2016: Leah Askey, was sued Wednesday by an ex-husband who claims she abused her position to gain unauthorized access to his old cellphone and extract deleted text messages, emails and other communications. " I’m not going to dignify my ex-husband’s frivolous claims with a response,” Askey said by phone Wednesday. “Not now, nor have I ever done anything that I believed to be illegal at any time,” she said, whether as a prosecutor or a mother". I don't know what happened with this lawsuit either. She's a criminal!

I'm absolutely disgusted that all of the people that helped Pam Hupp frame him, because that's absolutely what they did, are free to go work somewhere else and live their lives. The judge, who was childhood friends of Leah Askey, and Leah Askey were voted out of office in 2018. The judge was suspended without pay for 6 months before that, but for other horrible abuses of power aimed towards low income prisoners, not the faria case. She purposely waited 60 days to appoint public defenders to incarcerated people so that the public defenders couldn't request a different judge! Leah Askey, now Leah Chaney, has a private law practice called Chaney Law Group. The police officers, detectives and the other special prosecutor likely just went on to other jobs. The court opinion from Russ's lawsuit states clearly that they all violated his rights. They hid evidence, fabricated evidence and ignored evidence that exonerated him. Leah Askey was only dropped from the lawsuit because prosecutors have absolute immunity, even if it's malicious or illegal conduct! As long as it's done during judicial proceedings that involve a prosecution in some way, they are immune! She then went around telling the media that she was cleared of wrong doing even though the court opinion clearly states that they cannot drop her from the lawsuit due to lack of evidence, only due to absolute immunity. The new prosecutor, Mike Wood, then claimed he was investigating all of them for possible criminal charges. The evidence was already clear based on the court opinion, yet nothing came of that mountain of evidence. I can't find a single mention of it after last year and he never released a report. This is why this happens because nothing happens to the criminals working for the state that literally frame people! *OH and after hearing what some of those jurors thought, we need IQ tests for all jurors at this point. The evidence was so clear even without Pam Hupp's motive! 1 juror thought he had time to kill her and clean up even if he got home at 9?? How was the blood cold and coagulating with her in rigor then? Just ignorance all around.

Damn shame that this is what happens to Black folk all the time and yet Pam is still enjoying her privilege even in jail. Thanks again for your insight. Yeah this really happened. It’s enraging that the original investigators could only see Russ as the suspect. Not even considering Pam - since she is the one who the last person to see Betsy alive. She did it for the greed of money. The assumption that “as soon as they ask for a lawyer, that means they’re guilty” needs to disappear. Getting a lawyer is just being smart. Lawyers are the mediators between their client and the police.👮♂️vs🕵️♂️
@dennisjohnsen72972 жыл бұрын
Russ got $2 million. The woman that Pam propositioned to “reenact a crime”… Russ and her got married. Understand the golden rule; never talk to the police. Police are there to make arrests, not friends. Police can do nothing to help you. Notice that when they read your rights, they tell you that what you say can be used against you, but they don’t say that anything you say can be used in your favor. The only thing you ever need to say to the police is LAWYER. Invoking your 5th Amendment right (the right to remain silent) is great advice, but that can be used in court against you as to insinuate that you have something to hide. Invoking your 6th Amendment right, not to answer questions without your attorney will 1) stop the questioning and 2) it cannot be used against you in court. Russ needlessly endured the long interrogation. You might think that you are helping to solve the crime, but if you truly have no idea how it happened, then you have nothing to offer. If you think of something later on, you can tell your attorney, but don’t think that you should call the police and tell them. Once you “talk to the police, after you have invoked your 6th amendment right, you just negated your invocation and the police can ask you as much as they want. You’ve already been made aware of your rights, so they are not obligated, nor are they motivated to “reniform” you.

This was a satisfying listen! I've become addicted to this story since I first saw it a few weeks ago. True crime documentaries have captivated my interest and tales like this are incredibly fascinating! I'm locked in, hoping to see justice unfold and be served to the police, investigators, attorneys, and even the judge who did their best to convince the jury (I don't see why they can't be questioned and brought to light to explain their logic in weighing the evidence vs the fantastic tale the prosecuting attorney weaved...) I hope they all get put on the stand to be questioned about their conduct! The Farias were relentlessly targeted, and the fact that there are people in the family and community who won't accept that, even given the evidence, are just as willfully spiteful as Pam Hupp was! I pray that the new prosecuting attorney and his team stays as true to their courses of action/ investigation as they've vowed to be!

Fascinating case, I remember listening to this particular case on a crime podcast, the original judge and the prosecutor were out and out biased against the defendant right from the get go and were determined to send Mr Faria to jail, the police interviews were found wanting to the point of being criminal, if they had done their job properly this woman would have been behind bars long ago and that poor guy who she shot would still be alive !! well done to the defence lawyer for never giving up ....this case was FUBAR !!

I typically don’t blame the jury for making the wrong verdict, but in this case, I truly believe that they say back there and came to the court that “someone did this, and it’s most common for the spouse to be the culprit.” Rather than focusing on whether the evidence proved guilt, they focused on what statistical norms are. I would have to ask how someone can be so indifferent to the fact that this is a human being that is being locked in a cage for the rest of his life, simply for the sake of gaining a conviction.

I wonder why the Feria's got their Troy home at a ``cheap price.'' Maybe another unnatural death had once occurred there. It is very austere looking. So is Hupp's home, w/dark front door, zero welcoming accents or landscaping out front and huge, prominent garage indicating an emphasis on materialism versus human beings. That aside 'not ever gonna call 9-1-1. Be that as it may, God bless Joel Schwartz! I would like to hear Mark Hupp's story. I read Susan Smith's husband's story, thinking it would have fantastic stories of life w/a pathological liar. But he seems to have been complete;y duped. Tales of the cheating at which he finally caught her after he finally followed her to a college course she was supposedly taking . . . ha; I'm sure there never was a college class. I'm sure that was a permanent cheating rendezvous, but he acted like the one time he followed her was the one cheating episode.

Russ didn't have a chance with the DA who wanted to win the case, so she would be re-elected and the judge who was her personal friend. Therefore, critical evidence was not given to the jury. Although the time stamped receipts and alibi should have been enough to find him innocent.

Another copy cat murder mystery, Russ Faria parked in his driveway at close to nine forty-five and went in through unlocked front door to the small foyer of his home.
