This wouldn't change anything. We live under a dictatorship of the judiciary. They literally banned X in Brazil precisely because X refused to censor the population at the request of the Supreme Court without presenting legal reasons for doing so. They also asked for censorship to be carried out with the explanation that the user disrespected the company's guidelines. Punishing the population or removing services from the country will only open space for Chinese companies to take their place, further increasing communist influence in the country. We can't even accuse or speak out against the Supreme Court judges, with the risk of imprisonment and absurdly high fines.

And people talking about "he should give back the money" they don't get it that its not that simple and that most likely is not gonna happen at all, but more and more of these attacks... The ones who could take him out of there are by our constitution under the power of being judge by Moraes himself and his friends, and this promiscous relation institutionalized by our own constitution makes everything very secure... After all if they happen to take moraes out, there's still Lula's lawyer, Dino a self proclaimed communist and 6 or 7 more friends to keep the airplane flying to their destiny: power. When dealing with assets that are located abroad, the United States can initiate a forfeiture action in this country against the foreign asset. Property belonging to Brazil found in the United States can be seized by a federal court as compensation for seized property abroad. This type of legal maneuver takes upwards of 5 years to litigate and the cost in lawyer fees might not equal the value of the confiscated property. On principle, Elon Musk might pursue this injustice. There also might be RICO charges against this judge personally, in which if he steps out of Brazil, he could be arrested. This also means countries with extradition treaties with the U.S.

Also, the Office of Foreign Assets Control (OFAC) can confiscate property in the United States from foreign entities based on the Justice Department’s jurisdiction and recommendations. Also, U.S. Code § 2467 - Enforcement of foreign judgment (according to Cornell Law School) would be unconditionally denied to Brazil’s legal system preventing further seizure of assets (SpaceX, StarLink, or any other company owned by Elon Musk.) The Brazilian judge might have seized assets owned partly or whole by Elon Musk without legal standing. This ruling by the Brazilian Supreme Court judge is now elevated to an international level. They might rethink taking property for a few million if it’s going to cost the Brazilian Government billions. We will see what happens over the next few weeks. If our State Department exhibits a hands off approach, this case will be on the front burner of the next administration.
@lulu09165Ай бұрын
As a brazilian citizen and student of law, i'd like to explain why exactly the minister (our supreme court judges are called ministers here) is completely unchallenged in his authority. I'm sorry for the wall of text. The supreme court is the highest authority of the judicial power here in Brazil, but sadly, with the way our laws are constructed, this opens an extreme vulnerability when it comes to corruption: as the highest authority, ministers of the supreme court can only be judged by THEIR FELLOW MINISTERS of the same court. This makes it extremely easy for a party that has been in power for long to essentially transform the supreme court into an extension of itself. Moraes was names minister by president Michel Temer, who became president after Dilma Roussef was impeached during the infamous car wash operation, and before her was Lula, our current president who was arrested for being involved in the same. The worker's party (PT), the most prominent left-wingparty in Brazil, was in power for nearly 20 years, and in that time filled almost the entire supreme court with their men. Even now Lula is doing everything he can to take over the supreme court, naming a man named Flavio Dino, one of the most corrupt (and obese) politicians Brazil has ever seen, as well as his OWN GODDAMN ATTORNEY (Cristiano Zanin) who defended him in the car wash operation. The escalation of tyranny we see today was due to a "disaster" that happened in 2018: instead of reelecting Lula and making Brazil a true one-party state, he was arrested, which made him unelectable and opened the way for Bolsonaro to win, which ruined the plans for PT. Moraes, a newly joined judge, did everything in his power to get in the way of anything and everything Bolsonaro tried to do, even becoming head of the election council near the election periods of 2022, removing Lula from prison and scrubbing his criminal history clean to make him viable to run. At the election day, Lula won with what was the most suspiciously fraudulent election of our history, with Lula winning with large amounts of votes from the northeastern region at the very end of counting, earning him the win by margins exactly the same as Venezuela's Maduro. What followed was an even more suspicious "invasion" of congress, with many PT members as well as current senators present inside even before the acts. This resulted in Bolsonaro being blamed for it and being declared unelectable by none other than the supreme court (headed by Moraes). This was done to ensure PT's rule was uncontested, as well as to detect and punish dissidents. The reason Moraes is such a tyrant is not only does he have almost absolute legal immunity, but also the support of the entire presidential cabinet and the head of our congress (Rodrigo Pacheco) working overtime to ensure that he is unchallenged by anyone. I apologize again for the text wall.

Your mention of how this might be something that is hinting here is the usa. My granddad, 40 years ago said to watch, someday there would be another civil war right here at home. With all this stuff going on I'm not so sure that he might be right.... As far nas a blackout, it would be hard on the people and I think Elon is nice and may not, but I sure would. Thx for sharing good work!

I think he should keep service in Brazil and just block the government customers on X. Or maybe just the Supreme Court's. As I understand it, there are a lot of people and locations that have no other option than Starlink. So for Starlink service I say no, except as mentioned above. I absolutely agree with him not appointing hostages.
@drfirechief8958Ай бұрын
I don't think he'll blackout the whole of Brazil. One of his goals is to inform people with the truth. If he cuts off the people of Brazil then the Judge will win, at least temporarily. Elon Musk is one of the smartest men in the world. He plays 3 dimensional chess. I'm sure he'll figure something out.🤨 Thanks again for the update J.

Another info: The supreme court is limited by law to do investigations/prosecution only inside the building, but they "reinterpreted" the law. Our law says it's power is limited to the dependencies, but they interpreted dependencies as being the entire country lol. If you want to invest here FORGET IT, the millitary, supreme court, senate, 90% of our press all agree with this bullshit. By the way, our press is not free at all, they are funded by Lula's government and support it. We don't have jornalists, just propagandists.

Something no one thinks about. Having Starlink. You have cellphone service off of wifi. What's the major difference between a cellphone tower and Starlink? You get zero radiation poisoning off of Starlink. You get 100% radiation poisoning off of cell towers. Thanks Musk.

pull X and starlink out of Brazil until funds are refunded, this is way to messed up. Elon actually explained that he would be willing to listen to the judge but the reason why he didn't comply was that it the censorship they were asking him to do would be illegal according to Brazilian law and he did not want to be a part of that corruption and breaking the law
@livrepensador4075Ай бұрын
Foreign companies are abandoning Brazil due "legal uncertainty". Unfortunately Starlink is the next in the line. There is no way that companies can sail in Brazilian business waters will so many pirates, buccaneers and corsairs. It is not a surprise that Brazil is ranked 124 among 190 economies in the ease of doing business from World Bank rating. It is likely that wide spread corruption in the government and wrong doings from Brazilian Supreme Court (STF) will force and embargo on the country.
@steveholmes1736Ай бұрын
Well, I don’t believe Starlink or X do business in North Korea, so I would like it if these two companies did no business in Brazil either. Furthermore, the US government should impose severe sanctions on Brazil. The sanction should be so severe it would make the Russian sanctions look like child’s play.

Outside of diplomatic channels, before the last two generations it was illegal for Americans to have any dealings with foreign governments and American businesses could establish businesses in other countries, Import/export had to be established through and under the state department. This was also true of congressmen. Americans did not have to compete with slave labor.
