness to acquiesce (look that one up) to the other drivers request to move infront of you, particulary with HGV's who can't always be sure if it's safe to move over due to there extreme length.

if it could reasonably be argued that you are not paying proper attention to the road and other road users then you would be guilty of driving without due care and attention, no matter what your chosen distraction. Even if you were interacting with standard equipment that came with the car. Don't forget, anyone you hit whilst doing so would still be just as badly injured whether you were using a hand held phone, fiddling with a sat nav or even just trying to find the menu to set the climate controls on the car's touch panel.

the rac in 2022 said this on a google search - Can I touch my phone while driving if it's in a holder? Current law forbids holding a mobile phone while driving. Although this could mean you can tap your screen when your phone is fixed on a mount, the police can charge you for driving without due care and attention or careless driving. Driving without due care and attention will result in a fixed-penalty notice (FPN).. cannot get a clear answer from any police force so the best you can do is use google and hope. i will touch ok on my phone to continue same route or accept new faster route, but i try plan it near set corners, make some ground from cars behind through a few coroners and when its impossible for then to see phone use i use it to tap ok but you only got 30 secs to put foot down and get hid behind a corner. id rather do that until i get straight answer from the law if no one can see as you middle of few corners you cannot be seen, just oncoming traffic, i also have phone next to volume button so if caught i can say i hit phone instead of volume, easy to do if you not looking at volume button

I knew a policeman who was able to have a driver convicted of driving under the influence despite not being able to obtain a blood sample. It was his repored observation of the person's behaviour after they were stopped. My wife and her colleagues, while working as a forensic analyst drew and analysed their own blood samples at the end of their lab's Christmas party. The results showed how each person's alcohol level differed depending on their weights, and amount drunk.

You can your device hands free for maps as long as it does not obstruct your view of the road ahead. I would never recommend using a mount on the windscreen, depending on its position and size you may be committing an offence.

On your first point regarding use of mobile phones while driving. It is a major bugbear of mine that many drivers of PCVs do this, when IN SERVICE WITH PASSENGERS and waiting for the timetable to catch up with them. I have complained about this to the local Police many times but they don't want to know. I am fed up of having my safety put at risk due to bus drivers who can't do a shift without their bloody phone on! And as for bus drivers speeding up to 50% above the limit I feel VERY unsafe.

I just recently had my drivers mirror crunched by some neighbourhood old sod, who went round the corner, came back, and started looking for HIS mirror (I had it, kept it, and threw it in my bin). That's all the old sod was concerned about "where's my mirror". Didn't even ring my doorbell to apologise. Locally, he's well know for (besides being barely able to walk) for being smashed while driving.

Regarding the phone it’s kinda stupid as new cars come with touch screen radios which is basically the same thing.
