Police pull you over, you converse, they tell you to do something that's within their rights to ask of you, you comply and stay aligned with your own rights. It's honestly that simple. They attempted to arrest her whilst she was standing with her phone, refusing to comply, therefore making them have to forcefully arrest her. It wasn't excessive, the only excessive thing was the 4 minutes it took to get the woman in handcuffs because she wouldn't move her arms (that were free of any grasp at multiple points) behind her. Asking the same question over and over again while not listening to said officer isn't going to get you anywhere, nor is it going to make the arrest all the more enjoyable when the only nearby floor is gravel. Just exercise your rights and the officers will do the same with their own, more so- *just know your rights so you don't end up like this woman turning a signature into a 10+ minute arrest and drive afterwards*..

I disagree! The officer escalated something that was so easy to to do. He should have just informed them they shouldn't be out there so they could leave but instead he forces them to sign something that they have no idea what they're signing to no idea if they're committing a crime! If that happened to me in a city that I did not live I would have signed it and stated I was standing under the rest because the officer threatened to arrest me. Actually it's promising to show up for court. If a person misses court, normally you file a motion to vacate conviction afterwards if you truly want to fight the ticket. The judge will usually allow the motion to and give you a new court date. But if you sign the ticket, then try to go through the same process, the judge will deny the motion on sight no matter what. It's because your signature is a promise to appear and comply with all stipulations. When you miss court after signing a ticket, you break that promise. You don't honor your oath. Your promise. So don't judge denies your motion because of this and you're stuck with that default judgment and fines.
@NotMyEmail9 ай бұрын
@@chrissuave92only in signature required states for citations you will get arrested for not signing. Check the law in your state. There are so many non signature required states for citations. In Illinois you will not get arrested for refusing to sign because Illinois is a non signature required state for citations. Only reason they try to threaten you with arrest for not signing is for revenue. because they truly dont be wanting to go through the whole jury trial process blah blah blah.... So if they secretly intimidate you to sign by threatening to arrest you if you don't, just know that they will not do it if your state is a non signature required state. That's a lawsuit waiting to happen but most people don't know their state laws so it happens often in non signature required states and people never question it because they don't know. So the cop ends up getting away with doing it and enough time eventually passes over and the statute of limitations runs out and you miss your window period to sue. All this happens when a person doesn't know. It's false arrest that's what it is. Because in non signature required states, an officer telling you to sign a ticket is an unlawful order. Therefore, you are not obligated to do it. If he arrests you afterwards and then try to twist things around and say he arrested you for something like disorderly conduct and not refusal, you will see the truth on the bodyxam that he did in fact arrest you for refusal and he would be in trouble. It happens so so so much but people never know.. so sad.

She had two options, she chose jail. You can't act defiantly then beg for the lesser option when reality hits you. She wants to act tough, expect to be treated tough. If she's hurt, it's not because the cops hurt her, it's because she resisted and the appropriate force to put cuffs on her was administered. Yes & she personally attacked him asking for his name & badge number like she was looking him up to find something on him! She was calling him Mr. Brooks instead of Officer Brooks. She totaling disrespected him! She should have been looking up park hours of operation! Her boy should have told her to sign the damn ticket so they could go. He stood there like a doofus & had the nerve to tell the officer to stop hurting her. If she had put her hands behind her back, it would have been over. He could have tased her & had her in handcuffs less than 20 seconds if he wanted to. He took it easy on her & even called for backup. She brought this on herself! She knew exactly why she was being arrested! She said she was only asking for his batch number & he had told her he gave it to her twice & wasn't again. So he did answer her question. She flat out refused to sign the ticket & then says she wants to sign the ticket! It's too late now! Off to jail, she goes! This is over a $60 ticket. Now she has resisting arrest, too. That thumbnail said it all! The officer explained to her why she was getting a ticket and that she would be arrested if she refused to sign it. She chose to refuse to sign the ticket and actively resist and not follow the instructions of the officer! The officer used the force necessary to detain her and the body-cam will back the officer! It took 2 officers to put her in custody and she was still fighting and acting like the laws don’t apply to her! Entitlement at it’s finest!

This mentality is why USA jails are so full. It was a park ticket. Not a bank robbery. If the cops could barley hold himself back like he stated..he is dangerous on the streets. The princess cops had his feelings hurt. And is obviously unable to handle his temper as he stated over a ticket!

@@maggienificent1 we must not have watched the same video! This officer had the same conversation with the male, he signed the ticket, no problem. When she started with the “I’m not signing it” and was told several times what would happen if she didn’t sign and still refused to sign. She thought she was special and the law, that applies to everyone else, doesn’t apply to her, well she was shown it does apply to her. This was the path she chose, there’s consequences for actions and she found out what those consequences are. She should’ve just signed the ticket and lost that entitled attitude! An officer’s job is hard enough without this foolishness.
