The law in question from 1864 is the most recent law on the books regarding the subject of abortion. It has nothing to do with the party, it's the most recent law and therefore the relevant one. That's how it works. Also the author of that 1864 law was a democrat.

There is no new abortion ban. The old 1864 one is still valid because no new abortion laws have been passed since then. The legislature can pass a new law that overrides the old one, and then that will be law of the land. That's how laws work. The Arizona supreme court simply found that there were no updates to the old law on the books, so therefore the old one still applies. That isn't a partisan decision, and legally, it is the correct one. Don't get mad at them, they did their job correctly. Get mad at the Arizona legislature for not working to update that law.

No it wasn't. Arizona was a territory and had territory laws. When it became a state, the state adopted those laws. The law in question is from a set of laws called the Howell Code. The Howell Code is the most recent law in Arizona that mentions abortion, so with no more recent laws to change it, it's still valid. Also the author of the Howell Code was a democrat.

We are seeing democracy in action. The states are allowed now to deal with the question of abortion or aborted procedures as they see fit. We have a very progressive policy involving abortion next-door in the state of California but in AZ, the Supreme Court is enforcing a law passed by elected officials years ago. We are seeing the American process at work and we are seeing democracy in action.

Where in the constitution does it say that Abortion is a right. If it was then they would have had to make food a right. It's a slippery slope that's why our founders didn't make it a right. Many states have abortion, it's not gone. As a conservative I don't see unwanted pregnancy as an issue to where we should have abortions. How about practicing abstinence and birth control. When the birth control fails you put the kid up for adoption. While it is difficult to find an exact, accurate number to answer this question, Some sources estimate that there are about 2 million couples currently waiting to adopt in the United States which means there are as many as 36 waiting families for every one child who is placed for adoption.

The 1864 law is enforceable because there are no more recent laws concerning abortion on the books in Arizona. The Howell Code of 1864 is the most recent law that mentions abortion in the relevant way, so therefore it still applies. That was the Arizona supreme court's finding, and it is the correct one, legally speaking. Don't get mad at them, get mad at the legislature that has never passed an updated law in all the years since then. The ignorance people have of basic civics is appalling.
