I’m fighting social landlord kept us in a slum for 5 years we lived with rats, they moved us to temporary housing changed locks and kept raising rents to only find out we’ve been charged bedroom tax on a reception room not a bedroom lol now their trying to evict me on 27th on their adversary bs now tgeir preventing housing claim due to this they’ve even lied to court saying I don’t get benefits when I do and they know it, I’m also training to be foster carer so their acting in such a criminal and Housing Onbudsman can’t do anything with them lol 😂 they’ve zero complaints tgeir criminals to the core

Well, I'm a renter. After being told by my landlord (verbally) that I could indeed stay here and retire, I spent over £20,000 doing the house and garden up. I assumed that it was an investment. Landlord rep visited regularly and was very happy with everything I'd done. Three years in and I've been told that they want the house back, whilst congratulating me on being an exemplary tenant. So, the new rights will protect me from landlords who take advantage of renters like me. I wasn't going to mention this because I was too embarrassed to do so but, what the hell! This is the second time that this has happened to me - makes me feel like a fool.

It's ironic because I've never missed a month's rent (which is the same amount you would spend on a mortgage), have disposable money to spend on the house to make it a home but I can't get a mortgage because of my age. There are lots of renters like me. We are decent people who treat the rented home as if it were our own (looking after it) but we have absolutely no safety and have sleepless nights because of the Section 21 rule. I've been served twice. In both cases, I was promised that it would make a great retirement home only for the landlord to change their mind a couple of years in. So, once again, I have to uproot myself and start again. People who have never had to live under the shadow of Section 21, have no idea of the impact it has on our health and well-being.

I dont think any protections would help with what you spend on the property. That is a risk you would always take so be cautious on your next place. But you are right the other parts will protect you more.

@@propertyaccelerator Yes, I realise that now. I just wanted somewhere to put roots down. Basically, I'm left with little choice - live in a house as if it was a hotel (not decorate or improve) or risk spending on it to make it nice. Hopefully, the new rules will protect me now.

That would be quite an achievement, freeing up housing stock for social housing and reducing home prices for first time buyers. Middle men, scalpers and touts buying up stock of graphics cards, concert tickets and housing pushes up the prices for honest buyers. Rents being higher than mortgages is proof of a market that is not functioning. Nobody but landlords will mourn their loss.

It will just flood the market and even if prices come down you will still have to be able to get a mortgage which is not the easiest. All it will do is corporations will buy up stock and that is not a good thing as it won’t be social. The demonisation of landlords will come back and bite people. And no I’m not a landlord

The government don't want a middle man between the person renting the property. In the future, the state and private trusts will be the biggest landlords in the UK. Housing Associations already make up a considerable proportion of ownership in Britain. This is about gaining more control over renters without having private, independent landlords. There's a significant shift happening, and state is making certain they have all the say over those individuals who are renting properties. I suspect that in the next 20 yrs in the UK, the UK state and housing association trusts will be the dominant landlords across the country. This is all about economic control.

After the end of WW2, the property rental sector became largely dominated by local authority housing in order to replace homes for so many destroyed by bombing and at the same time promote slum clearance. `Corporation' housing took up many of the brownfield and inner-city locations. There is no reason to suppose this was done for "economic control", but just to house people - especially those who may not qualify for a mortgage. It was an ill-wind that blew when Margaret Thatcher sold much of the stock off for a fraction of its value in the hope that traditional Labour renters would be bribed into voting Tory. All that ultimately happened was a collapse in affordable rental housing availability. Compound that with soaring immigration in the decades to follow and another ideologically-driven diktat to prioritise remaining affordable rental stock for immigrants and we've turned full-circle to pre-war conditions. So long as people are comfortably and safely housed in a way that is not subsidised by public/private-sector taxation, what does it matter if there's a "middle man"...?

