I filed 14 claims all at once. I was at 10% beforehand. In 6 months and only 2 C&P exams, I jumped up to 100%P&T with 10 claims approved. They even awarded me 4 additional claims I didn't even know to apply for. So it's not a cookie cutter experience for all. Bottom line is documentation in your service and VA records.

Applied last year, to make it 100% combined rating and also they have to correct my lumbsacral strain to be service connected. He had back injury due to accident. With additional 70% that he had this year + previous rating of 80% in 2014, yet he got a total of 90%. Don’t understand about the computation. Now, what’s important is they have to correct his lumbasacral strain to be service connected with degenerative disc disease nd arthritis. His head, neck throat C is deferred, gout is deferred, etc.

Here is what you do. Had something similar happen to me with a very OLD doctor at the V A. The first red flag was he told me to turn off my cellphone, my mistake. Set your cellphone on record to record the examination. This is what I did after I left the office. I went and got on my computer and typed a 5 page memorandum to the Director of the V A thru the Senate and House Chairman of Veterans Affairs thru my Senators and Congressman thru the V A Regional Director the National Director of the DAV thru Regional Director of the DAV and the Director of the V A Hospital. I went to Regional V A Office and called the Assistant Regional Director (speed dial) I told him that I have a memo for you and the Regional Director. I told him that I am down stairs. We went into a side office and he saw 10 FED EX envelopes I told him here is your copies of the memorandum. He read it and turned white as the paper. He asked me, How can we correct this problem at my level. I told him quit screwing me over. That old doctor needs to be removed permanently when he started yelling at me I got pissed off real quick. Imagine if he did that to a younger trooper that was in Mid East and became very hostile with the old Doctor he could have ended up in FEDERAL PRISON FOR ASSAULT. I told when I done here the Director of the V A HOSPITAL will get a copy and I already gave a copy to the DAV. The Doctor was relieved of duties, I have my Decision Review Hearing with my DAV REP and won my 100 percent. Document any hostile BS from the VA and the VA Hospital.

There are different ways to handle it. There are studies that show that PTSD can cause sleep apnea. If not provide a memo describing how your back and body parts such as your knees were injured it will help. I filed TDIU and was denied because my union negotiated 1 year of Sickness and accident insurance. ITS 2/3rds of my base pay before tax. They said this straight from my letter According to your employer at United States Steel Corporation HR Corporate Headquarters correspondence dated April 18, 2024, you are currently, on Sickness & Accident and considered an active employee with active benefits. Accordingly, since you are eligible to receive 52 weeks of Sickness and Accident benefits, no further disability benefits are payable after June 18, 2024. Favorable Findings identified in this decision: Your service-connected disabilities meet the schedular criteria for entitlement to individual unemployability. I submitted a supplemental explaining that isn't gainfully employed. I actually lost over the year around 35k while being on SnA and if found eligible for SSDI any backpay must be repayed. I was trying to get ahead of the curve for when my SnA runs out. Thoughts?

One caveat to filing your claims. Doing them all at once is the best way to go in my opinion but this means to literally do them all at once. Not opening an intent to file submitting 4 here then 6 months down the road 3 and just before the itf closes submitting more because you don’t want to lose your original itf for backpay purposes. You will lose your previous itf with every new submission of claims within the one year allotted for an itf window. So, if you open an itf and you do not want to lose that date for backpay purposes do not file again until the itf expires.

I have taken a lot of pain medication which caused anxiety and stomach problems (IBS) and in turn I developed psoriasis and the doctor said I have psoriatic arthritis because of it but the VA just won’t connect the dots. VA primary care referals to VA physical therapist, neurologist and audiologist are going to be your best friends. You need current diagnosis and evaluations documented in your records before you claim. You are correct you don't need a nexus for an increase. Range of motion for back are what moves that existing condition. At a C&P when it starts hurting and you stop moving dictates your back rating. Don't let an examiner force you to move.
