The battle to enforce or bust an arbitration clause can be complex. A well-crafted arbitration clause is but one step in determining whether parties will in fact proceed to arbitration or the courthouse. Litigators should be aware of a series of considerations when seeking to enforce or attack an arbitration clause, particularly in view of recent case law and statutory developments.
