I've had a guy try to force his way into a neighbor's home, refused to leave and then swung on the neighbor. We took him down until cops arrived. Typical Portland police response: "he's clearly showing signs of mental illness, so the DA won't prosecute. So, we're not wasting our time arresting him." They let him go. He went across the street and attacked another neighbor. Finally, they arrested him. It's not that Portland police don't give a shit, but their policies set forth by a radical city council and DA won't let them do their job effectively. This city is just full blown chaos under the guise of hippie hipster's suburbia.

Never understood in what universe that is acceptable behavior. Again be mad or cuss or hell if both drivers get out then I guess fight but be done with it and move on. Smashing mirrors makes drivers more than likely just to hit the motorcycle than to be more aware since in their head they see the bikers as angry quick triggered people who will smash your mirror or worse over something that a day later means so little as heck it could have been a mistake. I just don't understand the logic behind that but maybe someone else will feel that way and explain it because to me it was a small incident that should be over with sooner than later not resort to breaking property. The fact is many police officer don't have training with every firearm its best to not even touch it period. And if the police officer says "It's for my safety". Well I call horse shit, I've seen police officers mishandle firearms to the point where they had a discharge. So no I will never surrender my firearm to anyone. People need to start asserting their rights before you lose them. And if you live in a state where you must disarm around a police officer then challenge it in court not along the side of the road.
@absolutelysobeast3 жыл бұрын
Just keep in mind guys the RIDER was the one who continued the stop. He absolutely starting trying to make small talk with the officer to be polite and he got taken advantage of. The officer said “sorry it was my mistake i thought it said blah blah whatever, you are good” to which crow could have said “ok thanks, have a good night” and ridden off EDIT: to clarify i absolutely agree the stop was bad and the officer took advantage of a citizen who was trying to cooperate and be nice and friendly. It was an abuse of power and should have never happened. Im just pointing out that YOU also play a critical role in those situations and if you start offering up explanations or excuses that you dont need to, you are asking for a problem. Crow admitted to several different violations by trying to justify himself and opened the door. Imagine this. A cop knocks on your front door and you dont answer. He has to get a warrant to come inside. If you crack the door now he can say he smelled marijuana or heard someone scream or saw a firearm on the couch or whatever and bust in. You CANT GIVE AN INCH of you rights away that you dont absolutely have to

