Yes, good idea. Take notes and do not discuss any finances or strong emotions (good or bad) while at the property.

hypothetical question: if I have a home security system and somebody breaks in, would that mean a recording of the burglar would not be allowed as "evidence" because it was illegally obtained ... that seems dumb

Hi Tom. I believe the laws are different regarding a security system to monitor for break ins as opposed to recording potential buyers without their knowledge at an open house or if they are viewing a home with their Realtor. You would have to check with an attorney in your state for the answer to that. Let me know what you find out if you do contact an attorney and in what state that applies. Thanks.
