Thanks for the awesome video. I have a small question. If I have UBN pet and UBN toys... would it be a problem to sell just the brand UBN toys to someone if my plan is eventually sell the business to someone?

Hi Dan, Thank you for all of your videos--they are great and super informative. I have a question for you--you note that getting a trademark can take up to 9months in the US, if I do not have the trademark approved, would I be able to start selling the product as "generic" and then change it to a branded product off that original listing? Or how does that work?

Thanks mate for this great video. I have a few question about trademarking. My brand name has a logo on it. e.g Michjor with a logo of MJ in a circle and placed on top of the name. If i want to trademark both the name and the logo . Do i file the name / logo as 2 individual applications or i can file for both together? Please advise. Cheers

Michael, from memory of a convo I had with a TM attorney on this, each mark is separate, so your wordmark (Michjor) and logo (MJ) would each require a separate TM. I think there are also ways to do combination filings but for Amazon purposes, I suggest just doing the wordmark in capitals (MICHJOR). Your logo (MJ) may also change over time.

Hello Dan. I have a quick question. 1. When we register under class 35 and then Amazon brand registry, Can we remove hijackers from our listing which will be a physical product. ?

Hey Husain, brand registry kind of "bumps you up the line" a bit in terms of getting hijackers removed etc. What's better though is that you can use the Amazon Transparency Program once brand registered. Apply the transparency codes to your products and in this way, eliminate hijackers from sending in inventory ro sell on your listing.

Hi Dan Thanks for another great video! As you mentioned... getting a trademark can take a long time... can you still continue with the process without it, or I think what you said, is Amazon will require this when you are setting up your brand?? Hope that makes sense? Just would like to get organised before setting this up soon! Thanks

Hi Mark, There's No requirement for a trademark to set up. 100%, set up and get moving and later do the trademark when you know the product line, I replied to your other comment too.

Thanks for the reply Dan... you are soon to be a front runner in this space. .. especially amongst the Saffas for now.. Very exciting! That's good news... Will do my research to ensure I have a very fictitious brand name, but what happens if further down the line you don't get that trademark? Would you advise to change brand names then, or just keep trucking? Worried about hijackers!! Thanks for taking the time! Much appreciated

Thank you Dan, this is some really great content! I am just starting out, and the UBN method is what I was wanting to do. I just had 3 questions 1. I was wondering if you have personally tried this, and if so, does Amazon give you any problems with brand registry when using the UBN approach? 2. Does Amazon brand registry give you any problems when putting a niche caption on the bottom of your logo on your product 3. If you have a product under your UBN that is having a lot of success, and you want to branch it off to it's own trademarked brand, can this be done very easy? Also, say your trademarked UBN name was "Blue Mountain", could you later trademark Blue Mountain Outfitters with a more specific class to allow better protection? Thanks again!

Hey Kyle, great questions! 1 - I have done this approach. Amazon only cares that your trademark is on the physical product, so it works for brand registry. 2 - No, as long as your TM is on the product and it is a registered TM of the wordmark, you're good. 3 - You can do this. TM the new wordmark and then once registered, on the next reorder of inventory, drop away the UBN. On the last part "Blue Mountain" to "Blue Mountain Outfitters", you could but I almost wouldn't suggest it for the time and money involved unless you had some really good reasons. Keep in mind, at least at first, your main goal is just Amazon brand registry. :)

Say im brand registered on amazon plus my trademark with the trademark office is registered under clothes. I understand that technically my trademark is not protected if i sell housing products BUT, I was wondering this. If you are brand registered on amazon do you get the benefits regardless of what category your posting in. Like if i wanted to sell housing products would i still get gtin Exemption Video privileges, ect? Please and Thank you so much.

Very thorough and great video Dan, you are really helping lots of people with these videos. Just have one questions. Right now I am still researching my first product (not found yet), though I have my seller account created on my incorporation's name in Amazon US. Since registering US trade mark takes 6 to 9 months, can I still submit an application to register for trademark? I already have decided Wordmark as and when I start selling on Amazon US, so is it good idea to register for trademark even if I haven't decided for the product?

Royal Pearl thank you! To answer your question - There are 2 ways you can file for your TM, "intent to use" (before using mark in commerce) and "in use" (once using the mark in commerce). At this stage, I prefer "in use" and file for this immediately after selling units with this wordmark. "In use" is faster and cheaper. The last one took me exactly 6 months in US, quite recently. It is obviously very important your wordmark is unique and you do all your checks so you are quite confident on the TM office accepting the application. I use a TM attorney for advice on this, although there is never 100% certainty. The choice is yours really, you can do an 'intent to use' now or wait and do an "in use" later. If I were you, not knowing what the product will be, I would focus on product research, choose, build, brand and launch it and then do an "in use" app on that wordmark.