@tedthesailor172 You are looking at two very different periods of time. I'm well aware of what the Labour government did, then the Tories. Today, a different model and objective is being developed that won't ultimately benefit the renter, but ultimately will benefit the state and the third sector Housing Associations where owning a property is impossible. The future for Britain will be more and more people priced out of the housing market and shoved into properties that they no longer own. The Housing Associations will become more like feudalistic barons who will have the ability to put up rents significantly on a house or flat you don't own. Home ownership is becoming more and more difficult for younger generations, and mortgage rates are going up. It's apparent that third sector organisations with the state are muscling in and deliberately destroying the landlord lord sector so they can control the leavers of social housing. To reset a sector and destroy it deliberately indicates the agenda being developed. Economic control over housing through two avenues like the state and third sector Housing Associations demonstrates where Britain is heading. You will own nothing and enjoy it. 😉

@@dr.impossibleofcounterpunc1984 Actually, I drew upon 3 periods - the post-war austerity period, the Thatcher period and the Blair period. You raise some interesting points, but I don't think the future of home ownership need necessarily be as dystopian as you suggest. Private house-building continues and there seems to be no shortage of buyers. Housing stock is less of an issue than land, as the latter is a finite resource. House building could be made much cheaper than traditional methods allow. For example, private studies have demonstrated that the whole structure can be pre-programmed into robotic builders literally able to `print' them from the ground up. That may sound far-fetched but the technology is already established. alternatively, they may be purchased ready-made on a modular basis, so that your house enlarges as finance and family dictate. Limits upon available land may mean future generations come to terms with smaller houses - rather like the post-war emergency "prefabs". Though I certainly agree that urban densities may require more detailed oversight...

@tobymaltby6036 If you are a perfect tenant, i would like you to be my tenant, bro. I give my properties absolutely on top candition and i am always on top of maintaining it. I pay hefty amounts to British gas for all gas, drainage, heating, etc. covers along with all repairs done within 48 hrs mostly..as usual all electric and gas certificates, etc, in order. Do i get my property back in the same or near the same condition? Never. Mind you, i have 2 tenants who are not willing to leave, not because of any other reason but because i am a very good LL they are there since 7-9 years. I don't increase rent unnecessarily and leave them alone. So, not all the tenants are bad (in my experience, mostly are). Similarly, not all the LL are bad (knowing from a big circle, most of them are good). People who are not the LLs dont know what LLs has to go through to make a few pennies after paying for the mortgage and repair and court bills, etc. LL has a very little right, and they are determined to take those away as well.

I'm a responsible landlord who's always looked after my properties and tenants and had a portfolio of 7 properties. Due to government's attitude towards landlords, I've sold them all off and just put the last one up for sale this week! If they want to screw me as a landlord, I won't bother and add to the housing shortage in this country. These complete fuckwits in charge haven't got a clue or the foresight to see they are creating a huge rental crisis in the years ahead!

I did the same as soon as they started talking about this, no way was I willing to take the risk of a bad tenant that I can't get out of the property for months. Even higher rents just aren't worth it now because there have been so many changes that have impacted profitability on rental properties. In the end, for me, it just stopped being worth it. It was clear that this would cause a mass exodus so getting the properties on the market early meant I sold at the top of the market rather than now where there are a glut of rentals being sold off.

@@TrevorAngel section 21 was used to avoid a mandatory court case, now all evictions will involve dragging a tenant into court for a CCJ and its associated costs. That’s why it was called a no fault eviction, it didn’t affect a tenants credit rating, but now that’s about to change.

The professional landlords understand the letting business but there are too many amateur landlords that genuinely believe it’s their right to throw a family out because it’s their property and they can do what they like whenever they want. Those landlords are in the wrong business and thankfully now will either sell or learn how to be a proper landlord the hard way.

It may well be the some private landlords abused section 21, but some don’t. Unfortunately no law is entirely equitable for either party all of the time. Landlords and renters need to negotiate where rent increases are on the cards where a landlord may be compelled to increase the rent to cover their inflationary costs, then the renter has to evaluate and negotiate whether that is manageable. However, I wish to disabuse some renters from the feeling that private landlords are a form of social housing. They are not. And any renter good or bad (and I think we can agree they are those of equal measure as with landlords), need to appreciate a landlord is in effect running a private business. A renter agrees and signs a contract with the landlord to stay at the residence for a period for a fee. Both parties are obliged by that contract. There may be a genuine change in the landlords circumstances where Section 21 is enacted and the renter knowing of section 21 accepts all these rules when they sign the tenancy agreement. Renting is not permanent residency hence the term ‘Assured Shorthold Tenancy’. I had to rent a flat I owned while I looked after my mother until her death. The first tenants were excellent. The second tenant later stopped paying rent after a few months. I persuaded (legally and considerately) that tenant it was time to go and I sold up and would bother letting a property ever again as government seem intent on taking rights away from landlords in favour of renters. In reality governments are ducking out of their promises to build affordable housing not to mention that if they continue to allow all and sundry entry to the UK, it is no surprise there will be forever shortages of housing.

