Like Jim Carry later says, it’s a technicality. Outside of her birth certificate and driver’s license, no one had a clue she changed her age. Even the husband didn’t know. I know from experience that once a lawyer has a good lead on where they want the case to go, they become so blind to other possibilities.

As a result, the prenup and very likely the marriage license were invalid and they would have had to enter into a new one once she turned 18. Think of it like this. The prenup and the marriage license were invalid so the terms of the settlement were decided by California common wealth law. Also, I should note, that given she was born in 1965, she likely would have been married in the 80s when divorce law was in its infancy.

By acknowledgement and validation with repeat and probably celebration of anniversaries cemented the marriage even after she was of age repeatedly hence it can be validated by that. However, prenap is invalidated because of the one time and probably due to the fact that maybe they had never reviewed it. If they had reviewed it and dates changed, that's a difference case altogether. She won by default because she could also plead for coercion at that time due to her being a minor...... There is more weight to that statement than the simplicity that is shown in a few minutes of a movie. There is also alot that comes with the fact that she is a minor that could also cause the dude to drop that case so fast........ The argument is very plausible

But the law in California is that under circumstances like this it is a de facto "common law" marriage (considered married by the state without there being an official wedding due to cohabitation and living as a married couple.) From what I can find, if you're married before the age of 17, when you turn 18, if you continue the with the marriage it becomes legally binding unless you choose to void it. Something along those lines. If that doesn't hold up, common law would take effect given that they had children and were together for as many years as they were

All in all this is pure drama, can't believe the husband's lawyer failes to know the basic facts of her lying on the age. By that same logic, doesn't it mean their marriage is null and void too? Unless CA has common law, they were never technically married so you can't get divorced i.e. no estate to settle.

It wouldn't if the court finds the prenup to be void they would also have to declare the entire marriage void as well which would mean they were never married and if they didn't the guy could instead file for an annulment of the marriage

Never been married so I don't quite understand. If the marriage contract was void, then since they're technically not married, how can she be entitled to half the assets? Even if she WAS a Common Law wife, then she STILL signed the prenups, so then wouldn't the contract be ruled valid anyway. She shouldn't win anything. I'd have sued for fraud. Even if the contract was invalid because of her age, the fraud was ongoing, and she's definitely old enough now.

Wait.....but marriage is also a contract which means that if she was 17 when she married and cannot enter a contract without parental consent, that means the marriage was null and void. So she isn't entitled to anything in the prenuptial because under California Law, her marriage was illegal thus making the pre nup invalid.

Whether she intended to fleece him in a divorce or just intended to be financially supported by him, either way it's intent to commit theft by fraud, in the sense of acquiring money or items of value under false pretenses. Here's the thing they glossed over or ignored: while bizarrely there is no minimum age to get married in California *with parental consent* (said consent must be in writing and witnessed by the court), the minimum age to get married *without parental consent* in California is 18. So, at 17, she was not legally able to enter into the marriage either. Therefore, not only is the prenuptial agreement null and void, so is the marriage. She could argue common-law marriage (if you live together and present yourself as married long enough, you are considered married for purposes of law), but since she entered into the marriage fraudulently and the husband presented them as married due to that deceit, he could challenge that. She'd also have a harder time getting custody (and thereby child support).

@@woodrobin No. The mens rea element in California requires specific intent to defraud. It also is not "theft by fraud" because at the time of the misrepresentation she didn't intend to permantly deprive any lawful owner of his property, which is a necessary element of a theft or larceny. Ironically, if she'd known ahead of time that she could use the fact she was underage to defeat the prenuptial agreement, you might be able to persuade a jury that this was her specific intent all along. The fact that Jim Carey had to figure it out while he was sitting at counsel's table suggests she lacked the necessary criminal intent.

Meaning that the marriage was real. But the prenup was void. And after the divorce she gets his money. A lot of it has to do with how the justice system works in our country. Like "She's used to a certain lifestyle" or "she needs all that money to help her with the kids" it's not right but that's just how it is. .

Adding on to what Figs said, California is a “no-fault state” when it comes to divorce, no matter what happens, the assets are split 50/50, unless one party claims domestic violence.

The thing is the husband could still technically win the case if he appeals having learned that she was under the age of 18 means that she committed fraud when she signed the contract. This would in fact open her up to a whole new list of lawsuits, worst thing that happened to this guy is that he lost the kids for a week.
