Regardless of whether she can or can engage a lawyer, the conservatorship is set up so she can’t even if she develops the capacity. Her father can choose the best lawyers he wants and she is technically forced to use court appointed legal help.... It’s the fact her mum is involved that has helped level the playing field allowing her to secure more personalised legal services

My great uncle before he passed away had dementia and he also had a psychotic disorder his whole life. He was very susceptible to scams, not really able to make his own decisions, and pretty severely mentally ill to the point where we worried for his safety. So my family tried to get a conservatorship for him, because we cared about him. We lost. Right after that, he gave all his money away to some strangers. It’s interesting how the judge looked at my very mentally ill uncle, along with the huge amount of evidence that he was unable to make his own decisions, and said “nahh he’s fine”... then the judge in Britney’s case looked at her, working, doing shows in Vegas, going on tour, etc, and said “nope she’s unable to care for herself at all”.

That’s a huge sign of abuse...secrecy. My mother always told me I couldn’t talk about the “family issues” outside of the house. I now know it was because it was all abusive and if I told someone she might get in trouble or someone might try and help me. He’s definitely abusing her and clearly took advantage of her at a vulnerable time, something he claims others are trying to do (projecting).

Amanda Bynes for example, the way the media treated Amy Winehouse (no her father didnt put her into a conservatorship, but he encouraged her NOT to go to treatment because it would disrupt her stardom.) I graduated from law school, and from my knowledge of the law I would say that there are a few factors that make it extremely difficult if not impossible for a conservatee to get out of a conservatorship, especially if the conservator is fighting it. First, whatever the court found regarding the conservatee’s competence is considered to be legal fact. So, even if the judge in the original case made a mistake or was wrong in ruling that you were incompetent, all future judges will take it as a given that you are incompetent, unless you can show something like gross negligence on the part of your lawyer in the original case or evidence that was hidden. Second, even if your mental health has improved, judges are going to err on the side of keeping the conservatorship in place, because the potential harm of removing it is pretty much always going to outweigh the harm of leaving it in place. In other words, most judges will feel like it’s better to leave well enough alone than to take the chance of ending the conservatorship and having something bad happen as a result. Third, as the documentary showed, the conservatee can’t really hire their own lawyer, because the court has already found them to be incompetent. To even have the lawyer of their choosing represent them in court, there would have to be a mini trial within the current case to determine if you are now competent, with the presumption being that you are not. In order to prove you’re now competent, you’d need hire to experts to evaluate you and testify on your behalf, which you won’t be able to do without the conservator’s permission. It really is a catch-22, once you’ve ended up in the position of being a conservatee. In Britney’s case, I suspect what happened is that her divorce lawyer advised her not to fight the conservatorship in order to get access to her kids back. Especially after the incident where she barricaded herself in her house with her kids, her ex husband was likely arguing that if she had visitation with them again, she had the resources to easily leave the country with them and never come back. So, having the conservatorship in place would have reassured the judge in her custody case that there were safeguards in place to keep her from doing something like that. Her divorce lawyer was probably also the one who told her that she wouldn’t be able to get out of the conservatorship and/or that it wasn’t in her best interest to do so, and she was better off just trying to have the conservator changed.

For what it’s worth, I understand that ON PAPER there is a high bar for 5150 holds, in practice they are often abused by police to remove homeless people and “troublemakers” from the streets. The other category for the hold is if someone is considered “gravely disabled”. Police are not clinicians and use this category broadly in unjust and inequitable ways. There’s a lot of reform that still needs to happen.

I'm sorry but even if Britney thought everyone except her lawyer was an alien, the fact is that the man is still a lawyer and has a legal obligation to help her. Even if she was accusing her FATHER of being an alien, it was her ONE request, did they even try to find another person who could look after her interests to be the conservator? It seems purposefully cruel that they would let that happen EVEN if her worries were unfounded and "crazy".

Seems random to send a millionaire celebrity who could afford the best of the best and decide to send her to the worst of the worst. If it is so poorly rated it would seem more likely to be a shady situation, i.e. they would do whatever her father paid them to say and do related to her treatment and diagnosis.

