@spacecase8791 The lady buys the cabinet, takes off work, and no one shows up or calls her. The cabinet is then delivered several weeks late and then they break the glass. The onus is on the store to make things right. The one 3 minutes phone log might have been to an answering machine that was full. The defendant was acting like he was doing the lady a favor for fixing the broking glass...which is why the judge scolded him.

@@Spankmepink I once sat on a jury where 5 Latino guys stopped on the side of the freeway at 1am so that one could take a piss. A police officer pulled over to see what was going on. All 5 were out the car when he pulled up. He noticed one guy was tipsy and decided to charge him with a DUI even though they were all out of the car by the time he arrived. The officer told one bad lie after another to support the arrest. Within 5 minutes of jury deliberation eleven (11) jurors voted not to convict. The one holdout was a lady who had just moved from Mississippi. We decided to go around the table and let everyone explain their vote. The first eleven jurors demolished the officer's testimony, as he was a horrible liar and some of what he was claiming was literally impossible. When we got to the one holdout, she had no explanation other than "I don't believe police officers lie". An argument broke out between her and several jurors. In the heat of the moment, the holdout lashed out and said "I don't want the handsome young (white) prosecutor to lose his first case over some drunk Mexicans" I tell you this story because sometimes race and skin color matter when people are assessing a case. In doing so they are willing to ignore the obvious facts.

No, it actually isn’t. You’re running a business, you may have to reach out to a customer that you’ve wronged more than once, the “wrong” here being having damaged her purchase. Just as JM said, a lot of older people, and even some younger people, don’t scroll through caller ID looking for missed calls, and some people (both young and old), don’t check voicemails, as evidenced by the messages saying that the voicemail box is full. Hell, half the time, all the person calling wants is to tell you about an extended warranty for your vehicle anyway. 😂 I absolutely believe her when she says that she continuously tried to reach out to them, to no avail.

In Greece it is considered highly irregular practice to leave a voice message after calling with no answer. Leaving a voice message, as it were, is not universal. The call logs should have been enough to judge in favour of the defendant.

It's a generational thing. I'm 51 and I see that a friend called so I call back. Mom leaves a message, just the same way she "signs" her FB messages. People the defendant's age don't even talk on the phone, let alone check their VM.

The judge was very rude to the defendant. He brought phone records as evidence that he called her to resolve the issue. The plaintiff should’ve walked away with only the glass; no money. People shouldn’t have to call you multiple times. 1 message is enough and the judge should’ve addressed that.

I usually ageee with her but on this one she dropped the ball. She says he needs to get with the times and understand that not everyone checks messages. She needs to get with the times as well. He bought that lady a new piece of glass, no questions asked, and took responsibility for breaking the glass and took proper measures to ensure he made her cabinet whole again. He did nothing wrong and for her to talk to him like she did was pretty uncalled for. Not everyone leaves messages all the time. People need to answer the phone.

One VM …maybe 2 VMs should have been enough for the plaintiff to call back and set up a time. After the judge confirmed the phone number …she than said I don’t know who he is calling meaning she was purposefully not answering the calls. Oh where are her phone logs…I’m sure there wouldn’t be any outgoing calls to the business.

If the defendant had just sent someone there with the glass and no one was home, it would have been a waste of time. As much as I am happy she got money to put the glass in.she didn't call him back. That makes me wonder about her motive I would have liked Judge to ask for a follow-up to see if the plantif actually had the glass installed. Movers and delivery people break a lot.

Judge got it wrong. Lady is being difficult. Most shops will gladly replace a piece of glass- it's routine. This nonsense is far more hassle then the former. He had call logs. He should have simply said, YES- I left message most of the time. He is not a good communicator. Clearly he did call her and left a 3 minute message. Judge should have given her the glass and the option of having them install it or do it yourself. He should not have to pay.