The landlords right to get there property back has to be balanced with the tenants right to security. Landlords have had it to far there own way with section 21 to the detriment of the tenants security. Any fair rebalance is going to feel unfair to landlords after having section 21 previously.

I bailed on rentals in 2018 , after being told by an estate agent that my rent was going up and there was nothing I could do about it (sec21) and if I didn’t like it I could do the other thing . Bought a motorhome job done . Renting is a nightmare and unaffordable!

My personal experience! A Tennant wanted to keep a pet (stick insect), no problem with that. Then months later I get a call from the council about damp in my property so I investigate. Turns out the Tennant has been keeping 3 snakes, some rats and an iguana. He has the heat lamps on all day and no windows open anywhere. You can feel the humidity as you walk in. The council came down on my side thankfully but it could have been expensive! .

The bill is very vague on pet insurance and on the whole pet question. What if the tenant has to get pet insurance, but doesn't keep up payments. The landlord will never know. Personally I'm going to claim on every pet insurance at the end of a tenancy. Theres no way of knowing that their pet didn't pee on the carpet unless every carpet is lifted.

There is nothing in there about the TENANTS responsibilities, such as due care of the property and PAYING the rent on time. I know a number of landlords that have had enough (local councils are now wanting landlords to be licenced) and are ending tenancies and selling up - a case of unintended consequences, where are all the tenants going to go? Some may buy, the majority will not be able to do so, Labour are creating a massive problem for themselves, well done Keir Starmer - I hope when you get served notice to quit you vacate quietly!

Many years ago i remember my grandparents paid a pittance in rent as land lords were not allowed to increase the rent. Landlords were selling up fast . Eventually it all changed. Many sold to the tenant at a reduced price. Seems were heading that way again.

@@JennyGavinWear You'll do the bare minimum to renovate a property because doing any more won't benefit you one jot. It's what happened in the 60's to 70's, home standards will slowly deteriorate, year on year. You'll have no incentive to keep tenants happy other that being threatened. I've rented to (mostly) really lovely people (at all stages of life) over 30 years and, without a thought, done everything I can to keep them happy. That will all end when the threats are so high of loss it's just not worth doing at all. In the last 3 month I paid for new mattress, £200 to replace one that was only 2 years old (and perfectly clean but the tenant found "uncomfortable" - and suggested it was causing health problems..subtle manipulation?) and £800 to for a small roof leak that was supposedly guaranteed - but the roofer that did it vanished. Tenants are clueless about the real cost of living in property that they're shielded from - they will soon find out.

That's what the Labor party in New Zealand did between 2018 and 2023. They destroyed the rental market and pushed up prices. Labor party thinking is probably the intelligence of a 14 year old, they just don't understand markets and how to make things work. In the UK this will just produce less properties = higher prices.

The way to stop that is to abandon the market rate test, which is no test at all, since landlords can act as a cartel, and do. Rent controls are the only short-term solution, while the long-term solution is to increase housing stocks.

I will continue to be a landlord and will not sell any properties. I understand why a lot of landlords will quit but I think its still a good business. In fact the bad landlords will be gone which will be good for me and tenants.

Three things if I may: 1. No hardship clause by the sound of things - a massive relief. 2. Section 21 - what happens if you want to sell your property? Will this still be rolled into Section 8? 3. I think you are wrong to assume the rise in CGT will only apply from the next financial year - it will be put up immediately from the day of the October budget to avoid a massive fire sale by landlords selling up to avoid the deadline. Finally thanks again so much for this great channel and the guidance you give.

As a long term renter, I am not sure that this is necessary, the only thing that needed to change was 2 months for section 21. If that was moved to 6-9 months that was all that was needed. I have always found lanlords to be reasonable, once I realised that I should only deal with professional Landlords not single property landlords. To much regulation is not necessary.

Opposite case for me. I've found landlords with 2-5 properties are worlds apart from landlords with large portfolios and failing a human touch. To be honest, I think the tenant's handling of the home and their rapport with said landlord is what truly makes the difference.

