Nice Information sir Thanks Sir Here is the case with my flat - I purchased a flat and have a loan with bank, without my knowledge/concern builder sold my flat to another person and I was paying my emi accordingly but knew I got the information that I was spending my emi on my flat and builder sold to another person, now Supertech builder got in NCLT, Now I can't file case against the builder, the bank is calling me to further EMI and file a case under DRT. Now I have no flat but have pay emi. So pls suggest to me such a case where to go file a case against the bank or builder...???

Hamare builder ne reliance home finance se kuch flats k upar loan ke rakha hai. humne flats bank se loan le k liye hai. achanak 2 saal k baad reliance ki notice aayi total 34 flats hai. Builder ne ek flat holder k naam DRT me case file kiya hai, applicant me flat holder hai and respondent me khud builder and reliance hai. abhi DRT me hearing chal raha hai last hearning 17/05/2022 ko hai. Reliance ne Auction k liye news paper me add bhi di thi us k baad DRT mein case gaya tha. Auction me koi party nahi aayi thi, woh DRT ki case list me hai. Hamara koi dosh nahi hai. Builder hame assurance de raha hai k woh jald paisa bhar dega aur hame NoC mil Jayegi but abhi tak us ne nahi bhara hai woh bol raha hai k woh amount bhar ne k liye taiyaar hai par reliance us ko written me nahi de rahi hai k jo amount decided huva hai bhar ne k liye woh bhar ne k baad NoC degi. Is liye builder bol raha hai k main delay kar raha hu. confirmation nahi aa raha hai. Lekin yaha baat yeh hai k hum apni taraf se kaunsa legal action le jisse hamare flat pe sealing na ho aur hum beghar nahi ho. kya aisa koi tareeka hamare favour me hai. Kyu k jab hamari bank ne loan di tab yeh reliance ka morgage wala nahi dekha aur na NoC maangi aise hi builder ko loan ka cheque de diya. Please held and guide

Respected sir, mere father ne 2003 july me ICICI bank se home loan liya tha 2 lakh ka, 2004 october me father retired ho gye the or unki pension or Bank ki emi same amount ki thi iske karan EMI disbalance ho gyi 95000 jama kiya tha hmne 1 lakh 5000 balance tha 2008 tak fir bank ne sidhe ARCIl company ko transfer kr diya tha hmara loan mere father ne 2011 me civil suit file kiya tha dono ko party bna kar jo abhi bhi FTC Lucknow me chal rha hai, lekin abhi 16 may ko 14(1) ki notice aayi hai ArCil ne kiya hai.. to kya isme aisa kuch possible hai jisse hm apni property save kr sake kyonki loan hmara ICICI bank se tha Na ki ARCIl company se plzz reply de dijiyega 🙏🏻

Bank manager se bat ki to wo bol rha ki apki har month phle wali due emi gyi h... New wali nhi gyi isi liye hmne wo bounce dikhaya h cibil me.... Jab sirf January or feb ki bounce huyi h to sirf wahi do emi bounce dikhana chahiye na.. Ye sari emi ku bounce dikha rhe h blki paisa har mahine le rhe h mujhse... Or abhi notice bheja hua ki due two emi pay kriye with interest... Mene kaha me pay krne ko ready hu lekin ye cibil me se report shi kro.. Hdfc is ready to settle car loan(in write off status) with one shot agreed amount but will not give NOC. They claim I have a credit card overdue which is in write off status as well. They can give NOC for car loan only if credit card dues are cleared. Is this true or bank has to give NOC for car loan when it is mutually settled? Please advise as this is forcing me into repossession of the car.

@@centurylawind correct Sirji, that is what i told them that i cannot sell the car and settle the amount agreed upon if there is no NOC given. They insist its RBI guidlines if there is another loan with bank (Credit card) they are not bound to give NOC without this being cleared (Credit card) Tomorrow they asked to surrender the vehicle or clear all outstanding car loan dues (9 dues total 72000) I'm ready to pay monthly as i lost job 2 months back but they insist on clearing all outstanding or surrender car. My blood and sweat will go in van. Any further suggessions will be appreciated. Shall I talk to my home branch for guidance as this all is being done by recovery team of HDFC.

Sir, jo bank loan deti hai wo kahi se paise ud ke nhi aate, general public ka hi deposit hota hai, kabja bank majburi me leta hai, aapka repayment shi hoga toh koi dikkat nhi hogi, aaj kal loan ke time pe sir loan suraksha le lijiye bolte hai toh log usko bhi nhi lete, ki mai maru ga nhi itti jaldi, batmazzi krte hai ki bhai tum mar jaoge hum toh tandrust hai. Ji iska koi fix samay nahi hota, isme bank ki marzi hoti hai. Jo bhi samay ots ke time agreement mein likha jaaye wo mana jaata hai. Usko extend karaya jaa sakta hai. Further jaan ne ke liye 9310411779 par baat kar sakte hai aap

मेरे दादाजी ने 2006 में pnb से छह लाख का लोन लिया जिसको चुकाने में असमर्थ रहे जिसके बाद 2014 dec में 77 लाख में बेचने का नीलामी निकाला गया जिसमें कि 9 लाख पीएनबी का बकाया था नीलामी कि 3 महीने बाद दोबारा नीलामी को 35 लाख का निकाल कर प्रॉपर्टी को बेच दिया गया और 9 लाख रुपया काट बैंक मेरे अकाउंट में 23 लाख डाल दिया इसके बाद मैंने हाईकोर्ट और डीआरटी में केस किया जिसके बाद मुझे ऑर्डर हुआ कि आप अपना 9 लाख जमा कर अपना घर ले सकते हैं जिसके बाद मैंने डिमांड ड्राफ्ट बनाया और पीएनबी में ले गया जिसको की मैनेजर लेने से मना कर दिया जिसके बाद में हाईकोर्ट गया लेकिन वकील बिक चुका था मेरे पापा को इंग्लिश समझ में नहीं आती वकील ने जैसे तैसे यह आर्डर करवा लिया कि मैं डीआरटी मैं जाऊं फिर मैं डीआरटी में गया जहां पर बहुत लंबा समय लगा 2015 में मेरे प्रॉपर्टी का रिकॉर्डिंग करा कर उसे घर दे दिया गया जिसके बाद आर्थिक हालत खराब होने के कारण मैंने हार मान कर अपना पैसा रिसीव कर लिया लेकिन आज 4 साल 5 साल बात जब मैंने आपकी वीडियो देखी तो मुझे लगा कि न्याय मिल सकता है क्योंकि कोई 77 लाख का घर को 35 लाख में कैसे दे सकता है पीएनबी का मैनेजर भी मिला हुआ था उसे कैसे भी मेरे घर को कम कीमत में बेचना था मेरे घर को अगर 77 lakh बेचा जाता तो वह मेरा एकमात्र घर था मुझे कोई दिक्कत नहीं होती मेरे साथ भारी अन्याय हुआ कैसे मैं अपना घर वापस लूं सर प्लीज हेल्प अगर कुछ हो सकता है तो बताएं सर 🙏🏻🙏🏻 waiting for reply

क्षमा चाहता हूं किंतु आपके द्वारा उचित समय पर उचित कार्यवाही ना करने की वजह से यह मामला अब time barred हो चुका है और इसमें अब कुछ भी कर पाना संभव नहीं है।
