I'm not completely convinced that having this memo challenged in a Federal Court wasn't part of the plan. And I say this because what Trump is trying to do is usurp power that only Congress is meant to have (under the Constitution). He wants that power for himself and to achieve this goal he needs to find a way around the Constitution. To do this legally would require three-quarters of the States to sign off on such an Amendment to the Constitution. It would also take far too long for Trump and there are too many variables that would be out of his control. But to challenge this in the courts, it allows him to keep appealing every result that doesn't go his way until the matter eventually finds its way to the Supreme Court. He could try to expedite this in a submission directly to the Supreme Court, but I think that would be giving the game away somewhat. Trump knows that whilst he has the Conservative Majority on the Supreme Court, he can get them to re-interpret virtually anything the Constitution says to suit what it is that he wants. I mean they created Presidential Immunity out of nothing for him. There was no precedent for this because no previous President needed to shield himself from being criminally prosecuted for things he did that were unlawful. So the end-game here is to have the Supreme Court overturn centuries of precedent in having Congress in control of government spending, and give this power to Trump. The linguistic gymnastics they use to do this will be something to behold.