I've been a landlord for 25 years and never had a problem until recently. In that case the tenant didn't heat the property in winter and caused mould damage which cost me £7k to put right. Arbitration sided with the tenant. I've since decided to sell up

Yes I've already had an idiot going mad over standard condensation mould that the slovernly twat refused to wipe away but also refused to open a window or turn on the heating. Had experts in who diagnosed it as condensation mould, he then got environmental health involved who also told him the same. Tenants now are a disgrace compared with ten years ago. Entitled and grubby but soon you'll just have to let anyone in to ruin your investment for as long as they want to stay.

In the early 1980's there was no new active rental market in the UK, it had been killed off in the 1960's. The tenants either had rent controlled tenancies from private landlords or secure tenancies from Councils and housing Associations or shared accommodation with landlords. We are headed back that way again. So those who aren't lucky enough to have a tenancy - where is everyone going to live ?

The bigger landlords won’t have an issue with this new bill. The smaller landlords like myself will be massively affected so selling up is an option. To me this bill is the first step to push the smaller ones out of the PRS.

Upwards 'Bidding war' ban? No problem. Advertise the property for 25% or 50% more than you ever expect to get, and ask for closed bid's. Closest to the asking price wins; they'll be bidding DOWN, not up. Pet insurance? who pays first for damage in excess of the deposit? When will pet insurance pay, to whom and how much? "Decent Homes Standard"? OK..so tenants must insure the Landlord again litigation as a condition of the lease? Probably. All this will hammer tenants and PRS supply.

Secondly, so many privileges then why not increase the deposit needed to 8 weeks for the rental. Sometimes the damage is so much 5 weeks of rent does not cover it. Or say they have arrears

Sell your rentals and invest overseas. Enelgand is not good for investments. In County Durham, because of the two-tier system, the council has a private landlord licensing system. This council has split the communities into zones. Those who have licensing and those who do not. In their newspaper, they bragged that they did 40% of landlords licensed. However, they did not tell people that all areas within the county are split into zones. The county council made 52 million this year by forcing licensing on landlords who are within their zones. This is a Labour Council been in office for 108 years.

You can only increase the rent once a year provided that the tenancy was for 12 months initially at the start! If landlords are increasing rents continuously during a year it’s illegal & I recommend tenants report the landlord/agent for this! By the way I’m a landlord & deal with many many tenants!

Well, it's not illegal if the tenant agrees but realistically it all should be done on a sec 13 which can only be increase once a year. Of which the tenant can challenge it a tribunal. So really nothing has changed here

It's going to be painful for a couple years but it's a great way to start a transition to a more balance and realistic market. It will pull the dirt from under the carpet and greedy scammers will be forced out of the housing market. This will also make the housing offer problem incredibly painful and obvious forcing the need and interest in building better houses.

I'm in a situation as a renter in a very sought after (now) area. I've lived in this flat for 3.5 years and I'm paying below market price. Now I should also mention that my landlord keeps ignoring my (very reasonable) repair requests. And if he does a repair it's a 'band air over broken bone' kind of botch job. He came today because I told him my bathroom window is going to fly out of its frame in the next storm. His 'repair' made the job worse and now I can't close it. When I told hm that I really think it needs a new window he said that he thought I wanted to move out. When I told him I can't afford it, he basically just said he's going to increase the rent. Thing is had I not 'criticised' his awful repair job today, he'd never said anything like this. How can a tenant be protected by this? I've never met a good landlord in the UK. All have been negligent and greedy, down to abuse, calling me names, etc. I hate this place. He's never helped me with the noisy neighbours, nor done any repairs, including a leak that drips heavily into a socket. I pay my rent every month on time, I don't party, I'm quiet, don't have visitors often, and no telly. I'm a good tenant but keep getting those landlords who are all nice when keeping the head down, but if you dare to ask for something you're treated like a rat. He literally was annoyed at me today and said it was a waste of time to come. Seriously? I fixed the mouldy (someone had painted over old mold, which I assume was him) silicone on the bath tub. I got so bad, I just couldn't take it anymore, so fixed it myself. I'm not paid for it, nor do I get the cost of the silicone back. I fixed the kitchen window where I could see daylight through the frame. Same in the front room. The list goes on. I've now drafted a firm email listing the repairs I want done with a deadline, will get environmental health involved and from now on will fight him on everything. I've had enough of bully landlords who get away with murder. Where are all those good landlords? Where?