I agree. There are plenty of kids out there that are living with drug addicted parents, no food, no clothes, sent to school to get them out of their hair, and thank God. The schools feed these kids. We never went to school and ate breakfast and lunch there but plenty of kids eat their only meals at school. The parents still have their kids, the state never interferes because those parents are poor, spending every dime they earn, or steal, on drugs.

Britney was put under a 50150 by her father, but she was quickly released before the 24 hours hold because they did not think she was unstable. Her father then tried to take away her children, so Britney locked herself up in the bathroom with her kids! When they took her kids from her arms by force, she threatened to commit suicide. This is when the father made another 50150 hold which led to her conservatorship. Im against the conservatorship but I can kinda understand its argument at that time. But it should be a temporary conservatorship, not a lifetime conservatorship. If you will keep her under a lifetime conservatorship, atleast accept her request to remove her father and replace him with a independent unbiased party. And if you will keep her under a lifetime conservatorship, isnt it weird that their making her work and tour the world?

You should check out a Documentary that she did in 2008 i think called Brittney Spears: for the record, I think this might give you insight as to what was going on in her life at the time. This doc is from her point of view and it has interviews from her about this specific events in her life and it is very honest and authentic on her part.

I think the dad pushed the 51/50 to have an excuse to get the conservatorship. I think he plotted, planned and did it because she was wanting to quit. I think she wanted to just step away and live privately but he wanted more money and a way to force her to work... hes vile.

Here is some data for you: Uncovered court documents show, Jamie Spears claimed that Britney had dementia. Also, Kevin Federline accused Jamie Spears of attacking his and Briteys eldest son, Sean Preston. Allegedly he broke down a door to "shake him" while the younger brother witnessed it. Sean calls him "a jerk" and "a pretty big d---k".

Also dementia isn't a disease, it's a symptom of a disease. Like she would have to have something like Alzheimers or Lewey Body Dementia. Or like my aunt has been schizophrenic since around 30, but now in her 60s they have said it has progressed to dementia as a symptom. So she would have had to have a mental illness or physical illness that caused it to have "dementia". Sounds like a bunch of secretive bullshit to me. Also she wouldn't be able to learn new song or choreography if she was dealing with dementia.

I tried to get a restraining order on an abusive ex boyfriend when he resurfaced a year later after our breakup started leaving threatening voicemails the cops said it wasn't enough, then he said well even of we do an emergency one you have to go to the court tomorrow and put your work and home address and give that paper to him, it was so disheartening to not be able to get help and other people abuse and lie about such things.

I'd love to see you partner up with a lawyer for these reaction videos! I'm a law student but a lot of what you've said in this video is accurate (regarding what I've learned so far). It would be fun to see the intersection of law and psychology. Lawyers don't get training to deal with trauma and clients typically need some emotional and mental guidance. I can't imagine how Britney handled all of this, especially since it was all being followed by fans, paparazzi, and basically the entire world.

i was involuntarily placed in a hospital for psychosis for the maximum 30 days. I was not threat to myself or anyone else. There was literally no evidence other than mildly paranoid statements. All it took was one phone call. The bar really isn't that high at all especially if you're a woman. Hospitals have "heads in beds" quotas where they get money per person they can hospitalize from state funding. It really only takes one phone call to a social worker and all of your rights are gone. I got put in handcuffs even though I was completely calm and noncombative. The police actually apologized to me because they "had" to restrain me. THE BAR ISN'T THAT HIGH. ESPECIALLY IF YOU'RE A WOMAN. The system is BROKEN. My therapist tells me to be grateful they don't do lobotomies anymore.

Every single adult woman it seems like has a story they can tell about sexual assault or an abusive controlling boyfriend in their past. Every guy I've ever dated besides my current fiance seemed to hate how femininity actually manifests in the day-to-day. They also want to manipulate and control. Every one of my female friends has had an even worse time of it than I seem to have had. Just look at cultural practices around the world- a lot of places cut off female parts and sew them shut so they never want to have sex because it hurts. Fundamentalist religion is always on about controlling women's every action. It's clearly part of the male mind to control women.

