Great video very helpful for us consumers. Two Kia dealers have fobbed me off after damage that wasnt fixed from accident damage i had when car was stolen. Unfortunately went back a few times and they kept claiming they couldn't find issues with my car even though there were. Luckily i had my car insurance help me out.

If someone is that worried about the Dealer saying they cannot service their car at a particular time, just go to a different Dealer OR independent mechanic for that particular time. Or absolutely, do exactly what John suggested! Services dont jump out at you randomly.... you often get a sticker on the car that advises of the next date/km. Great video!

Yup, I have used consumer guarantees for many things, apple watch screen popping off outside of 2 years typically warranty, refund on satnav when it stopped working because 3g/2g was turned off and so on, apple watch strap snapped after 3 months and they said it must have been me snapping it. Always be polite and firm, point out that a reasonable person would expect it to have lasted a given amount of time for the price and quality of the item. e.g. you might expect an apple product to outlast other brands.

Same, son's Laptop died for the 2nd time within 12 months of school use, even though that's exactly what I told the salesman it was for. Yellow and Black electronics retailer tried to say because it was just under $1,000 ON SALE it was only covered for 6 months, wouldn't budge. Used consumer law and reasonable service life under consumer guarantee and they came to the party with a full credit towards a better replacement, which was all I wanted in the first place.

Shop around that's way to expensive. Independent mechanics will swap your pa5t engine for about $1200 and engine from the wreckers will be 6-8k 👍

After watching a previous clip you made on the Isuzu you mentioned ACL and expected durability which I always remembered, my $2000 Kenwood stereo stuffed up just after it’s 2 year warranty expired, Kenwood were woeful and refused to acknowledge it for another 12 months saying it’s out of warranty, went to QCAT and 4 weeks later had a phone mediation with Kenwood and QCAT to which within the first minute I mentioned ACL and expected durability to which Kenwood immediately backed down and I got a new stereo, postage , removal and refitting at $0 , Also the issue of the Mitsubishi 2.5 diesel engines cooking because of a acknowledged manufacture fault where they do replace engines for free no matter of age or kilometres, some dealers still refuse or try to charge something but I also advise people of your durability and ACL information and many dealers immediately back down, thanks John

had a problem with my car where i got a head gasket replacement and it ran like crap. took it back to the mechanic a number of times (first right to repair) and they could not identify any issues. took it to another repairer who identified a miriad of issues. got my money back for the repair which meant warranty on the so called repair was no longer a problem, and at that point the third party then investigated more thoroughly which found that the previous garage completely destroyed my motor (12k in damage) due to incorrect installation of my heads, not being torqued down correctly, and lack of due care with reassembling the car. ultimately i got a lawyer at this point and filed a case in court and won by default due to the repair not being fit for purpose. all in all a lengthy, expensive and stress inducing experience, but was well worth it as a new motor will be installed very soon (started this process a year and a half ago so keep that in mind).

That same independent shop would also be a good place for routine service if the dealer is booked or if you want to save money. Love the shirt. Missed it before. Must have gone off on a tangent and displaced it in my mind.

My understanding of consumer law here is that manufacturers can express whatever warranty they want to express, after all it’s a free country! But that doesn’t absolve them of the implied warranty of merchantability. Like a reasonable person would assume that if you buy a BigMac at Maccas it can be safely eaten. A similar implied warranty must surely exist for big ticket items like a car!

Yup, 23yo one owner Prado in for a service at local dealer. They did the service, charged over $800, and then wouldn't give me my car back stating it was unsafe to drive on the road, and handed me a $14k quote to fix/replace every rubber bit underneath. One $300 tilt tray latter I took my 4x4 to a reputable mechanic, who did the required work for $6800. My 4x4 drives like new, but I'm now suspicious my injector pump needs a overhaul.

