Don’t pussyfoot around asking what we the viewers think you should do. Be decisive and stop waffling on which doesn’t come across as very professional, it’s clear you need to potentially hit the customer with the CCJ so just serve him notice by email and hard copy by recorded delivery that if full payment is not received within 7 working days of the letter date you will instruct the issue of a CCJ.

After suffering the same kind of tardiness in payments by several customers over the first few years of business, I finally found that a detailed estimate in writing, followed by a 50% deposit with order, balance prior to delivery/collection, sorted the wheat from the tares. if they cant or wont pay a big deposit, they certainly wont want to pay the full bill. Its a sort of Darwin Award for potential customers. A fairly regular phone call with updates on progress helps them to realise that things are moving on and the balance will be due soon. A CCJ soon focuses their attention too!

From experience (against my company) the process to retrieve funds is as follows: 1. High court judgement - if successful, a CCJ will be issued against the claimant. Step 2. If they dont pay, you send the case to the supreme court. If this is successful, they will issue a writ against the claimant. At that stage, you pass it onto a recovery team (the supreme court writ cannot be refused entry unless the claimant applied for a stay of the writ in time)

you've got the process nearly right but names wrong: CCJ is County Court Judgement, which you can either send to either the bailiffs or (over £800) transfer to the High Court for enforcement purposes. Once at the High Court a writ is issued at which point, the defendant gets 7 days to respond to the Enforcement team, then gets a visit to pay up - "can't pay / We'll take it away" (The Supreme Court ain't involved)

@@classicrestouk No. The Supreme Court hears very few cases, sits in London and only gets invovled in the very highest level legal decisions about our constitution and interprtation of the law when the appeals court judges have been unable to reach a unaminous decision on a matter of law. CCJs are just handled by the county court (well, actually an office block) and rubber stamped by a special division of the High Court that is in reality just another office block. The only stuff that ends up in the Supreme Court is stuff that has been to the Crown Court, has been granted leave to appeal, gone through the appeals court, and again been granted leave to appeal to the supreme court ... it typically takes around £500k+ in legal costs before it gets there ...

@itsverygreen532 the reason I believed what I stated, I have a ccj against my company for a disputed telecoms bill. Somehow I received a supreme court judgement - unless this has been forged in an attempt to put pressure on me to pay? Total bill was £1200 which was disputed. Now they want £3k

Unfortunately I think it’s time for you to press the button on this one. You’ve given more than enough time, you’ve chased it and made it clear what the customer owe’s you. With the amount of debt they’ve racked up and the fact they haven’t responded to the court, I think this is now your only option. As you say, you have bills to pay as well. As for the channel, really enjoy the content you put out, really open and honest. As for the technical stuff, you manage to do it in such a way, that even the less mechanically minded people can understand. I think the way you guys are so open and transparent about everything as well adds to the appeal.

Getting a CCJ against your customer is no guarantee he will pay, you will most likely need to go to the next stage which is to get the court to send the bailiffs in.

Get the CCJ , transfer it to the high court for enforcement purposes, tell them you have the engine which is worth X - which those the High Court Enforcement can seize. They'll then sell it at auction for you - legally. Gets it out of your place & raises some cash

been in business for 25 years ... I always split them up into can't pay and won't pay ... If they won't pay an invoice because they don't see you as a priority, a small claims court can help get them to pay up. If they *can't* pay, you are just wasting your time and making their life harder, but it still won't get paid. If you can use the CCJ as a route to seizing the goods and selling them to cover your costs and return any surplus to the customer, that may still be worthwhile though.

Once it becomes clear you're not a soft touch and stand by your work you'll start to get more of the right customers. Get a CCJ. it puts the ball in his court. If he pays within 1 month, then he can apply to get it cancelled. After that he's struck with it and then you can decide if you what to go down the enforcement route

Get the judgement. There is a a demand for these engines, and you will eventually get your money. You will never be completely whole considering the amount of time that will have gone by, but on paper you will. The stress and work that you are putting into collection will be at an end. You're right, it is just business, nothing personal.

