Here's some common sense: 1) People who are willing to jump through all the hoops necessary to obtain a Maryland Wear and Carry Permit... which includes 16 hours of training in the law and the responsibilities of an armed citizen, a thorough background check, fingerprinting, shooting a qualification to demonstrate the safe and proficient use of a firearm, waiting a minimum of 10 weeks, and paying out over $500 for training, fingerprints, permit fees, etc... are NOT the people you need to worry about. These are not the folks who commit violent crimes. 2) You don't need a permit to carry a firearm on your property or someone else's property with their permission. You never did. It was already illegal to carry in a government building (courthouse, school). 3) A criminal is someone who lives in disregard of the law, which means a criminal will disregard the new law in the same way they disregard the existing laws. SB-1 will only impact law-abiding citizens... or create prosecutions against people who have broken the law unintentionally, without any nefarious intent. 4) My Wear and Carry permit states, "Restrictions: None". You cannot make someone pay for a permit to do something, then make it a crime to do that something. 5) "Wear and Carry" has now become concealed carry only... and it's now a crime if people can see the imprint of a gun in your clothes. Really? When issued, the permit was for open OR concealed carry. 6) This will be in court for 3-5 years before it is finally decided.

Considering the anti-gun sentiment of the MD courts, this is a huge win. From an Obama-appointed Judge no less. It isn't a perfect injunction, but better than I had hoped for.

My email to Waldstreicher after the preliminary injunction was ordered: Sen Waldstreicher, I was very gratified to see Judge Russell order a preliminary injunction of major portions of SB1 yesterday, protecting the rights of Marylanders to defend themselves from violent criminals. As you contemplate new laws for public safety for the 2024 session, please focus on putting violent criminals in prison and keeping them off of our streets. Legal, trained firearm owners are not the problem. Please refrain from any further unconstitutional attempts to infringe on our God-given civil rights. You have mentioned liability laws for firearms manufacturers. Laws for defective products already exist. If a firearm is defective and causes harm as a result of that defect, the company can already be held liable. I believe what you are proposing is holding firearms manufacturers liable for the actions of criminals who misuse firearms against existing laws. This simply doesn't make sense. Would we sue Honda because someone gets drunk and then kills someone by driving their Accord while intoxicated? The individual broke the law. Hold them accountable. Laws against violent crimes committed with firearms already exist. Perhaps you could increase the penalties for those crimes to keep violent criminals off our streets. That would truly reduce the level of violent crime and make Maryland a better place to live. Sincerely, XXXXXXXXX
