Something interesting here is that the final blow to Chuck was actually not something slipping-jimmy-esque, but something very chuck-esque. Chuck was fine with being manipulative and sabatoging Jimmy and he considered it morally okay as long as he wasn't breaking the law. Jimmy on the other hand typically has strong morals but bends the law to get his way. In this scene he didn't do anything illegal; he simply told someone the truth in a manipulative way in order to do something nasty to chuck. This is similar to the way chuck is perpetually lawfully sabatoging Jimmy.

@@telescopicS627 in reality, front line staff in a reputable company are gonna have more sympathy, balancing between customer service and the interests of the insurer, abiding by the company procedures or government regulations. it's usually higher up or further away from front line staff where they only have the insurer's interest to focus on, leaving it to front line to get all torn between the two interests. they also can't "unhear" things, and i love just how naturally jimmy slipped in that red flag for chuck.

The reason his show of a breakdown is so very believable is because every single word he uttered was true, he was able to keep such steady control of his anger to make his words believable (wouldn’t be effective if he just yelled and was escorted out), and he was able to come up with the plan in two seconds flat. You can see the wheels turning in his head and worked the plan despite extreme anger. Really a stunning performance.

I think he knew the plan long before he walked in there. He knew the insurance could not be refunded, he just wanted to play the agent so that he could let slip about Chuck. If he had been honest about "just needing a break" then he'd still be upset when he left the office, but he was determined in his anger with Chuck when he left that office and he knew he beat Chuck at his own game. This was a long con, not an on the spot thing.

His arguments to be refounded were pretty weak for a character as smart as Jimmy. The odds of that happening just because of an appeal to empathy were pretty low. Since thé begining of BCS if Jimmy wants something he starts by making up some strong plan before making any move. However, this part of the dialogue was necessary to build the naïve character he was trying to sell to the insurance lady. "It's in the transcript..." LMAO It's really interesting to watch Bob Odenkirk do one of the toughest things actors have to do, which is to play someone who are themselves acting or pretending. And since Bob plays a con man, he has to do this all the time. In this scene, he needs to have a breakdown that's convincing enough that we believe that this woman believes it's legit, while also being a little off from how Bob Odenkirk plays a real breakdown (for example, when he cries in that empty office after Kim turns down his offer to team up with him) so that the audience feels that it's a con. I feel like there's something in his mouth that doesn't quite feel right in terms of how it looks when he's legit miserable. But maybe I just like looking at Bob Odenkirk's mouth!

Acting has some interesting moments like that that are largely overlooked by the audience. End of the day, in theater performance, your best work goes unnoticed - it's too "natural" to the artist to seem impressive. One of my favorite examples is Mel Blanks voicing Bugs Bunny and Daffy Duck disguising themselves as each other, complete with bad imitation voices. Except Mel voices both characters in real life. If you can make any kind of character voices, trying to make one character voice sound like a poor imitation of the other is a mental minefield, because you actually *can* do both voices. You have to embody the character of one voice while letting *it* try to be another voice that you're otherwise completely capable of doing naturally. And the end result is something no one notices, because it's a quick sight gag that's done so well no one even contemplates the feat they're seeing.

This is what essentially killed Chuck. The insurance issue lead to Chuck being forced out of HHM and then Chuck ended up spiralling out of control which ultimately ended with his suicide.

Him threatening litigation against their insurance company is what led Howard to lose faith in him and strongly insist he retired, leading to betraying Howard by suing HHM, forcing Howard to buy him out to save the firm.

Or Howard. Or Kim. Or the power company that couldn't see him until Wednesday. It was Chuck. He was provided irrefutable proof that his condition was a mental sickness, and he pushed away everyone who tried to help him so he could tear his house apart looking for power cables. The fact is that he died because he'd rather fetishize his own pain than admit that it wasn't real. Oh, and not declaring his sickness was technically insurance fraud, so in the eyes of the law Chuck cares so much about, Jimmy is 100% in the right here.

Great scene! It's filled with irony- we, as the audience, know that Jimmy is doing this out of spite yet everything he says about Chuck is true. Although I'm definitely not a legal expert, it seems that Chuck and Howard WERE being unethical and even possibly committing fraud by hiding the truth about Chuck's debilitating mental illness from the insurance company. If even one of their clients sued HHM in the grounds that Chuck was incompetent as their lawyer, the insurance company could be stuck paying a huge settlement, let alone if multiple clients sued for ineffective assistance of counsel- it would create a huge mess. Another point of irony- Jimmy is actually doing the "ethical" thing in reporting Chuck's deception to the insurance company even though we know he's doing it for revenge. If another random lawyer had inadvertently discovered Chuck's hidden condition, he also might feel obligated to report it.

That wasn't an opportunity for exploitation, that was the most reasonable thing she did in the entire scene. She just learned that another customer they were insuring for malpractice was hiding a mental illness, which makes him very high risk and a liar too. Once she found out about the lie, she had legal or moral obligation to pretend she didn't know, help him maintain the lie, and keep insuring a mentally ill lawyer when that literally wasn't what he was paying them to do. He was paying to insure a nonexistent mentally stable Chuck. The main way the insurance companies exploit their customers is by denying claims that they should approve. It's evil usually because it betrays the customer's trust and/or relies on a loophole intentionally made so that almost no customer could notice it. But overestimating risk? I don't think that's a big avenue for exploitation, profits are probably maximized when risks are estimated as accurately as possible. There must be a whole team whose only job is to look at the market and set the price per level of risk, and since they are the specialists in it, they will do a better job of maximizing profits than she possibly could by selectively paying attention only to details that increase estimates of risk. From her limited perspective she would make mistakes that they would not make, and drive away customers that they would not drive away. If you are giving data to the experts, there is no way you can intentionally bias the data that will usually make them make a better decision. What is their expertise for if you're making the decision for them by biasing the data you collect? So, urgently taking notes about a mental illness is something that any insurance company should do, even a morally mostly good insurance company would do this, if one existed. And regardless of her morality, if she were doing her job properly, she would take notes just as urgently when she learned that a formerly mentally ill lawyer was cleared of a mental illness.

I love how complex the show is and how it's up to debate on whose fault Chuck's death is. Chuck killed himself because HHM, his own company, let him go, so you could say it was Howard's fault. But that wouldn't have happened if Jimmy didn't sabotage Chuck, so you could say it's his fault. But Jimmy decided to do that because of how Chuck treated him, but at the same time, did Chuck treat him so poorly because he was mentally ill, or was he just an asshole with or without mental health involved? It also makes you think if Chuck hated Jimmy because of his irresponsibility or is it just because Chuck is a bad brother? Furthermore, did the insurance lady do the right thing? Was she being a cold bitch or was she just doing her job?
