Can experimental aircraft be used in a commercial operation? I was just wondering if someone is paying the pilot and use of the aircraft.

FARS 91.319 says you can't use the an experimental plane for compensation or hire in the United States. However, this is ministry work in another country and their regulations are different.

91.319 does not say "in the United States." According to the FAA, an experimental aircraft that is registered in the US is subject to the same operating limitations regardless of where it is flown, unless the FAA grants an exemption or deviation authority. Therefore, an experimental aircraft cannot be used for compensation or hire in another country, unless the FAA approves such an operation.The relevant regulation is 14 CFR 91.319, which states: No person may operate an aircraft that has an experimental certificate- (1) For other than the purpose for which the certificate was issued; or (2) Carrying persons or property for compensation or hire. Therefore, even if Niger allows the operation of experimental aircraft for compensation or hire, the FAA does not approve such an operation for US-registered aircraft, unless an exemption or deviation authority is granted by the FAA.

@@ethanlegrand33 Um, you are mistaken. As an operator of a U.S.-registered aircraft, and holder of an FAA-issued pilot's license, you are bound by the U.S. regulations that apply. Frankly, I'm surprised AOPA endorsed this video. I recommend you contact your local FSDO and treat this video like a voluntary disclosure. Either they didn't explain, or you didn't hear or read, the operating limitations that are part of your experimental airworthiness certificate. Those certificates are not valid outside the United States because the aircraft does not comply with ICAO Annex 8. 14 CFR 91.319 does not mention the United States: (a) No person may operate an aircraft that has an experimental certificate- (1) For other than the purpose for which the certificate was issued; or (2) Carrying persons or property for compensation or hire. You can read the rest by googling '14 CFR 91.319' FAA Order 8130.2J, Airworthiness Certification of Aircraft, paragraph 4-3 says: 4-3. Flight Operations Outside the United States. A special airworthiness certificate does not authorize flight operations over a foreign country without the permission of that country. Imagine how I might know this level of detail... Good luck!