I don't think that it should be overlooked when they said that the ex-boyfriend was possibly drugging her, and her extremely out-of the-ordinary life experiences as an adolescent. Even if you're the most mentally stable in the world, growing up as she did and then possibly being drugged- anyone would be diagnosed as "crazy". Everybody seems to be benefitting from emotionally and mentally devastating her.

I remember when this was going down and thought maybe it was a good thing for the father to get involved ( I'm about the same age as brittany), now after going through issues of addiction and having a child I realized that she was unfairly judged and executed. The help she got (even thought well meaning) may not have been what she needed. Somehow she seemed to have level off but certainly not fully recovered

I really appreciate the commentary you are offering, especially when it comes to humanizing Britney and what she may have been going through. There are some things that either the doc didn't clarify or that got missed: -Federline only won emergency sole physical custody, but Britney maintained visitation rights indicating a dangerous environment was the issue more than the mother's risk of harm to her children. -The restraining order on Lufti (who was her "manager") a 5-year restraining stay-away order (one more of which was issued and likely another one soon). A temporary restraining order (TRO) lasts roughly 14 days which is why it has a low threshold. A 5-year restraining order is the maximum length of time for an order requiring substantive evidence and it has been issued twice now. The court documents describe extremely manipulative behavior like drugging food, hiding her dog to make her panic then show up to "save the day", and bragging to Britney's mom that he "owned everyone around Britney" including security, her attorney, her boyfriend, etc. The man is an absolute demon. -The 5051 was likely related to getting Britney to a hospital because she was being drugged. She likely would not have been cooperative, nor was she incapacitated, and she seemed to be in fear for her child's life. -The documentary is a bit misleading in how it presents Britney's cooperativeness with the conservatorship (mostly because Vivian Thoreen was the only person actually involved in the proceeding and cannot talk about them due to privilege). The court appointed a highly qualified lawyer to represent Britney in litigation and another highly qualified lawyer as the court's independent investigator. The first attorney claiming to represent Britney (the attorney lufti "owned") appeared to have misled her about the proceedings which is why he was issued a restraining order and disbarred. I'm guessing he convinced her that "someone else" should be her conservator (like maybe him or that lufti guy). You can imagine why a judge would want to be sure Britney was represented by competent, ethical counsel and did not want to recognize the second lawyer (the one in the doc) Britney hired as her counsel in an abundance of caution. Later court documents explain that Britney had misunderstood what would happen in the proceedings or what a conservatorship was, but that she was cooperative after learning the reality. In the years since, Britney has described the conservatorship as necessary at first, though she has not spoken about it beyond that. Last fall, the court investigator who is effectively Britney's counsel explained a plan behind the conservatorship and implied that she is a conservatee voluntarily retaining the right to petition for an end to the conservatorship in the future. -Britney has implied she has an anxiety mood disorder describing numerous situations of serious anxiety issues and crediting anxiety for a lot of 2007. It was also reported that she has ADHD and stopped treatment in 2008 because of medication contraindications (seems to be credible reporting since anxiety/depression medications often have contraindications with stimulants and she had yet to reveal her history with anxiety). All of this is to say that she seems to be a perfectly competent person who was brutalized by the press and horribly manipulated by truly toxic individuals. My guess is she has yet to petition for an end to her conservatorship because it appears to be a condition of her de facto custody arrangement with her ex-husband (he seems to have changed the agreement unilaterally a lot in recent years), but that is only my speculation.

I think that the courts should appoint an advocate or guardian ad litem for anyone in a situation like this. We all would really benefit if the system was set up to help and heal.

She was set up when she was put under a 5150. She essentially didn't want to be separated from her kids so she locked herself in the bathroom with Jayden I think. Everyone at the door of the bathroom everyone kept telling her the police are leaving, stay in there. They then left her alone for the police to interact with her. She never wanted it to get that far. She was willing to give up her career at that point for her children and she was set up and had them taken from her. At this point in her life all she was doing was being a mother. Also Doctor Phil said she cabable. She never got formally diagnosed with anything that would put her under a conservatorship.