A dealer cannot force you to do repairs to get your vehicle back. They also don’t have the authority in most states to assess the roadworthiness of the vehicle and issue any documentation that bars it from being driven

I had a not so serious problem with my Kia Cerato. It was under warranty. Referred to dealership that sold it. They were not interested in doing anything when asked twice at different times. Had even had it serviced on time by them each time. Contacted the head office re: Consumer Guarantee by email initially, including the comment you had given me when I referred it to you ..... they said this was important to them and they would get back to me ...... they didn't. Finally I contacted Head Office in NSW by phone and all they did was refer me back to the dealership. At this point I traded it in at a dealership on a Mazda whilst the Kia was still under warranty. The Kia was still quite safe to drive but I was so unhappy with Kia that I decided I would not buy another one.

Another option may be to find one at a wreckers, buy the engine from the wrecker and get a mechanic to put it in. Would be less than 10k or even 5k depending on what model it is.

for those who are here and it was too long / cant pay attention. Australian Consumer Laws. New car purchases, are GUARANTEED to last 10 years, via Australian Consumer Laws- Extended Warranty or no extended warranty. If you Modify the car that would affect "normal functions" of the vehicle, your on your own, dont turbo-charge your brand new car and expect the dealer to repair it when it blows up... MASSIVE CLAUSE: The car MUST be serviced correctly, via a licenced MECHANIC, at the CORRECT TIME INTERVALS!!! Dont skip servicing, or get Uncle Jimbo to change the oil and filter for you... Any problem that causes the car to not perform its "intended purpose" ie, the car is undrivable, but its purpose is to be driven, you are covered. The DEALER MUST: 1 Repair the car in reasonable time, with NO charge to you 2 Return you the money you spent at time of purchase in full (yes even if the car is 9 years and 11 months old) DEALER IS RESPONSIBLE, Not Australian head office of [insert car brand here], not the importer, not the overseas manufacturer - THE DEALER. aka the garage you bought it off.

Porsche have covered things after warranty for me, but given the size of the bills they will eventually stop stumping up for, it’s probably time to move it on before I have to take the hit on a new transfer case myself! (I’m on number 3)

I feel like I did every you said not to do. My dealership is telling me that they found two drops of water in my fuel and is the cause for my intermittent misfire that occurs in cylinder 4 only. They also said all future related engine problems are now “suspect” due to this. Please tell me how fucked I am.

I doubt that you can help me John because i've dumped myself in a situation of my own doing but i've recently purchased a 2nd hand car at an auction that was being sold on behalf of a major car dealer in Perth. After driving the car home it started to overheat and was low on coolant, next morning i topped it up and tested again , didn't overheat but coolant was low again and engine oil was discoloured compared to when it was purchased. I'm thinking the head gasket is leaking and am asking if the dealer that sold the car has dodged the bullet by selling at auction not on it's lot?

Another solid video John. Query though; won't a tow truck take you anywhere you want to go? Surely they are not legally compelled to take you to a wreckers, workshop, or dealership? Surely they can just take you back to your place? I don't have any mods to my vehicle, and I don't have any plans for the full "inadequate manhood compensatory kit" (2 inch lift, illegal "poke" due to ridiculous offset, tyres so big they scrub the guards, etc). However, these upstanding peers of society surely reserve the right to get their broken vehicle brought home? Of course I wouldn't want to be giving a helping hand to those who prioritise form over function, and giving them the idea they can take the vehicle home to rectify any mods that might be used for denying claims is not a goal of mine, but surely Ol' mate can get his XB Falcon GT brought home? Could it be grounds for denying claims if in the event of an accident or failure, the vehicle is taken somewhere else before a smash repairer/mechanic? I can see how that could be a "yes" if there was considerable suspicion that the vehicle had been modified between the incident and being presented for assessment, but surely it's a "no" if there does not appear to be any tampering? It'd be quite interesting to know as I (regrettably) associate with people who plug in engine tune mods to their vehicles' ECU (to enhance the performance), people who put on illegally large/offset wheels and tyres, and sometime even people who add accessories that they don't declare for insurance reasons - knowing whether them taking their busted vehicles home to de-mount all the accessories before an inevitable write-off claim sees them lose the lot, or to unplug the ECU plug-in performance module to make the vehicle appear "stock", would be automatically denied or could float under the radar would be interesting.

