@@yourmum215 best thing is if you don't feel you owe the money or are being harassed by the bailiffs is don't engage in discussion, don't give any info to them as you are not legally obliged (though they will make out like you are. It's a lie.) And contact to original creditor and sort it directly with them. You have less powers if it concerns tax or court appointed fines but for all personal debt, they have much less powers. It's all intimidation.

That is how you deal with bailiffs, first they need to establish the identity of the person they are dealing with because of data protection. If you don’t give them your name then then they can’t continue with their job. They can’t even tell you why they are there until they get permission from the person that they need to speak too. If you give them your name then you have entered into a verbal contract with them.

Bailiffs I worked with authorised and oversaw breaking into properties to repossess them, following court action for non payment of rent. If the house was occupied, or we suspected it was, the bailiff would have a couple of cops with them. They have plenty of rights!!

Didn't make sense. they refused to speak with the guy on the grounds that they couldn't confirm that he was the debtor... but then they left him paperwork about it and advised him to read it because it was quite important. That makes no sense... if they don't believe he is the debtor, then why would they give him paperwork about it and advise him to read it?

Exactly, not only does it make no sense, its illegal. They remained on private land momentarily after being told to leave, they littered on private land and as the above commenter said they left documents, presumanably containing private data lying around. I think you can still make a private prosecution within 6 years and youre strongly advised to do so with this video as good evidence.

@@michaelgrace1298 if you tell someone to leave the property and they remain, it becomes aggrivated trespass and is a criminal offence. You have to formally tell someone to leave though as its legal to enter someone's property if there's a clear right of way, such as an open gate. It's advised to get a video of yourself telling someone to leave so you can take them to court.

I told them I dont know who they are and as such would not be giving strangers my details over the phone .... I've not had so much as a letter from them since. Demand to see the official warrant of execution only, with wet ink signatures from the judge, for reverse liability. The warrant must be court sealed or court stamped, if the bailiff cant produce the official warrants, dont accept their digital warrants on their handheld computers they are copies, with photocopy signatures they are fraudulent warrants, refuse them. Bailiffs cant force entry for civil matters, police by law cannot assist a bailiff for civil matters, always film them. Keep all doors and windows locked. Never give your name, ignore the idiots on here say pay your Bill's, people fall on hard times, it also exposes the corruption of the bailiffs and how they try and use fake fraudulent warrants to fool people.

Trespass is a civil offence. Aggrivated trespass is a criminal offence. Ask someone to leave and if they don’t the matter becomes one where you are allowed and obliged to a certain degree to use force.

The woman asked for him to confirm his address, not because she's unsure of the address, but because she wanted to get "Joinder" with him which means he is giving his consent to her being there to carry out anything she wants. If you'd ever had any dealing with the plods you'd know that if you refuse to give your details you can be arrested and brought to a police station until they find out who you are. They will have refused to pay bills and have refused negotiation with the debtee. This is a last resort, other than repossession of property

Usual thing in the comments, a couple of people saying pay your bills without even considering that the balliffs are chasing a vulnerable person who had been conned into signing something for someone else, or a former owner or tenant, or a former co-tenant who has ducked out on their part of the bills, or someone has out and out used the residents details for fraud, or a billing company (eg car parks trying to get over £150 for parking an inch out of the parking bay lines) and their shady "debt management" companies.

@@BedsitBob where i live we've had 2 separate debt collectors letters for previous residents you know what we did? We rang up and then when they came we showed them ID and explained. If they're chasing you for someone elses debt then inform them. Otherwise pay your bills its not hard.

Most bailiffs aren't unreasonable people in my experience (there will be some idiots of course) next time they knock on your door answer be polite and show them your ID, explain it was a previous tenant. It happens a lot when we moved here we were getting letters for 4 seperate people 2 stopped sending them once we rang them and the other 2 we showed ID on the doorstep. If that fails you can always ring citizens advice if you're in the UK.

Once you tell them to leave, or that you don't want them there, or that they are now trespassing they are then trespassing, civil offence, and they should immediately withdrawn by the shortest or most sensible route (eg if you were in a farmer's field and they tell you to get out you'd not take the shortest route if it meant damaging crops or scaring cattle). While that is a civil offence, if they continue to remain there, or damage anything while there, or cause a breach of the peace or harassment, then it's criminal trespass. However if you rang the police and said that there's a debt collector who was committing trespass, good luck getting any plod out to the property within a week!
