I owned a new copy of it for 3 weeks lol, my b'day was the 30th, returned it 3 days ago for a used copy. Doesn't matter, Steam's refund policy has to be in compliance with European and Australian law. Its the US/NA customers that have very little legally to stand on. Especially since the Australian law set precedent, refusing an Australian consumer a refund on an electronic service/good is illegal and you can't add your own terms or refuse. (that 2 hours or 14 days doesn't apply, you can still ask for a manually process refund). Bethesda can't tell Australian's your out of luck cause you downloaded it... cause the download itself is the faulty goods/service provided.

I personally don't think Bethesda can "No mans Sky" this game back to an acceptable state. Fallout has to great a player base who have been burned and will always remember this. No mans Sky had the luxury of being a new IP with no previous track record. Fallout has deep roots, meanwhile the Fallout tree is burning because of this dumpster fire of a game. Speaking of that, I like how fallout 76 is the sunniest most lively game yet even though it’s 25 years after the bombs fell. At that point being outside should be deadly within hours at most on a good day and minutes often and sometimes seconds. between imediate radiation sickness, nuclear dust and ash that would fill the air and clog your lungs and block out the sun, The nuclear winter as a result of that ash, Extreme entirely new weather systems causing all sorts of natural disasters, The likely formation of many new bacteria since bacteria would survive due to the rate at which they evolve and adapt making for incredibly deadly new illnesses that people have no imunity to, And even without all the ash and dust the chemicals released form the millions of destroyed cities and factories every single one on earth everywhere there are contaminants and dangerous gasses they would now be realsed, and with the amount of bombs and where some might hit like in Hawaii the forced volcanic activity that would realsee massive amounts of carbon monoxide and other such things changing the composition of the atmosphere making the wolrd uninhabitable for humans the same way dinosaurs could not breath in our current atmosphere, Oh and did I mention the radiation kills off all the decomposers so when a forest dies from the radiation and inevitably from human made things breaking down and sparking or lightning or and number of things that would start fires and by that time 60% of the worlds forest if not more would have probably all burned realeading even more smoke and all the radiation that had settled back into the atmosphere? There really is no possible way you could be wandering out there and live at that point and what you would see is nothing but ash smoke and ice and that’s if somehow enough light made it through to penetrate the thick clouds and storms all over the world and you would freeze within minutes most places. Now a game that explores that version a realistic fallout 25 years after where the vault is home base and you go out in full special hasmack power armor and fight the various horrible mutations while gathering data and samples and developing the tech and vaccines and things that make the latter games possible with friends would be really freakin cool, But that’s quite diferent from the West Virginia we see in fallout 76

Companies choose to put a label on it but it gets used for multiple purposes. I think we are beginning to see a shift in the world of game development. Publishers and developers are starting to face pushback from consumers, where they used to get away with lying and overhyping their products. People are also pushing back against DLC and microtransactions. We've been told repeatedly that story-based games are a thing of the past, and that nobody is interested in offline content. Most of these games are nothing but a lifeless sandbox where you can play with a bunch of strangers online, but nothing exciting really happens.

Publishers are facing backlash, however the company doesn't give a rat's ass. Look at EA/Activision, hell even Bethesda and Blizzard. The future of triple A gaming is micro-transactions and trends. Blizzard trying to dip into the mobile games because they're popular in China. Bethesda trying to get into multiplayer gaming and "games-of-service" because they make more money, also created the "creation club", which is more fleshed out than Fallout 76 itself. Destiny locked behind multiple expansions, forcing people to buy season passes at launch, or waiting to buy a 120+ dollar game. The shitty practices are everywhere, and will continue to grow. I only hope there are at least two large companies like CDPR or Rockstar Games at any given time, or else the gaming industry will be dog shit, and real gamers will only be able to trust reliable kick starters and indie companies

I haven't played RDR2 and from what I've heard, it's excellent, but Rockstar is a trash company. A year or so ago, part of their terms of service for GTA V on PC was them having a right to track ALL online purchases. Not to mention how quickly they killed GTA Online. They'll be the next Bethesda or EA the moment their success goes to their head and another big developer collapses to make room for R*.