They only ever raise the rent..she resulted doing a lot of work herself for the past 12 years. I just wish we could take landlords and agencies like that to court for free.

I run a small agency in London, and most of my landlords have decided to sell their portfolios because of these 'one sided' rules just for landlords, when it's their hare earned money, they sacrificed so much in order to buy even one investment property, this is super frustrating :( This is going to put many many people out of work too, well done, Labour!!

Sounds good. More stock, lower house prices, fewer people priced out of buying and thus not needing to rent. Continue selling if you're that afraid of your tenants. The decent landlords vet their tenants, so aren't afraid of these changes. At least, not the ones I've spoken to.

I know 3 landlords who sold all their properties because they knew what was coming would ruin them. That's twelve good homes no longer on the rental circuit. If this is replicated across the country there will be a shortage of rental properties which will drive up rental costs. This is another of those policies that will be self defeating and very destructive.

Angela Rayner will have to build 2 million homes in tis Parliament of 5 years instead of the 1.5 million that she promised. The 1.5 million won't happen. The latest government figures are that house building has slowed in the 2 months that Kabour have been in power.

I am a tenant and Landlord asking me to move by issuing 2 months notice by article 21 " No Fault eviction " It means if new law is in place they cant do it . Abolishing section 21 makes no difference to the tenant because I know from experience nearly all evictions are nonfault anyway where landlord is selling the property or claiming to want to sell it. Of course after the eviction they don't have to, it's their property

What about this, moved in on September 2020 with rent of £1675, then bumped it right up to £1950 just a year later. The property is dissolving with black mould in the bathroom and no extractor fan. It’s falling apart and the garden looks like a dumping ground with his old nackered furniture and we have no storage. The she has all his junk in it and the shed door has water damage AND broken.

The worst houses we've and my sister have lived in have been council ...damp with nothing done except adivice on leaving the windows open and heating on....in winter and a housing association delays on repairs. Freeing up stock...lol ..some councils are the worst landlord ever. You've got to protect both tenants and landlords ..

Another well-thought video James. I would perhaps put a different emphasis on some aspects, but overall I agree with nearly all your points. I have come a cropper once or twice, but that experience counts. When it comes to renters cynically renting and giving notice straight away, surely a thorough vetting process would obviate the risk. What I look for in a new tenant: employers reference giving salary, previous landlord reference. Ability to very easily cover the rent. Back story e.g. why this house or flat, what are your circumstances etc. any potential tenant showing reluctance or leaving glaring gaps, can be discarded straight away. Ask a rent at the top of the market. Any applicant squirming at the rent can also be rejected. As you say, you’re looking for good tenants who stay, and pay the rent on time without damaging the property. Due diligence by the landlord is essential. When it comes to capital gains tax, I’m not bothered, I have bought the properties as a long term investment and have no intention to sell. The thing that would worry me is if legislation were to bring in rent caps like they did in the 1960/70s, which devastated the private retail sector, reducing the value of rented properties to pennies in the pound. Mind you, even then they were a good buy for the long-term investor.

If the rental market shifts too heavily in favor of tenants, landlords may respond by selling their properties, converting them to holiday rentals if feasible, or opting to take in lodgers instead. Landlords hold capital in the form of their properties, and British rental properties are not their only investment option. They can choose to invest in properties abroad and exit the UK market altogether. In the short term, this shift could lead to a decrease in the number of available rental properties and a rise in rental prices. And potentially renters risking homelessness.

I was served a section 21 last year and then the property was turned into an Airbnb. Paid my rent every month over the 5yrs without fail. I guess some landlords opt for the money grab with less restrictions and you only have to visit the lake district to see the direct impact of Airbnb on local communities 😷😷

My sister's step son and family as renters already fell foul of this. The landlord suddenly out of the blue recently said he wants the property back, they were paying the rent on time with no issues. He's struggled to find somewhere else and they are now living with my sister. As someone that's about to buy a narrowboat to live on and cruise, then in a few years a buy a flat(so my monies in the ever increasing market) to rent out with a view to eventually moving to the flat when I get too infirm for the boat maybe 10 years down the road, this is all concerning.

