@@terryenby2304 Coffee's "ideal" serving temp is 190F. That's only 22F from boiling. It should never be served to anyone when it's that hot, though. Judging from the damage it caused, burn experts concluded it was served to her around 180-190F. It didn't destroy her whole vulva. It did destroy quite a bit of it, though.

Part of the reason the USA is lack of socialized healthcare. It's common for our insurance companies to refuse any payment until anyone who can possibly be sued to cover it has been. The hospitals and doctors will tell the insurance company if you mention falling or being in an accident too. A lot of people don't realize that, and they are just being honest with their medical team. Also, if you get caught lying to avoid suing someone you "should" have, you've just committed fraud and they will come after you. USA USA USA!

A buddy of mine who is a lawyer mentioned to me once that the McDonald's coffee lawsuit has made it into a law class (no clue which, probably an ethics course) as the book example of how media can distort the facts of a suit and guide public opinion. I would guess the point is to break you of the very human habit of forming opinions without all of the facts.

Don't know if someone already mentioned it, but cars didn't used to have cup holders. Everyone (driver and passengers) put their drink between their legs because it was the best place to hold it and leave your hands free (I'm old enough to have done this). The lawsuit was in 1994 and after that car manufactures began installing drink holders.

They become disabilities when they begin interfering in your day to day life, so yes, a fire fighter who develops a fire-phobia, which others might consider common sense, that prevents them from doing their normal job, fighting fires, is a disability needing treatment. Sometimes, it's curable, other times, not so much... If the phobia doesn't interfere in your normal life, it's not a disability FOR YOU. I'm apiphobic, but since I'm not a bee keeper, and it's not a problem for me in daily life, it's not a disability for me. That would change if the building I worked at decided to suddenly put up a bunch of hives to encourage pollinators in the area.

I am legit being sued by a man I rear ended from a stop, where the insurance company found minimal damage, who was out of state, had no license, no insurance, and drove an unregistered car, and was perfectly fine, for physical harm, a year and a half after the incident.

I was sued for defamation for calling a convicted felon a felon. That's literally the complaint against me and why I was named in the suit. John McCaul is literally a convicted felon and has a felony on his record. A total of 17 of us were sued over posts on Facebook. Since what was actually said was actual fact, the case was thrown out. HIs attorneys ended up losing their licenses.

@@kellytaylor6651 That was everyone but the guy's lawyer wanted to know. The funny thing was, he had bought and paid off the car before we even started dating. It was literally his car, even if I wanted to, I had absolutely no say in what he did with it. We self represented, no lawyer. All I did was ask the judge if his wife gave him permission to drive to work that day. Not only was my case thrown out, but the judge restricted compensation to only what our insurance would pay out because he was so obviously trying to milk the accident.

That's a temporary issue at best. The disability would be PTSD from whatever happened to cause the phobia, but if you JUST have a phobia for no reason that's not a disability. If you suffer generalized anxiety disorder and have frequent panic attacks from things you fear, that's not a phobia. That's a disability.

Yea I feel like it almost always comes down to how much it interferes with your day to day life. Like if your agoraphobic and can’t leave your house that’s clearly disabling. But I feel like fear of fire as a firemen is like saying well I have social anxiety but it’s discrimination not to hire me as a salesman. Like people skills and sales personality is a skill some people have that make them good fits for the job. Especially if they’re not firing him but rather moving him to a position better suited to their skills it’s a reach in this particular case. But certainly there are phobias that can impact your everyday life to the point it’s a disability.

You'd be surprised to know that a lot of American firemen have pyrophobia and still serve. They even have special therapy sessions for pyrophobic firemen precisely because many acquire it on the job, as was the case with the guy mentioned in the video. That's why the court argument was that pyrophobia was not a disability instead of the seemingly more obvious one you mentioned. It's similar to how many serving soldiers have PTSD but are still allowed to serve. There are ways to maintain and cope with post-traumatic stresses in any occupation.

Fun fact, in America it’s required in every state to have an agency that helps individuals with disabilities gain employment that reduces the impact or barriers caused by the disability/disabilities. Unfortunately, they just spend a their money trying to avoid lawsuits. Like paying for someone to become a pilot who has a reduced ability to make an accurate decision in an emergency situation. A disability is defined by barriers in at least two areas of daily life (school, work, social setting) AND is anticipated to last longer than 12 months. So, pregnancy isn’t a disability because it’s not going to last a full 12 months.

The McDonald's coffee was served at (according to the lawyers) 180-190 degrees Fahrenheit. The National Coffee Association states that the appropriate range is 195-205 degrees Fahrenheit (while 140 degrees was the argued maximum). That was a ridiculous lawsuit (if not frivolous), especially the amount settled for.

That brewing temperature not holding temperature. You brew at 195-205 but industry standard is to hold coffee at 150-160. Keeping it 180-190 was extremally dangerous as at these temperatures you skip past burns and into melting skin. Stella Liebeck only sued for the medical bills and court costs in that case she won 70% as 30% of what happened was deemed her fault. However as McDonalds had already lost a lawsuit about the danger of the holding temperature meaning that the holding temperature was already legally declared dangerous and punitive damages applied because they didn't change anything. The huge amount was 2 days of profit for this dangerous profit the amount sound ridiculous only because punitive damages where at the time meant to actually be punitive and McDonald make a ridiculous amount of money. This amount had nothing to do with Stella Liebeck and everything to do with punishing McDonald for they're own bad behavior. As my Corporate Law professor put it after the first lawsuit McDonalds had the ethical option of lowering the temperature (which they wound having to do any way) the unethical but smart option of keeping the temperature and settling any other lawsuits or the brain dead option that they went with of keeping the temperature but fighting lawsuits an option that was guaranteed to get the result they got. It was literally held up as the gold standard of what not to do if you/your company get sued. Also important to note that McDonalds only had to lower the holding temperature range 10 degrees to make it safe.

Actually the McDonald’s lady never blamed McDonald’s for making her spill the coffee. They lost that lawsuit because that McDonald’s had been cited multiple times for serving coffee that was almost at the boiling point of water. Liquid that hot can cause third degree burns in seconds, and pardon a bit of grossness, but the coffee literally melted the skin together “between her legs.”
