Once McConnell pulled his stunt with Garland, there was no window for RBG to retire. Given McConnell did this when Obama had almost a full year left, it's reasonable to assume he would have done so even earlier. Especially when the prize was a Liberal seat rather than replacing a conservative. Realistically, RBG would have had to retire before the 2014 midterms. That's a full 6 years before she died. Obviously hindsight is 20/20. If anyone had known what would happen with the 2014 midterms and 2016 election, there would have been so much more pressure. But the Justices are stubborn. Even after RBJ passed, Justice Bryer was reluctant to resign when Biden took office.

You are forgetting McConnell is not in charge of the senate. Right now that is Schumer. Also republicans abolished the filibuster for SC judges. The entire surpreme court process needs a complete overhaul. No single party should be in control of the supreme court, ever and certainly the sitting president should not be the one that decides who to appoint. Just like congress it should be decided by the votes by US citizens.

I also love the idea of having like 27 of them, and 9 randomly selected to hear any given case so that there’s no guarantee, or likelihood, of political bias either way. That would also make it harder for people to bribe them since they’d have to subvert 20 or so instead of just 5

I wouldn't want Sotomayor to retire, for mainly two reasons: 1) just because she is 70, there is no guarantee that she wouldn't outlive someone who is 40, who might get terminal cancer or have a stroke; and 2) she has over 30 years of experience being a judge, which shouldn't be undervalued. I know many people don't put as much weight to experience as I do, but I do think one big problem we have in general in European and American culture is that we tend to overstate the drawbacks of being old, and overstate the benefits of being young. Older people aren't necessarily more prone to sickness and death, or perform worse at ther job, or are less educated than young people. Older, more experienced people, tend to not have to spend time and energy figuring things out, because they have faced a lot of similar situations before. I'm not saying there shouldn't be term limits on Supreme Court justices, I'm just saying that there shouldn't be age limits. I can definitely see the case for having a quicker rotation of people on the Supreme Court, but that should be applied equally regardless of age. So for example, even a 30 year old justice maybe should only be able to have ten years on the bench, just the same as a 70 year old should.

It's not about her age being more of an issue. It's simply that those two self-serving liars have obviously have no interest and stepping down for the greater good, because they like the court be packed with corrupt extremists such as themselves. She on the other hand might do it. And if she has to do it later for say health reasons within the next 4 years, than Trump gets to stack the court even more by replacing one more real judge with yet another right wing hack. If one of the existing right wing hacks steps down, at least replacing them with another one doesn't change the needle. That's really all the discussion is about. Nothing personal against her. Quite the opposite really, the appeal goes to her because she's one of the few sane persons among her peers.

@@brokenhalo22 the issue is, with only 48+1 votes you could reasonably count on in the Senate, even if she were to retire, it's not just possible, but likely that you'd run out of time, and end up with an extra Trump nomination regardless. If she stays on for 4 more years, when hopefully a new Democrat President is inaugurated, we have a better chance IMO.

I still remember my sinking feeling of dread at the news of Ginsberg’s death. And I live in Australia. We have a similarly well-intentioned and politically clueless Labor Party in government here who are looking at being swept away next year despite all their constructive achievements and the conservative opposition’s populist lies and incompetence. But at least our High Court is apolitical and they have a compulsory retirement age of 70.

Sotomayor should NOT retire yet. The biggest reason being that it's clear to me that she has been working on slowly converting Amy Coney Barrett. They've been doing speaking engagements together. It's clear that Coney Barrett admires Sotomayor. And I think you can see the impact she's already had on Coney Barrett in certain recent decisions. I think Sotomayor can do more for our cause by having an impact on ACB and maybe, just maybe, influencing her enough to make rulings that we can all agree with.

If I were Joe Biden I'd put Kamala Harris on the Supreme Court she's worked her way up through every branch! The Supreme Court would be perfect for her!

Set term limits for SCOTUS & make them open up for election by the people. No more of the Executive & Senate appointments. We the people should get the chance to vote for SCOTUS also.
