Sir today Hon'ble SC has issued guidlines on non bailable offences in which accused is not under arrest at the time of filing of ch.sheet in Special Leave to Appeal (Crl) - 5191/2021 titled as satender kr. Antil v CBI in which the Hon'ble Apex Court categorised the offences in 4 categories- A,B,C and D and the manner of dealing in such offences for granting bail to the accused not arrested at the time of filing of challan.

Police can't give bail in no bailable offences but if officer found that thir is no reasonable ground that accused has committed a non bailable offences,only then he can give bail and conduct further inquiry or investigation