Some people have commented about how 'nice' the cop was in the last clip, but he still disarmed the man and 'checked his papers' AFTER ascertaining that the bike was not stolen. These actions were unnecessary and (perhaps not by that individual cop but in general) are tactics used to test your compliance and provoke some kind of response that would allow the officer to 'justifiably' escalate the situation if they wanted to. The cop was polite, yes. But it was wrong (and technically illegal) to continue the traffic stop after the reason for the stop was discovered to be a mistake without any secondary suspicions being raised by the condition of the bike (roadworthy/uninsured) and/or rider (under the influence).
@TheOriginalEL3 жыл бұрын
Yep, that's exactly what I thought as soon as he asked for his licence. Dick move that, just looking for a reason to get his arrest quota up.
@PathinAZ3 жыл бұрын
Since you say it was "illegal", I'd love to see the revised statute for that. Any officer that conducts a stop must identify the person. Usually, the traffic stops fall under "reasonable belief" of a violation, so the actual stop wasn't "illegal". If the guy on the bike, let's say had something illegal on his person (drugs, or the gun was illegal), a lawyer might be able to defend the discovery of that under "fruit of the poisonous tree", and therefore a violation of the 4th Amendment, but that would be a LONG shot and have almost no chance of working IMO. The cop would only have to prove that he had "reasonable suspicion " that a violation or crime was committed, in court to validate the stop. Anything after that he finds (smell pot, warrants etc) would fall under a different "reasonable suspicion/belief" scenario. Most law is based on what is "reasonable", and that's why there are courts and lawyers to argue/prove their position. I personally think your description of " tactics used to test your compliance and provoke some kind of response that would allow the officer to 'justifiably' escalate the situation if they wanted to" is a tad conspiratorial, fomenting the "all cops are out to just ruin your life" nonsense. Well, it's a free country (so far) and you are certainly allowed to believe what you'd like.. Cheers
@archaeolas3 жыл бұрын
@@PathinAZ What I said about the tactics was an observation. I know there are a lot of good cops out there. However, the fact remains that these tactics are employed often, consciously or not, by those in positions of authority in many different ways. For instance, employing young women to work front of house in a bank. It's predominantly to utilise their social status (weak and vulnerable) to dissuade members of the public from getting angry when the bank mistreats them and to make it easier for the public to feel bad for 'the bank' when they get robbed, because of the harm caused to the innocent staff. Humanising an otherwise utterly inhuman system of control by giving it a pretty face. It's a basic economic/financial decision. Same goes for interrogation/interviewing tactics. Any system of control requires that you be subservient for it to continue so of course it will have in-built methods to test that. As for checking his ID... if the cop had done that prior to running the plate, or while he was waiting for the call back with the info, then OK. But he already knew the bike wasn't stolen BEFORE he took the guys ID and gun. It's my understanding that identifying yourself to the police is only necessary if they can articulate what crime they suspect you my have committed. In this case, there was none. If the guy had refused to hand over his firearm, the cop would have easily been able to argue non-compliance, which when a firearm is involved is instant 'justification' to draw their own weapon and escalate immediately to danger to life situation. Given that the rider had a concealed carry permit and the bike was ascertained to not be stolen, the cop had no right to disarm him. That said, of course if you have nothing to hide and the authority is benign, there is no problem at all with offering your ID and sidearm on request! ;)
@PathinAZ3 жыл бұрын
@@archaeolas Well, I understand where you're coming from where companies try and take advantage of any business tactics they can. It's why you don't see 400 lb women in mini-shorts and low crop top working at a "Hooters". What you describe (concerning the video) is what may be the hidden intent of the cop or the LE establishment, whereas I was coming from specifically a legal standpoint. That's the only reason I questioned the "might be illegal" in your previous statement. Concerning the refusing to hand over the firearm, usually states have very specific legislation on this. If you know your state law on what your 2nd Amendment rights are (i know that statement is confusing as the 2nd is protected by the BOR and really not subject to state regulation, but there is) , and you know (truly) how far a cop can LEGALLY go, then you can push the issue. Just like a cop asking "can I search your car?" , and you agree, even though there is no probable cause it's not illegal in any way. You can say no..and then they'd call for a k9 to open air sniff to establish PC to search. Anyway (went a little off there), the cop for his safety can legally take temporary possession of your firearm (if it's in the state statute), and sometime he can't. I can't argue this specific case cause I don't the state and their SOP on it. If you decide to refuse to hand your weapon over, you'd better know your state laws, because if your wrong then it could get ugly. I've been carrying for over 30 yrs here in Tucson, and I've been pulled over a handful of times..and I carry 24/7..That's why you're taught in class (take as many classes as you can), to say "Sir, my Dl is next to my CCW permit and I am carrying on my (location), how do you want me to proceed." Anyway, i personally (from my 56 yrs) don't believe there nefarious reasons for simple police contact laws, but to each his own. There is a lot of info from a simple "do I have to show my ID to police" query on your fav search engine. The best advice I can give anyone, is ALWAYS comply in a LE contact situation, even if you 100% know they are dead wrong/being illegal. Record, record, record and fight in in court. Even if you're right, you just might commit numerous felonies that WILL be held against you. Dead horse yet? Lol.. Good chatting with ya my friend, take care..
@archaeolas3 жыл бұрын
@@PathinAZ I don't know the specifics either, but my understanding is that if you have an open or concealed carry licence, then you do not have to hand over your weapon unless you are being detained for a valid (and articulatable) reason. Whether that's a tail light being out or you match the description of a murder suspect (or you ARE the murderer of course!). I agree entirely that you should let the cop know as soon as possible if you are carrying and do everything you can to not escalate the situation yourself. Including complying with whatever requests the cop makes. I'm not saying this guy 'should' have argued with the cop. Just that this instance is a good example of the boundaries being pushed and you don't have to look very far into history to find evidence of where this leads if it goes unchecked. Good chatting with you too, stay safe out there!

You're having this misfire in your brain about patience, YOU, and I mean you as the individual you are, needs to have patience for those around you who do not. Patience for those who are stressed, anxious, having a darwinistic thought of "fight or flight."