Maybe it's just my bank but I personally went in to Chase they said dispute it with Gamestop. Went to Gamestop they said talk to Chase. So...talked to Bethesda they said sorry we cannot give you a refund. Luckily, the day I bought the game I didn't go anywhere or have any bills come in. most banks will do a fraudulent claim, and you will be given the money back out the gate, (atleast my bank and many others I have heard) BUT once their investigation is done, if they feel you obtained the item sold to you, they will recharge you for that same amount, and technically you could be charged with trying to de-fraud a bank, or like making a phony insurance claim, personally I don't wish to go through that for a 60$ game. Most people should just eat it and move along, I mean really it is only 60$. This is happening with ALL games in a lot of ways for example and not limited to COD, battlefield, madden, all basketball games. There is a alternate universe where it does, and where Fallout: 76 came out actually good, on a new engine, with NPC's, a new story, it was Co-Op/single player, and Multiplayer was optional, diverse class load outs and play styles, some made to work with others or hinder others, with P.V.P simply toggle on or off and full P.V.P driven areas, didn't break lore, and you could sell ammo.

Somewhere around 1999 the company took a turn for the worse and has only gone farther in that direction with each passing year. Todd Howard publicized his turn to the dark-side when he told us, at about the 37 minute mark of his 2012 DICE keynote address, that he was using Peggle as a model for Bethesda's games. Instead of solid role-playing and a compelling story, he chooses the easy way of psychological tricks to induce a sense of pride. Essentially he sees video games, not as a medium of art, but as money making Skinner boxes. If it is an art form and a legitimate product, then buggy, lazy, dumbed-down releases are the last thing you would want attached to your brand, but if you are just a sleaze only looking to convert IP into dollars, then buggy minimum effort and minimum story skinner boxes is just the thing.

But tbh that game was worth it to me, got more than my times worth... I only buy games used today, unless I dead-set know I'm going to like it (Hollow Knight, Celeste, Zelda, Mario, DKC)... But I still can't even know of ill like them until I've seen them. I owned RDR2 sealed for 3 weeks before returning it to GameStop for a used copy, which I've had for 3 days and am highly considering returning because after 8 hours so far I still don't enjoy it like I was afraid of... And hell, that was bought as a b'day present, not even *my* money and I can't justify keeping the thing even though I admit it probably it GOTY and the most highly anticipated game of all time... It just isn't for me.

Listen, I don't care WHAT industry you're in, you don't sell a " brand new product " to consumers which in reality is broken. Imagine if it was a brand new car, you drive your car home and bam, you start having problems, turns out your transmission is shot and your engine keeps failing. You contact the manufacturer and they're pretty much like, sorry, you should have bought the other model so that we could have issued you your money back. I hate this kind of mindset. Publishers shouldn't throw their broken games on the market to get the biggest amount of money, but rather think about the customers and what we would like to see and give developers/programmers the time to pour their hearts into the games. We're paying so much money for a triple A title, atleast give us a WORKING game then. It's not even about how good the game content wise is, it's about not being able to play it to begin with. Is that too much to ask for? I don't want to constantly spend another 20 bucks on DLC's (except it's an optional decision I can make for let's say more ingame content and/or *free* bugfixes) that try to fix these issues that wouldn't have been there in the first place if publishers weren't the greedy pricks they sadly are. /rant

Honestly, I gave up because online, no npc, shit story, flying dragon "scorch beasts". WTF?! How do we go from a futuristic nuclear wasteland with radiated mutants and ghouls to....flying medieval dragons spewing ice and turning survivors into zombies? Also, East coast AGAIN?! What about the Enclave "fortress" in the midwest? What about Mexico/Canada (cuz apparently after Anchorage the US annexed Canada)? While we're on the point of different countries, what about China or RUSSIA? SO many possibilities for a great NEW setting and story that delves further into the Fallout universe, but they threw it all away.

