The only thing that I can think of is the wallet security policy on the bitcoin that can be tracked. If that becomes compromised so does every investor that has it. It needs to be insured as well as strong social engineering with regards to access and seed phrases and hacked computers. That is the key that the SEC would need to get for it to pass no problem as a Spot ETF has to have proof of ownership and due to how risky it can be to have it in a wallet for an extended period of time, it can be extremely risky. I think the end goal needs to be a periodic change in wallets over time to reduce the risk of old wallets being compromised.