Re. the unpaid bill, you need to do the following 1) explicitly tell the engine owner that you have no choice but to get a CCJ, and that will, unfortunately, ruin his credit rating 2) if they don't pay (they should be able to get a loan if needed) within a week, then schedule the crown court hearing as soon as possible 3) when you win the case, immediately got to the bailiffs and pay the fee to have collection enforcement (this used to be about £30 but I'm sure it's much more now) so that, without further bother to you, the debt, legal expenses and bailiffs fees will be collected on your behalf. The courts usually allow 30 days for payment so the bailiffs will only act once that period has expired. As for the engine? Get the owner to sign a bill of sale for the scrap cost or (if they are nearby) tell them you will deliver it for free (it's a small cost to you) just to get it out of the door.

Take it through the high court. Their sheriffs have more authority and will be like a dog with a bone. Much more chance of getting your money and costs back. Also remember you can charge daily compound interest at 8% above the bank base rate. Good luck with it, love the channel, get driving that Lambo .

Lee, life is about Karma, what goes around ....... You, Isac and John ultimately have good Karma with your transparency and desire to deliver excellent results / the best service for your customers. That will always deliver good financial results as long as you face head on the commercial reality / challenges any credible business will, unfortunately, have to incur when dealing with customers. The court process is there for a reason so do not feel shy to use it when you have made every attempt to avoid it in the customers best interest already. Go for what the customer has made inevitable and sleep well whilst the process takes it time to work out.

You can take a lien on his engine in order to sell it off and recover/defray your costs. I don't know how you go about it or how long you have to give him before disposing of his goods, but your solicitor would advise.

No doubt about it at all Lee. The engine owner has shown that he has no intention of voluntarily paying for the work you’ve done so CCJ is the only realistic option you have left. Force them to either pay for the engine or give you the authority to sell it on to recover your costs.

Can't believe a LR rebuild is 11k. Press the go button. Someone I know, a kind of a relation, very proudly showed me their couple of year old Jag, I think with a similar engine? He said it was a good one he found, it was only 41k and just had a new engine fitted, not a recon, a replacement new, good for another 30 to 40k or so ha ha? I nearly fell over. I had a LR, a 96, I put 150k on her, over 200 when I sold her, 22 years I had her, never failed, never any engine work, just radiator, water pump, alternator, some pipes that's all.

I can't believe it's been a year since you changed the shop already, well worth it though Lee. I'd contact the customer one more time asking how they propose to settle the problem, issuing a CCJ is a serious long term and life affecting financial black marker, hoping the customer will propose something beneficial to both parties. Don't know how long the CCJ is active before it self cancels, use that date as the back stop date, or a few days earlier and keep it active if the customer proposal fails. We all have bad luck sometimes don't we, I wonder why he agreed the work and seems to now negated the agreement, maybe something that could affect all of us anytime. ❤ from Yorkshire.

I’d say press the button. The only thing I might do is send the customer that’s your intention if you haven’t heard from them in, say, 5 business days. Yes, you’ve given them lots of time, but the CCJ has other impacts outside of the debt. Things like, it could impact their credit score, and their ability to get loans in the future.

Might be worth sending the non-paying customer a record delivery letter,,explain the court’s decision bit you will hold off enforcing the ccj for 14 days if full and cleared payment is received by a specified date or even a payment schedule (full payment before releasing the engine), giving a little window of opportunity isn’t going to cost you anything and the opportunity to avoid a ccj with a bit of time may help get the customer to respond . Another option is to get them to sign over the engine ownership to you so you can sell it instead of them getting a CCJ, that way you are not sitting on it for 2 years with all the money thats gone into it being tied up.

Hello Lee, Just a suggestion for your next video. You haven't mentioned the Rover V8 lately, Are you intending to fit solid cam followers and adjustable rockers or push rods? Would this be a good subject for the viewrs, as you could explain the reasoning behind the process. You could also mention the relevence of the rocker ratio, and when setting the tappets that it is more accurate to use a dial micrometer, particularly on bedded in valve trains as the rockers tend to wear a slight cup over time. When you receive a engine get them to sign a contract that says that when we tel you it’s ready to be picked up and payed for .They have 20 working to pick up or it will be dreamed abandoned and will be sold as per the signed agreement.
