The Court threw in that bit about not using acts as president as evidence of unofficial acts just for this very reason. To muddy the waters in any of these cases, and further delay the process. Their hope seems to be that Trump becomes president, and a Republican Congress makes laws making it nearly impossible for Democrats to ever win elections again, effectively giving them power forever on the national stage. Or something close to that. It sounds far-fetched, if only they weren't giving this much power to the presidency. What do they gain if we have a king? Don't forget. Trump CAN'T appeal the verdict until he is sentenced. Also, what remains of the gag order is still in effect until he is sentenced. Once Trump is sentenced, the ball is literally out of Merchan's court. But now none of that will happen until September 18. This is one delay that may hurt Trump more than it helps him, because he is stuck with Juan Merchan until mid September.

The S. Ct. could have issued this opinion before the NY trial started. The NY prosecutors made a tactical decision to rest without calling a bunch of other witnesses because Cohen's and Pecker's testimony was so strong, but some of what they testified to occurred in the White House once Trump was elected. If the NY prosecutors had been told about this new "evidentiary" ruling, they would have used other witnesses. The S. Ct. deliberately waited for the NY trial to finish and sandbagged the prosecutors by ruling that no evidence of what happens in the White House while Trump was President. They are despicable. This is outrageous. If Biden wins and if the Democrats win Congress, I hope they impeach Thomas, Alito and even Kavanaugh (after confirmation hearing testimony from Alito and Kavanaugh that no one is above the law). Agree that judicial reform and taking whatever action can be taken against these 3 is essential.