After hearing of the paparazzi all on her face after being hospitalized due to concerning behavior, I remembered when that happened to me, I remembered walking out to the hospital feeling so ashamed, so lost, so vulnerable just completely embarrassed, i can only imagine how horrible that must've been if the whole world was watching, recording, taking pictures, documenting what i wish had never happened

Well, restraining orders certainly aren't that easy where I live! I tried to get one against an ex who was harrassing me, and found out that you can't get one if you never lived together. There was literally nothing I could do.

@@merricat3025 He didn't do anything to me physically, so I couldn't do a thing. He kept calling and texting, and threatening to come over, after I had repeatedly told him to stop. The best I could do was block his number, which meant the phone wouldn't ring, but he could still leave voicemails.

Dr K needs to watch Emily D Baker break down how the conservatorship works. Regardless of Britney’s need, the structure disempowers her ability to engage her own legal services. Her father can secure the best, paid for by the estate of Britney, but she is technically unable to fund her own legal defence. In spite of Britney’s mental health issues or her current level of need, no grown woman wants their father THAT involved in their life. He can dictate her use of birth control and prevent her marrying... It’s such a sad situation

I think her father can get access to her medical records, but he can't dictate what medication her Dr prescribes for her, that would be unethical and illegal. Brittany is her Drs patient, not her father.

She had no idea how bad it got, because she had no voice in anything. She's been trying to help Britney legally against Jamie.

I am an attorney and I used to work as a judges clerk at family court. The court is going to accept undisputed evidence as fact. So if a litigant tells the court you are unlicensed and the mother didn’t dispute that contention or you weren’t there to dispute that contention (which would be the case most of the time) than the court has to assume it’s true. The court has to work off of what is presented before it, not do independent research.l, that would be a violation of due process.

While I understand your position regarding how high a bar there is supposed to be for 5150 holds, the simple fact of the matter is that they can be and *are* granted when entirely uncalled for, and can be excruciatingly traumatizing. Taking a person who is having an issue with anxiety, for example, and putting them on a 5150 hold, is like taking an arachnophobe and locking them into a coffin filled with spiders. And unfortunately, profit motive is one of the most common driving forces behind these, as programs can recoup astronomical fees from insurance plans, rather than the state having to pay for all involuntary holds itself. In essence, my experience leads me to believe that if there are people saying that these things were improperly granted, then they probably were. The judge who signed off on all of this has functional immunity and will never be held accountable even if he knew Brittany was fully competent and that the conservatorship should not be granted. And at this point, the statute of limitations has run out for all the professionals who were involved in evaluating her. Hypothetically, the records could be unsealed tomorrow, proving that Brittany was 'assessed' by a psychologist via half a dozen questions over the phone, and that the 5150 hold and all legal proceedings thereafter were based on a 5-minute phone call, and nobody would suffer an ounce of punishment for their actions. The system may be *intended* to work in a certain way, but there are so many numerous ways in which it is fundamentally broken that it is best to always assume that something has gone wrong rather than that everything has gone right. Lastly: it is overwhelmingly clear that the paparazzi and other elements of Brittany's fame and fortune were either responsible for her mental issues, or were triggering/compounding her mental issues. No judge that had Brittany's interests in mind would have allowed the conservator to require her to continue working. Imagine having a traumatic experience with some part of the justice system, having a serious crisis during which a family member managed to gain conservatorship over you, and then being *legally required* by the terms of the conservatorship to follow the conservator's schedule, even when that schedule meant regularly interacting with that same part of the legal system that traumatized you. How would that lead to anything but further and greater trauma?

None of the info that Dr Honda has asked for is publicly available. Britney's diagnosis is private and many of the court documents related to this case are also private/sealed. People have speculated that she has bipolar disorder, but that is not officially confirmed.

Somehow, everyone was told there was good reason proving her inability to retain counsel for 13 years, and when finally pressed to prove it, they just--couldn't. My brain is melting.

