I listed punitive damages in my small claims case for $7k - I filed 2 other claims after being wrongfully fired. The contractor I worked for had instructed employees to do something that damaged product for the contracting company, a corner cutting measure that employees were told they could do as long as the "supervisor" from the company wasn't around. He was rarely around, so this happened all the time. Well, the judge threw out the claim for punitive damages, kept my other 2 claims, but threw out the P.D. because she said there was no personal damage to me. Actually there was personal damage to me because I was dismissed on the basis that I wasn't up to snuff on production and cutting that particular corner would have led to an increase in production for myself. But I didn't think of it at the time. I'm surprised you didn't mention that part.

Hello I am trying to get a retaliation lawyer and I got a potential lawyer right now but when I told them I want to be included and present during mediation they told me I don’t need to attend and that they can attend for me. Can lawyer refuse for me to attend a mediation and have them attend instead? I’m thinking this is a red flag 😓 It’s so hard to find a good lawyer now a day, do you know any good lawyer in Texas? And can we ask for the amount we want to get during mediation?

Ok so I have a question… if I have to claims that must be filed separately if I settle one before the other can it be harmful back story I was wrongfully terminated because of reports I made under STAA whistleblower so I filed with osha(federal) but also because I hired a workers comp lawyer (state) I can prove both claims but they will have to separate the workers comp will probably settle faster but I’m concerned about if I accept damages will it impact my whistleblower case

Why do I get that there is conflict between limitation 1 and limitation 3 based on explanation.... If multi-billion dollar company was sued for punitive dmg and plaintiff won... Limitation 1 would make the company pay billions of dollar to plaintiff But Limitation 3 would just make the company pay 9 million dollar to plaintiff?

@@braniganrobertsonlaw is this a case to case basis or the court applies these limitations based on precedence? To multi-billion dollar companies a 9 million dollar is a small fine Fine at these scale to such companies will just be treated as fee for doing something wrong "Oh sorry judge, did I make a mistake? I will write the plaintiff along with lawyers involved a check for each... So I can go on and do the same thing again"