I genuinely think we need an Office of the Consumer advocate to give ACL genuine teeth. It can be funded by a levy applied to businesses found to breach ACL, a way to counterbalance against big corporations with massive in house legal departments who can effectively fight a consumer law case for free.

Again great advice John, Volvo Australia fobbed me off with headlights faded after 5 year, still under warranty, (now 6 years). Dealer said 'contacted Volvo, they say not covered'. Dealer solution 'Volvo sells a kit to fix it' . I think it is 'reasonable' to expect headlight (not globes) to last longer than than 5 years. I think I am up for another fight, but Volvo must know most consumers wont bother, as it is time consuming and overwhelming to fight with big companies. Skål! Ps. put up a webcam of your rubbish bin.

Nother funny thing, many years ago bought a used Vovo thru a Vovo dealer, looked immaculate, thought I gave it a thorough check, but later while washing it, found a large rust hole in the back door where it shut against the mudguard. The dealer said F off, but a letter to Vovo Aus caused them to tell the dealer ''Fix It Cs'' which they did, no questions asked.

I sold a car, and the head gasket blew on the new owner, they are now taking me to the small claims court because they belive that i sold it knowing the car had a problem. I servised the car every 12 months myself, around every 5000k. Dose this mean that the consumers garrentees act, would not be valid for the new owner. The car had only traveled to 42,000k, 7 years old.

If you're a private seller the CGA shouldn't apply. The buyer could have had a mechanical inspection, rather than blaming you. You also don't know if they thrashed the crap out of it, blew a hose or a belt etc.

It would be difficult for them to prove it and besides which Australian consumer law generally doesn’t apply to second-hand items where there is a reasonable expectation that the food has experienced some wear and tear. If I were you I would countersue and seek to recover costs for the frivolous lawsuit. That said I ain’t a lawyer!

I would like to say as someone who has been down this path. Document everything,every phone conversation,every email. Pay out of pocket for a second opinion from a trusted professional. Who will supply you with a written report. You can believe whatever you want,but without the facts you are wasting your time.

Y'now AE the legislation is "grey" as it needs to be cause there are so many factors that impact a consumer experience with a product. Usage / Servicing. The comment on fair Wear and Tear is kinda right. The idea of justifying a failure cause it's a thought bubble is a possible failure point in a protracted customer service issue. I do agree that if you do not have the skills to deal with the manufacturer then it's a mountain to climb. But this stuff is not Rocket Science and a solicitor should not be required. They just aren't. Do everything by email and then supply the ACCC with the evidence, You'd be surprised how interested they become when you do most of the work for them. Compare a Nissan Pro Warrior 4x with a base Model. It's all warranted by Nissan. And yes AE going out and increasing the Power and Torque figures of your under warranty new Navara from 140kw to 175kw could result in a failure point. Good luck with the aftermarket warranty then.

Hyundai vehicles urgently recalled over fears of ‘sudden loss of power’ while driving. Hyundai has issued a recall of thousands of vehicles over a programming issue with the “fail-safe” driving mode, which may result in a crash. Hyundai Australia warned the issue applied to a range of models with their i30N Santa Fe (TM), Kona N (OS), i30N Sedan (CN7) and Sonata N-Line vehicles sold between 2020 - 2022 all being recalled.😁 . *‘sudden loss of power* 😂

As soon as my i30N starts nagging me about its next service I’ve booked it…. early or not… the best rule is don’t accent ‘No’ from anyone but the ACCC. You can’t be told ‘No’ if you don’t ask.

Possibly a dumb question; I'd be interested to know your insight on how it would work for consumer law in that regard to being a 2nd hand owner being within the 10 years of the cars "birth"/relatively low k's, would it consumer law still be applicable?
