Excellent video Mark. Those are all really great points. We have to remember that metal detecting their land isn't a right, it's a permission subject to the vibe they get from us. Here's number 11, that should be an obvious one.... FILL YOUR HOLES! Nobody wants their animals (or themselves) to twist or break a leg from stepping in a hole you left behind. I see way too many people leave craters and that ruins it for the rest of us.

In California, if the landowner isn't charging for access, they cannot be held liable. However, even showing them the law doesn't convince them so I also carry a release of liability forms and have an umbrella policy and additional insurance on top of my medical which covers everything from personal liability from defamation to getting injured in the field. Great video

I was not aware of this! One of my biggest permissions is owned by a family of lawyers I will have to ask them about this. But I agree that even if you show a landowner this, they will just assume that they could still be liable, so many war stories that they have all heard from other landowners. Hello Mark. Great video! You are spot on with the concerns that land owners have. There are varied reasons for their concerns but what I have found is ranchers are worried about theft which is understandable. Common sense really comes into play here with the permissions. I’ve always thought of it like this, if I were the land owner, how would you want to be approached and what concerns I would have. I live just south of you here in Valley Springs and have enjoyed all your videos and still, on occasion, watch California Relic Adventures. Thank you

Great information! I find that the largest obstacle to overcome is the property owners concern regarding liability of the person(s) detecting on their property. In today's highly litigious society, many are concerned about potential personal liability/ injury claims that could happen while on their property. Also its tough in these days to get a homeowner to sign anything without first wanting to have a legal interpretation/opinion. Just my experience. Cheers! Reply

Could you expand on the insurance policy? Just general liability? How much coverage, etc.? I asked my insurance agent about the scenario and he said there really isn’t anything they can offer since there isn’t a business exposure for the landowner.

Yes, so I called a few of the companies I found online in a search. The one I used had a Liability Insurance policy designed for hunters that gave me all the coverage I needed, even though I was not hunting. It just provides liability insurance to the landowner if you should get hurt on their property. Maybe you start by searching specifically for a hunting policy? 🤔 My policy is a $1,000,000 dollar policy with a an additional $1,000,000 umbrella. I actually do not know much about insurance policies but you should be able to get started in the right direction with just this information. I also remember asking about the coverage limits and the policies that they offered all had the same coverage so I really didn't have options. Just make sure that you're totally honest with the insurance agent and tell them exactly what you're doing. I hope this helps!! Thank you for your view and comment/question!

Great video! Appreciate your insight! Do you normally get property owner information from OnX or do you use assessor website for the county you are looking at? When approaching private property, how do you reach the main house if they have long driveway/road with no trespassing signs posted?

These are great questions! I do use apps like OnX and Gaia and prior to that I was able to buy a CD-ROM from my county records office that had contact info for all current property owners. As far as the typical ranch or property with the driveway or gate. It is very difficult to find a way to make contact with these property owners and often the only way is a letter mailed to their physical address. Some have tried ambushing them at the gate when they take the trash out or pick up the cans and that almost always upsets them to be caught off guard and feeling like it's a stalker. I have a few properties I drive by often and there is nothing I can do but just wish I could talk to them. Now on the old CD-ROM there was names and phone numbers listed so a call could be made. Just so hard to call a stranger and ask such a question. Thank you for the view, comment and great questions!

Thank you Mark, I'm a treasure hunter in Texas, and I have to write letters to the landowners, and I might get 1 permission for every 20 letters I send out. I tell them I indemnify them from any liability to my safety, and offer a 90/10 split. Do you have any other suggestions to get more permissions???

Thank you for dropping by from the great state of Texas. On your split, is this a 90/10 split of relics and coins? Not sure how that would work without first right of refusal in play and who would decide the 10%? What if you only found one old coin? With a 90/10 split on the table I wonder if it would be less troublesome to even offer or mention a split at all? 10% might offend them. Or is it the other way around? Land owner keeps 90% you keep 10%? As far as other ideas, do you have any skills or services you could use to barter? On one of our permissions we help them herd and run the cattle on branding day. On another I fix fences. On another I used my drone to do lots of free video and photography work and on another great property/permission I made them a really nice website. So these are the fair strategies that I use and if there is a split agreement I always do 50/50 for gold and for coins and relics, land owner gets choice of anything I find. Scary to think about but it has worked great for me. After all these years, I have literally only had to give an item to a land owner 3 times! Thank you for your view and comment/question!

yes permission is the key.I bought a whites 24k and minelab 5000 plus a minelab monster 1000 from our friend and tv star Albert PLACERVILLE hardware the oldest mercantile in the west,, Albert gave me your card so i will call you.I am a local in hangtown and have a 35 acre placer mine that has never been searched with metal detector. it was a hydraulic mine in the 1850s

3 times that I can remember and all three we're with the same landowner and we're pretty epic finds when was a powder flask complete with a hunter seen holding some pheasants and rabbits with his long rifle at his side. And another was a early 1840 Sportsman style button with a deer stag on it and the third and final item was a type 1 1917 standing liberty quarter.