The alwasy online feature killed my urge to get the game, so i just decided to not get it when it comes out, then i find out that there are: No npc's Quests that are boring as hell Barely anything to do Bad pvp Buggy and glitchy beyond measure Really bad a.i. Fraud and robbery in the form of refusing to refund players. Not letting players delete the beta until they buy the game And a patch that was bigger then the game and only made things worse. No-mans sky was a different situation. They made promises about what the game might be and then released a functioning game that was not well received. This is a company who has released a product that does not work for many people, and refuses to give refunds if they have tested the product. Basically they have said that once you take the product out of its wrapping then it is your problem if it does not work. If someone sells you a product and you find out it does not work, then you are allowed to pursue legal action in order to get a refund as it is the company's fault that the product they sold you does not work/function/perform the task it was meant to. If you buy a car, start the engine and it just instantly fails, then it is the manufacturers fault. They cant just tell you that it is your problem because you tried to start it. You could not have known it was not functioning when you bought it. Would you have bought it if you had known it was not functioning?

I agree with you that people should be able to get a refund 100%. However I can pick a hole in your car analogy. The car isn't dependent on pre-existing technology to work, so if it breaks within a month then yes you are entitled to a refund due to a manufacturers fault. Game in the UK has a no refund policy on all PC games, and I think you can only return console games for store credit once they are open, unless proven to be faulty(don't quote me on that second bit). So it is normal for PC gamers to get hosed on refunds, is it right? No of course it isn't but there is precedent for not refunding PC gamers, and I think Bethesda will blame people's hardware for some of the faults to try and get out of this.

While i think this is how it should work, as this is an online game only there might be some problems with owning / licencing a game. In other words, Bethesda only licenses the game to you for a price, they do not sell you a product in the same way you get sold a car or a sweater. Also there is an arbitration clause in their ToS as far as i know, which make it impossible to have a class action lawsuit against them if you have not opted out of this by mail.

For me the real issue was because the most talked about aspect of the game was the settlement building aspect of it. And it's not that I didn't like it. I enjoyed it in fact. But, the main reason is that the most celebrated and talked about feature of the game started out as player made mods for Fallout 3 and New Vegas. The point is that Bethesda is some what less creative with their products than the players that make the mods for their games are.

Bottom line is gamers are so often idiots with this sort of thing and will buy any old crap. Why pre-order games? You basically don't do this with any other purchase, but for some reason technology seems to be an exception. With films, chances are you read a review or two before deciding whether you'll go and see it. You'll test drive cars, try on walking boots, whatever. You get an idea of whether something is going to be for you before spending your hard-earned money. Spending a tonne of cash on pre-ordering a game...why? For a special skin? A unique taunt? A glow-in-the-dark map? Because you can't wait a couple of weeks extra? Those things are really not important. This game had 'bad' written on it from its announcement when we were told things like no NPCs and given an ambitiously short time from announcement to release. Some KZbinrs and journalists got a chance to pre-test the game and it didn't look promising. Then came the beta - we all saw what that was like. Then it was released and people still brought it/didn't return after playing the beta. I mean, why? Professional games journalists exist and KZbin exists - we have had ample opportunities to simply not buy the game... and people still do because they want a special helmet. Bethesda, and every business in the world, cares about one thing: money. They really don't care whether glitches ruin your games. If they can make a game on the cheap and still make a profit they will. We've known this about Bethesda for years and people still buy their games (even more so with EA). Until these practices hurt their bottom line significantly then they'll keep doing it - we're mugs. So rather than moan on KZbin, just don't buy these games. Let professional KZbinrs make some let's plays and reviews and suffer for us before making our decision. Pre-ordering is a mug's game, and getting hooked on a gimmick or cosmetic and letting that sway your decision is just silly.
