Facts. If Florence knew she had an STD, then doctors should have detected it as well. Sex ed was not taught so the appearance of symptoms had to be obvious. Poor woman.

@gaslitworldf.melissab2897: The way the justice system is _supposed_ to work is that the accused has the benefit of the presumption of innocence until guilt is proven. In this case the prosecution botched demonstrating unambiguously that Florence had been poisoned. So if she hadn't been poisoned then her husband couldn't be found guilty of poisoning her. Yes, I strongly suspect Howard did it, he definitely wasn't anything even remotely like a model citizen but the prosecution made a dog's breakfast of their case and so Howard Behnam got off.

I felt so bad for Mrs. Benham. The final verdict just brought even more heartache and shame to the poor victim’s name. But he didn’t last long after his freedom so I felt it was poetic justice. So well told as usual Mr. Brief Case!

Wow. I can't believe Mr. Benham was actually declared not guilty. In all the stories presented previously, it seemed the justice system was far more prudent than it is in today's society, but in this case it appears to be just as corrupt. That's disappointing.

I am sorry a high priced lawyer was able to sway the minds of the jury. Finally justice was served by way of fate. Unfortunately, Florence and her family suffered greatly. I wonder how much Mr. Benham paid to get his retrial, never mind what the second trial's legal fees must have been, because there's no way there wasn't bribery involved. But the grim reaper doesn't care about money. I found the channel about a month ago and I'm still finding the occasional old episode I've missed. I have enough subscribed channels that I don't always catch new videos within 24 hours of their release. I've been consistently impressed by the level of research, and by how much information survives from older cases.

The poison was not consumed .It was injected .That is why no poison was found in her stomach .When the poison was injected it traveled through her blood stream and straight to her heart which brought on a heart attack .Which given by the doctor who was paid a considerable amount of money to do so by Mr Benham . I love old history stuff! I watch all the old crime stories I find it fascinating. I actually here recently been searching my family history. And I found out that the property that we live on was a circus town back in the late 1800s early 1900s. Which is also pretty fascinating I just love historical things.

I was a kid, but even then I was confused about where she was talking about. 🤣🤣🤣 So even somewhat locals, can pronounce it wrong. Hell, I'm about 40 mins from Batavia in a town called Chili ... amd it's pronounced "Chy-lie", not like the food: chili. Couldn't tell ya why they did that... but I'm sure there's a reason. HAHAHA

I’m sure it was definitely painful. I feel that it came down to, an eye for an eye and a tooth for a tooth. But his sentence wasn’t served by the courts. Great work BC. Hello Brief Case! 💼 Poor Florence! I do believe Howard did poison her. After the way he pursued her, ran off with her to get married, and the way they quarreled and circumstances of his purchase of cyanide. Thankfully, he did not get away with it, even if he was found not guilty at retrial. I'm sure he suffered, and as he did, perhaps he gave some thought to his past actions and Florence. The only good news was that their child didn't have to grow up with him, was raised by his grandparents, and lived to a ripe old age. (I made it here, a little late today, but I enjoyed the photos and story. Thank you again, and I surely hope all is well with you, Dear BC!) Resa

This case is not quite straightforward. Admittedly Howard Benham was a terrible husband but the post mortems clearly were not as well as they should have been so there was and still is an element of doubt. Benham didn’t really escape justice if he was guilty. Things could have been very different for him if he had valued his wife and treated her well.

Why didn't Ms. Harris (the new witness) come forward sooner?Also, who did she testify for (defense or prosecution)? Her testimony shows the possibility of when Florence could've been given the poison. I just wished a proper autopsy was done from the beginning. As of right now, I'm unsure of Harold's innocence/guilt.

I didn't get a chance to watch this case yesterday as usual, but caught up today. What a crazy turn of events! I find it fascinating that even though he was acquitted in the second trial, that he ended up dying a year later from disease, so I guess in the end, one can't cheat death...

This is the second episode I watched where the alleged murderer went free but died shortly after. I guess some people get justice sooner than others. It’s also the second episode I’ve watched where the lady’s guardians were not comfortable with her romantic interest, and they were proven correct.

Seems to have been easier to introduce new evidence in those days: the Innocence Project sometimes cannot reopen capital cases even with decisive evidence!

I am incapable of making up my mind about this case. The doctors were of no help at all. Was he a killer or not? Did he transmit a disease to her and was truly trying to help her? His innocence or guilt will forever remain a mystery and it matters not much in the end, he did not live long enough to fully enjoy the fruit of his bad deed if he was guilty. Good case Brief Case. Thank you!! (Just to let you know, you give the date of Florence's father's date as January 7 - I think you meant June 7?)

The one thing that makes me suspicious of the first verdict is that when someone was said to have died of a “brain fever” back in the day, that was usually describing death from syphilis. I don’t remember the exact name of the clinic where BC stated that he died at, but there were several hospitals/sanitariums that were really just places for rich people with syphilis to die in.

@@DneilB007uh, NO. Brain fever was a common diagnosis for innocent young girls and children. Interesting though- it may have also hinted at syphillis deaths but not "usually" (Some of my favorite authors had teen daughters die of brain fever)

I just forwarded this video to my son in Florida. I was married to a Benham for over twenty years. It was my name too! We have three children and eight grandchildren. Excluding my two sons' wives there are seven of them who have the surname Benham. Since six of them are male I expect the name will go down through another generation on this branch. Here's the weirdest coincidence that really caught my attention, my mother-in-law was FLORENCE BENHAM! My father-in-law was born and raised in NY. But he was from NYC. I do have an active Ancestry subscription with a family tree I occasionally work on. My kids all have submitted their DNA there. So, new cousins, maybe? At least there's a place to start. I'll definitely be investigating some more on this.Too bad the son changed his name though I really do understand why he did it. Of course, even with finding someone, this is a subject any possible descendants may not want to discuss, if they even know. If they are on Ancestry, likely this story is not unknown. I can always share your video with them. Anyway, this gives me a very different kind of project for the new year. Thank you for posting this video! Have a wonderful 2024 from Vermont USA! ❤️
