CLIP DESCRIPTION:
Monty (Richard Pryor) outfoxes his lawyers by mailing a rare stamp, canceling its worth.
FILM DESCRIPTION:
The seventh cinema adaptation of the venerable stage farce Brewster's Millions stars Richard Pryor as Montgomery Brewster, a third-rate baseball player. Much to his amazement, Brewster discovers that he is related to deceased millionaire Rupert Horn (Hume Cronyn, who appears only in a videotaped "living will"). Even more amazing is the fact that Horn has left Brewster his entire $300 million fortune. The catch? Brewster must spend $30 million within 30 days, or he'll be left with nothing (in the earlier incarnations of Brewster's Millions, the hero was required to spend only a million, but this was, after all, the inflationary '80s). Aiding and abetting Brewster in his efforts to divest himself of his money are his catcher pal (John Candy) and an erstwhile lady friend (Lonette McKee), while his principal antagonist is a snotty attorney (Stephen Collins).

The stamp would still have substantial value, even after being cancelled and mailed. I guess the question would be whether Monty relinquished the stamp, and all claim to it, as soon as he mailed it. I think the postcard would immediately become the recipient's property.

Yeah, the postcard becomes the property of the law firm, who he mailed it to. It also isn't an asset since he mailed it. He used it the way a stamp is supposed to be used, so it is not destroying it.

Rupert gave an example of what not to do in that situation. So for the stamp, if Monty ripped it up and flushed it down the toilet, that would be destroying it and an instant disqualification. He didn't destroy the stamp, it is still there. It's just not an asset any more.

Despite the fact that its value comes not being a stamp, its still a stamp. As another example, in 2008 a cornflake the shape of illinois sold for $1350. Of course its a collectors item much like the stamp. But its still a cornflake and thus meant originally to he eaten.

This breaks the conditions of the will in three ways: 1. He must get value for money. Buying an expensive stamp for the same purpose that one costing a few cents would achieve is not value for money. 2. He must not destroy what is inherently valuable. Buy mailing it, the stamp has lost any rarity value. And if it hasn't.... 3. He can't give his money away (such as buying the Hope diamond for some bimbo as a birthday present). So if the stamp retains its value he's failed on #3. If it doesn't, he's failed on #2. Either way, he fails on point #1.
@HALLish-bl3bm
@HALLish-bl3bm 7 жыл бұрын
I think he succeeds on point 1, but then fails point 2. Something is worth what someone is willing to pay for it. If we take monty out of the equation as a special case, then so long as someone else was willing to spend about 1.25 million, he got value for money. He then destroyed the asset.
@sha11235
@sha11235 7 жыл бұрын
He bought an asset, but he didn't destroy it. A stamp is supposed to be used that way. Rupert gave an example of what Monty couldn't do in the case of destroying something and this isn't the same thing. The stamp is still there, it just is no longer an asset of Monty's since he used it by mailing it on that postcard to the law firm. If he had torn it up that would be destroying it.
@QuorkEx
@QuorkEx 7 жыл бұрын
He destroyed its value. As one of the characters said: "It's worthless, he's mailed it". As Monty's uncle said, "you must not destroy what is inherently valuable". This instance breaks the rule about getting value for money also.
@AdderMoray
@AdderMoray 7 жыл бұрын
Couple of things. 1. There is no inherent value in a stamp other than its use as postage. Any other value is ascribed, not inherent. He used the stamp for what it was worth. Its value as postage. 2. The line was "It isn't an asset any more, he's mailed it." Because the stamp now belonged to the law firm.
@QuorkEx
@QuorkEx 7 жыл бұрын
The question is, is the stamp still worth what Monty paid for it? If it is, he's broken the condition about giving valuable things away. If it now belongs to the law firm, instead of Monty, that merely proves my point. If it isn't worth anything ("worthless" as one character describes it) then he's broken the condition about destroying something inherently valuable. A Picasso only has "ascribed value". Other than that, it's just a frame, some canvas and some paint. Either way he's broken the condition about getting value for money. As for the stamp having no inherent value, it is a collectable,, not just a stamp.

Two things i'd like to point out. As previous comments have stated, I agree that in posting the stamp, he's pretty much destroyed it. It's worth a fraction of what it was before. Also, the postal service in America at the time this film would never have accepted the stamp as a current valid postal stamp. So it would've probably been sent back to Monty anyway! @@ryandeffley7652 the key issue here, and what the movie is obviously going for, is you can outright destroy an asset in a manner that it's not intended for so buying a car and immediately crashing it would be breaking the rules BUT one could buy a car, and sell it at a depreciated value because a car loses it's "new" price the moment it leaves the lot. and the more the car was driven, the lower it's value would be. because items depreciate it. "You must not destroy what is inherently valuable" Mailing a stamp whos value comes from "the only known copy in existence" there would undoubtedly be a massive court case. The stamp still exists, and the meaning of destroyed would come into play if the value was zero. Id think he would get away with it but with no assets to use to defend himself in court he would need an army of lawyers on contingency. It would be a cool movie in of itself.

If it's a government stamp then it's been purchased and used as intended.

Brewster's explicitly allowed to use things for their intended purpose. This stunt works out because stamps are created to be mailed, regardless of their aftermarket value.

Doesn’t mailing the stamp technically disqualify him in the rules? I’m sure “Granville and Baxter” would have litigated that to no end... (Really sad what’s happened to television these days...)

it wasn't destroyed and it was for the intended purpose to use it on an envelope. Brewster found a loophole

@@toomanyaccounts it would have made for a boring movie, but be could have just bought $30m worth of stamps and mailed them all.

This movie would've been a whole lot better and much funnier with Eddie Murphy in the movie instead of boring old Richard Pryor.