Judge M is so irate over him calling every week but not leaving a message is really frightening. Not everyone leaves messages. And if you're repeatedly getting a call from the same number every week, then maybe you should call it back. Plaintiff got her glass, she shouldn't have even received an extra $150 for installation. Plaintiff is entitled. Judge ruled wrong here. Bias for the plaintiff and hostile towards the young man. I think Judge Milian should be reevaluated for her ethics. 🤷♀️

I had ordered some thing on the telephone and the company kept saying we called you 20 times and finally he drove over to my house and he said why don’t you answer your phone and call me back and I said well what number are you calling because I would’ve had it on my voicemail if he had called. It turned out that they were calling the wrong number so yes they did call 20 times, but they called the wrong number so I was not ever notified and because I was not notified and I didn’t call back. They took me off their contact list and I had to reschedule for the product Which is finally coming next week. It’s a good thing that I am a patient person because I was really upset like what do you mean you took me off your contact list anyway it’s all gonna turn out OK but it’s only because of the perseverance on my side and the perseverance on their side that is coming together. So I understand the frustration. This lady has been experiencing since October.

He's taking over his father's business so he doesn't understand the importance of building and maintaining a "good" reputation and providing excellent customer service. He is not obligated to leave his business for days on end to camp out on her doorstep until she could find the time to let him in to fix the stupid cabinet!!! It just does not work that way and Loud Mouth Marilyn knows that very well too. If she was as smart and well versed in the legal world she would also know that it does not matter whether she likes the Defendant or not is irrelevant, the ruling has to be fair. The woman with the cabinet was simply pulling a scam. That was abundantly clear. She paid for the cabinet with a credit card because she clearly said she didn’t have the cash and now she did not want to pay for it which is why she wanted that huge wad of cash for loss of wages and other silly little pennies. Judge LMM is ABSOLUTELY wrong on this ruling, like she often is, but this one she is absolutely, unquestionably DEAD WRONG!!!! She should admit it and I call on her to apologize to the Defendant!!!

Thank you!! I feel like I’m the only one who is thinking like this. JM solely charged the defendant with an installation service, which is probably what he would’ve paid some techs to fix it. He’s not losing out on much, but this all could have been remedied had he been more proactive and professional.

I don't agree with this ruling. Maybe there's was more that the judge read in court papers, but it's not like the defendant ignored the plaintiff. I agree with Milian that everything isn't urgent regarding call backs, but in this case the plaintiff should have called if she allegedly she didn't hear from him.

I can see a lot of young people in the comments. Older people still use phones with cords and many of them rely on voicemails for missed calls. Simple solution is to send a certified letter. I understand y'all not professional or business people so y'all don't understand whose responsibility it is after a business break sometime and admit fault

I’d have an attitude too, if I had evidence to the contrary and someone is calling me a liar. Then the judges is yelling at me bc I left a voicemail every other call. He called her more than he needed to. He’s running a business. He doesn’t have the time to sit and call her all day everyday until she answers. The plaintiff seems difficult to work with. She should have only gotten her glass. If she didn’t want to finish the work with them that her prerogative, but it shouldn’t have cost this young man.

I love the lecture she gave him about leaving a message. In addition, we can't assume that everyone has caller ID or that everyone has digital voicemail. I work in recruiting, and while back ago I called a candidate regarding one of their assessments and was leaving a message and they picked up in the middle of the message And it turned out they had one of the old-fashioned answering machines from the 90s where you could answer the phone while someone was leaving a message. The person waited for it to go to the answering machine to find out who it was and I remember doing that back in the day. When I was a teenager, I didn't answer the phone unless I either knew it was a friend of mine calling or I heard who it was on the answering machine and it was for me, because often it would be someone for my parents and if they weren't home I just left a message on the answering machine for them to respond to when they could. as crazy as it sounds in this day and age, some people still do that.

This judge has told us all that she is a person who has lost her mind. She is totally dismissing her own rules that she regularly HOLLERS across the room. She is WRONG and even the interviewer in the hall knew she’s wrong!!! This is the last straw for me. I am no longer watching this fake show with a fake “judge”. She is so full of it.