Hey Dan, great video but I’ve got a question. Since it takes up to 9 months for uspto to register your tm can you register it in India/I’m/japan for amazon us? As I see amazon itself says your tm should be in one of those countries, but haven’t found any detailed information about would you be able to sell only in the country where the tm registered or not? Vlas that's a very good question. Of course, you can sell in any country regardless of where your TM is registered. You won't have 'legal' protection of the mark under the 'other' country's TM law but I think what you're mainly getting at is whether you can gain brand registry benefits in other countries. Here's my experience with this. I am able to use both US and UK trademarks for brand registry in the US, for example. Drawing from this, although I cannot guarantee anything, I would say that you can use trademarks registered in the specified countries to your benefit on other country Seller Centrals. To that end, registering elsewhere could be faster but I recently did an "in use" TM application in the US and it took exactly 6 months which is super reasonable. Overall, I would still suggest applying for it where you will actually make sales so you also have the 'legal' protection over and above the brand registry benefits which are the most useful. The time difference will be just a few months. if any different at all. Additionally, you never know if Amazon may change this 'inter-country' trademark to brand registry benefit.

Hey Peggy! Thank you. On your question: No, you will only need to register your trademark with the trademark office associated with where you aim to sell your products. So, if you are only selling in the US, you only need a US trademark. When you expand, you can look into registering your mark in those other areas. One tip on this, you have 6 months, from the registration of your mark in your first marketplace, in which to use "some treaty thing" in order to really easily also register your mark in other countries (eg. Trademark your exisiting mark you already just registered in the US, in the UK as well.)

Issey DBAs are more common in the US. If you are in the US with a US company, then why not go for the DBA too? That is fine. DBAs are state-level though. Trademarks are federal level, far more important. You do not need one generally. Your brand name (the one on products/on websites etc) is often what the DBA would be too as that is what you are doing business as.

Hey Jonathan! Yes, you can, the lines on South Africa being an accepted country for the US are a bit blurry currently though, as SA is on their list of supported currencies but not on the accepted list of Amazon seller registration countries. Many saffas have asked about this so I am putting together a video on this specifically for South Africans :) A sure-fire way of doing this is to set up a company in an accepted country and apply with that entity but I am currently putting together content on this subject and that video will shed more light on the situation.

Hello Dan. My product has a logo on it but my packaging is just a poly bag without a logo. Would this be a problem, or is it OK to just have the logo on the product itself? I am getting conflicting information from different sources. Some people are saying that you need a logo on both.

rstscott in my experience, you do not need the logo on both, it's one or the other or both. Here is the exact wording from Amazon: "An active registered trade mark for your brand that appears on your products or packaging." "OR" being the key aspect. The main thing is having your registered trademark number and ensuring this a trademark on your wordmark (part you can spell out or vocalize) NOT logo or slogan etc.

Hello Dan! I like your videos. Some people think that they should earn tons of money by sharing experience. It is proven that all the successful people (in a long term) are people that always shared and learned things from others for free. Congratulations for being well intentioned. Keep it and be proud. I have a question about this topic. What if I’m not the brand owner but the official representative of that brand in the country or countries I plan to sell, am I able to present to amazon the brand owner authorization given(granted/acknowledged/permitted to me? Does amazon have this option for sellers?

On your question, even on signup Amazon does ask are you the beneficial owner or a representative of the business and so yes, Amazon does have options for this. Also under Settings there is User Preferences where specific access to areas can be granted to multiple users or software applications.

Hi Dan! Very thorough and great information! Im still learning this FBA business model. I haven't signed up for an amazon account and not sure of what niche to get into yet! Can I start the application for a brand name right way to gain time. E.i, brand name "kuchux" by the time I have gone through the process of learning FBA and have the product manufactured (6 months) would I be able to register the brand name in Amazon? Thanks for your input!!

Hey Ed, thank you! In order to get brand registered you need to first trademark that brand name (wordmark). Then you will need to provide this TM number as well as images of the product and packaging with the brand present on both or at least one. You provide this to Amazon when applying to become brand registered, so these are needed first. Without them, you cannot fast track. US TMs = 8/9months. UK TMs = 4/5 months

Hey Michael, good question! I know companies have trademarked names like this, for example, Amazon.com. So, it is doable, I would do your trademark checks still on USPTO.gov. Overall, I would suggest rather just trademarking PINATAS as it keeps it simple but I am no trademark lawyer. What I would say, is do not trademark Pinatas.com because Pinatas alone is taken, this will still be a problem with the TM office as it will still be seen as confusingly similar. If both are available and don't conflict with other 'already-registered' marks, then you could choose either. I would go with the name alone, personally.