Mould can be caused directly by the tenants habits such as not opening windows and using equipment that creates humidity like grow tents, aquarium etc. Also there is a massive problem with mould in some areas such as Cornwall. I live near the sea and the humidity in my home is permanently above 80%. Not my landlords problem, its mine.

In my experience, mold is usually caused by neglect from the landlord. All but one property I've lived in has had mold issues that are ignored, left to fester and get worse despite multiple reports. Most people I know have had similar issues. Lived in my current property for 3 years, great landlord, well looked after property (by me also, as I always do), and no mold to be seen in the 3 years living here.

How long until the government tell landlords you have to provide free housing. The tax situation is utter nonsense, 7000 for mold scares me. One of my properties always gets mold, always my whole life, it was my childhood home. Time and time again I had to explain to my family to open the windows but still it comes back. The neighbours have the same problem. 7,000 is more than the rent for the year there!!!

I had mould on a property for years. I insulated ALL the walls in the flat. The problem stopped immediately. The cold wall where the mould collected was not cold anymore. I don't know if that will work for you. I also double glazed the property and insulated only some of the walls but that did not fix the problem by itself.

my tenant leaves on 1st oct! listing the very same day and have estate agents already lined up. Can not wait to get my property sold. Its only going to get worse for the renters

Landlords having been taking the utter puss recently. Houses that two years ago were 1100 a month now are 1700 a month, letting agents have landlords phoning them telling them to kick out perfectly hood tenants do they can watch the rent up sn extra 500 per month. Rents are supposed to be in line with the value of the house, now they’re way above thst , fully paying renters with children are being booted out in made up reasons just so the landlord can immediately re let the house on way above its worth. This will stop the unscrupulous landlords doing this

I was a tenant for many years and I always looked after the property that I lived in as it was my home for my daughter and I. Unfortunately, after 13 years of renting from my ‘friendly’ landlord, she wanted us out because her daughter wanted to move in until she could find a house to buy. She gave us three months but back a few years ago, it was hell finding any property. So, abolishing Section 21, I can see why, but it has to be replaced with something else that is fair to tenant and landlord.

I’ve just paid five hundred pounds on a new shower fitted and the toilet fixing on my rental property that was my home for twenty years. The tenants are two weeks late with the rent and ‘landlords’ are the baddies ?? Also the property was / is in really good shape much much better than I lived there. As a rental property I realise it has to be of good standard

As a private landlord, I am letting my property at approx 300 pounds below the market value and paying huge amounts for maintenance, replacing appliances etc. etc. I would be better off - just selling it.

I’m selling up. I’m a good landlord, and have a gorgeous house I’ve been letting to a family. They have been great tenants for the last two years but have now bought their own home and left last week. I’ve done a lot to keep the property in the best possible condition, plus done lots of upgrades. However now my tenants have left I’m selling up - entirely because of all this legislation. I might just as well invest the cash - with current interest rates I’d get more than I’m currently getting from letting - so why let with all this legislation?

I've had bad tenants and a bad landlord so I know both sides. The previous no fault eviction was unfair, there has to be a reasonable reason for evictions. In any case, all landlords should get suitable insurance

6 months of being a landlord and I'm out just getting ready to serve notice for tenants within next few days and get it up for sake . Bought house a year ago well below market value and renovated it to EPC rating of c but had enough. No money to be made unless you are wealthy 😢

Some landlords are good but very hard to find. Most of the landlords misused section 21 to basically just kickout for no reason inspite of being a good tenant and paying rents on time. Basically they want to kickout tenants, do just a bit of refurb and increase rent 2 folds for new tenants. This is basically a scam. Tenants are not supposed to bear your mortgage, they are just a means to help. Landlords have been taking advantage

This is intended to help tenants, it will do the opposite, in order for it to be worth the risks of renting Landlords will increase the rents as much as will be legal other will leave and supply and demand will put up the cost of renting. Politicians are actually just thick when it comes to business and clearly lack life experience. They will not understand why this hasn't worked and things get worse for tenants.

I get the impression most of them have not got to their positions of power through operating successful businesses, but rather through meritocracy and connections. It means they have very little real world experience in maintaining anything with economic consequences. Yet, they combine that with an inability to listen to the people so we’re left at the mercy of luck.

