This case should be referred to constitutional bench of sc because in criminal case except some special laws,it is the burden on the prosecution to prove the case beyond reasonable doubt but in this case the accuse person is acquitted but treated him as convicted person.

What if after the final disposal of case he found innocent, will he get the job? Also the duration when he was not supposed to get into the job that period of time will he get the compensatory money? Because he had cleared the exam.

So, literally say if the senior officer has some grudge on the junior officer due to some external facts not related to service and to exact revenge born out of that external fact, the senior official maliciously files a case against this person who is the junior official, the junior official would still be even on aquittal be treated as a criminal on no fault of his. CRPC doesn't pen the term honorable aquittal, it only mentions "guilt established or not beyond reasonable doubt" , "prosecution failed to establish guilt beyond reasonable doubt", and "prosecution miserably failed to establish guilt beyond reasonable doubt " . So, trial courts never write honorably aquitted. They say one of the things from above as per CrPC. So, even if a person is fully innocent and the senior official is the actual guttershite criminal dog, that innocent person still has to suffer. Very funny indeed.

Under sec 320 crpc ,in case of compromise it is considered as acquittal then also court considered it as applicant is involved in the crime and denied him public employment. But the criticism is , court is not making any difference between benefit of doubt and acquittal in case of sec 320 crpc.

Agar love kush meena ko kisi ne bilkul jhota mukadma lagaya ho tou uski life tou kharab ho gyi na. Ab aap kahenge ki vo BNFT OF DBT se acquit hua hai. Magar mai apko bta do ki court ab kisi ko bhi baijjat bari nhi krty 90 percent cases me BFT OF DBT se case chorty hai.
