The property has assumptions made about its cash flow. Either the cash flow from the property can cover the debt payment of the loan or it can't. But he did so with campaign funds, which _is_ a crime, though a (relatively) minor one and one that is past the statue of limitations. 3. This action he tried to cover up by cooking the books for one of his businesses in New York. 4. The fraud statue he violated would even have been past the statute of limitations... unless it was violated for the purpose of covering up some other crime. 5. As such, the jury was asked, as the triers of fact in the case, to determine whether that (or some other crime - the statute only requires that the cover up was of _a_ crime) was his purpose in committing the fraud. They said yes. Do tell which of these you think were not established.

But on your item 2, the Federal Election Commission has held that payments to protect a candidate's reputation are NOT considered as political contributions. And the payment to Michael Cohen's firm was NOT made with "campaign funds." It was Trump's own money. Bragg argued that he made the payment 'to influence the election' and that it should be considered a campaign contribution for that reason, but that is simply not the law. So your item (3) is wrong. He didn't "cook the books." A clerk on his accountant's staff entered the payment as a "payment to a lawyer" because that seemed to him like the best choice. There was zero evidence in the record that Trump told him to classify it that way. In short, there was never a cover-up of an actual "crime."

There were several issues with the reimbursement of Cohen that you missed, though. Cohen was to be reimbursed $420,000 over the course of 2017 so as to include double the $130,000 compensation for the hush money payment, plus other reimbursements and a year-end bonus. This was to be in the form of 12 payments of $35,000 It was these payments that were recorded as being for "legal services" for specifically Trump over the course of 2017. _That_ was entirely false. Even if you allow for calling the reimbursement itself "legal expenses", that fig leaf falls off the moment the "legal services" in question are made to look like they took place throughout the entire following year. That's just money laundering at that point, albeit it's a strange instance of the laundering not being for the purpose of tax evasion. Money laundering is illegal regardless, though, hence the conviction. Trump provably got personally involved, too, having personally made the payments for April through December.

They had to change the law in statute of limitations to bring this case forward. So my question is what precedent was their set in the past that they had to change the law to bring a case to court. No victim, no crime. The lenders didn’t just take Trumps word that his assets were with x amount of dollars. They did their own assessments. If you go to buy a home and the asking price ISA million bucks but the lenders property assessment only comes in at say $500,000 then you can’t get the mortgage/loan. I am a paralegal and worked in real estate law. If the lender agrees to lend x amount of money and it later turns out that assessment was wrong that’s on the lender not the client.

So people understand Trump had to pay for saying his property was worth a certain amount. Not for missing payments or being delinquent on the loans. Self appraisal of assets happens every day in the US. A similar instance is when you have a classic car and the insurance asks you to appraise it in order to cover it completely. You can appraise it at $10 million if you want. You just have to pay that amount. Trumps property may have some historical value as well as the basic property worth.