Thank you for this... My gut feels on this as a responsible landlord (5 properties) is that we're moving to a standard where the govt or large Blackrock style organisations own the properties - not private landlords, it may also be that the govt needed a large influx of Capital Gains Tax paying to bridge financial shortfalls ? I had to sign up to a 'Good landlord' scheme or whatever its called in one area in my town - cost me £700... the other property in this town isn't in this area... so not in the scheme ? One thing that I didn't hear you cover which has caused me a huge headache... The section 24 tax scheme - so in effect i'm paying tax on income i haven't even had...?! Wtf is that all about and in the law of unintended consequences - as rents rise and inflation devalues the currency many more landlords with say one or two properties and a job are going to find themselves in the higher income bracket whereas before they would have been nowhere near it....

Hi James, I’ve had to move from a lovely flat once already through no fault of my own because the amateur landlord wanted to sell the property. This was done under Section 21. I complied within the required timescale (2 months) but it was a horrible experience. My question is: if a tenant is served with a Section 21 before the new law takes effect next summer, if they just sit tight will they be covered by the new law when it takes effect? Thank you.

My wife and I ploughed our combined pension lump sums into a two bed long leasehold apartment so no need for a mortgage. We toyed with the idea of renting but have now decided to go down the government's 'rent a room scheme'. This allows an annual income of £7,500 tax free. Initially we considered renting it out and was advised the market rent was £900 per month (£ 10,800 pa). After paying management fees of 10%, plus having to pay tax on the total rent we came to the conclusion having a lodger was a better option than renting. Now the new Renters Rights Bill is upon us and the section 21 notice is no longer available to protect landlords. I feel taking a lodger allows more flexibility with our own property and only 28 days notice is required to remove a lodger. My wife and I will take turns to sleep at the apartment overnight.

I don't think the govt could monitor how many nights you slept there. The way to prove that it is your home is that you have to officially change all your addresses on all your accounts to that address. Get your name on the electoral roll and council tax at that address. It has to be your official address

When I first started renting and saw all the rules I had to sign up to in the TA it felt a bit daunting. By the same token it must feel a bit like that when Landlords are suddenly subject to new rules or even managing existing responsibilities and 'grey areas' of law. Overall, I think that consideration has to include whether letting a property can yield a reasonable return for the Landlord, thereby making it worth their while to provide the service versus other kinds of investments, balanced with the vulnerable position tenants are placed in. This includes keeping up with rent payments, rising cost of living, threats of eviction and living in sub-standard accommodation where private renting may feel like the only option available to them.

No government has the ability to beat the market, landlords will just massively increase asking rents and wait for tenants to offer on the asking price. This has the same effect as bidding up rents. the market will set the level in the end.

All for having a fair rental bill, but this needs to be fair for both landlords and tenants. We get good and bad on both sides so it was essential the bill should have had protection for landlords from bad tenants. Recently went to see a property ruined by the tenant. It was disgusting. To put that back to good the landlord will end up in negative equity.

James, I’m very worried about the mould issue…I’ve been a landlord for over 20 years and in my experience the only time any property developed mould was as a result of the tenant not opening windows to air the property, not opening the kitchen window when boiling pans on the stove and refusing to put on any heating because they claimed they couldn’t afford to 🤷♂️

absolutely agree. It's one of my main issues too. They will shower, dry clothes, cook, heat but never aerate the rooms. Sorry, but unless there is an obvious ongoing and unresolved leak, 99% of the time it's the tenants fault.

It could be used as a tactic NOT to pay rent. I have never been a landlord but I worked in a housing unit with young people. They done this all the time kept all windows shut dried loads of clothes in a small space and then refused to pay the rent when mould developed. I also worked for a housing association (under the maintenance side) and 99% of problems were due to tenants not maintaining or cleaning their properties. It was an eye opener into the rental market. Honestly I would sell up while you have some rights left. This is going to be devastating

@@Bereadyalways123 My windows are open most of the year, especially the bathroom. I still have to clean the mold off the walls twice a year with Borax. My landlord takes MONTHS to respond to anything, never answers questions and ignores all text messages. I'll be interested to find out if this bill covers Scotland too.
