Because the Republicans will appoint him to the Supreme Court anyway. There isn't enough time before the upcoming midterms to select another candidate. And since Republicans are scared shitless, that Democrats will act in kind and block any supreme court nominee if they take the senate Republicans will do anything to appoint another conservative activist judge to the bench.