I was involuntarily detained here in Maine and they refer to it as being "Blue papered". I was put on a new seizure med which cause me to go bonkers for about a week or so with hallucinations, mania and threatening to harm myself. After they realized it was possibly the new meds causing my unexplained break with reality they took me off them and within a day I was completely back to normal and had zero memory of most of what occurred days before. I was released from the psych hospital after being there for 8 days. Found out later I threatened to hit a cop and EMT but have no memory of that.

Personally, I don't believe it's right for anyone or the government to take anyone's rights away. If Britney wants to spend every dime she makes on whatever she wants to spend it on, that's her right. She worked for that money. If she wants to go live under a bridge, that's her right as a human being. Her Dad wasn't in her life until he realized she might be a cash cow and he grabbed the opportunity.

I feel like when this all happened it is very possible that these were all appropriate assessments. However over these 12 years she has been healthy enough to put on a full scale Las Vegas show. From what I understand she is not allowed ANY of her money like she needs approval to buy a coffee. And over the many years she has been fighting this conservatorship being under the control of her father, I understand that the original threshold to establish is so high but the argument to move control to another person should at least be reconsidered since that has been a clear issue for over a decade.

An adult guardianship / conservatorship can be terminated with proof that the impediment / incapacity either no longer exists or, in the case of a mental health issue, the ward has been successfully treating and managing it without incident for a significant period of time (as judged by the Court). As an attorney, I have been successful in getting termination for my clients, but it can be very difficult to do.

I was shocked how many immensely dangerous situations some of these children have to go through before being put into temporary or permanent foster homes. Of course, I believe most parents should have a chance with their children...

the problem with the "medical assessment" is that the Judge dismissed Britney's lawyer saying she had an assessment saying Britney didn't have capacity and then after the lawyer walked away the Judge asked for the medical assessment to be produced. It was never produced. It had been asserted that there was never a Capacity Declaration filed when the conservatorship ended.

Dr. Honda, I have to say I have a problem with what you said about the two lawyers in this video. When the lawyer who was representing Jamie Spears said that courts take conservatories seriously, you agreed with her. But when the lawyer who met with Britney said he felt she was capable of retaining him, you implied he could have been saying that selfishly because he stands to benefit financially from her hiring him. But isn’t it in the best interest of the first lawyer to have everyone trust the conservatory system? Doesn’t she also have something to gain from us believing her? Isn’t it possible that the notoriously flawed and unethical American justice system failed this famous young woman? Come on Doc, get on the Free Britney train!

It's horrible about the order that prevented you from treating the children, but I think that it's better that judges hand out restraining orders quite liberally. One reason that I think this is positive is because I hear all too often that women are terrified of their abusers and that no one believes them if they are abused and/or raped. I think restraining orders are one way for battered women to escape and hopefully without judgement.

This is absolutely so tragic and sad. I personally was given the opportunity to have a trustee and conservator 13 years ago by the state of California for being disabled for anxiety,ptsd and depression disorder. I was never hospitalized or deemed a threat to myself or anyone else. I chose to have my father as mine, his job is to make sure that I’m given proper treatment and has access to my finances if at any time I’m deemed incompetent and not of sound mind, which if at that time would be evaluated by physicians. I’m young I was only 29 years old at the time and I’m 42 now and every year I’m evaluated and asked if I want to continue to have a conservator. I can clearly see the moments when she is spiraling into a manic episode and watching her having to face that with all of the cameras had to be even more traumatic and scary. The fact that you can see in her post that she is literally trying her hardest to come off like she is okay after people commented asking her is a triggering thing and often times just trying to make sure we are not coming off as depressed or panicked sends people into a much more downward spiral. I see it clearly down to the exact moments, maybe because I have experienced this so much, and understand.

This is interesting. I have an aunt who has the whole FBI is listening through the walls and in the toilets thing but refused to see anyone. She once disappeared, left her wallet, phone, keys, and 15 yr old daughter alone and was gone for weeks. Police found her in a public bathroom the next state over, could not convince them to put her in a hold because she seemed "fine". She goes through spurts a lot but won't see anyone and there's "nothing we can do" because she "isn't a danger".

Because I had hurt myself, albeit mildly, (by self harming) I obviously couldn't demonstrate that I posed zero risk to myself. It's unfortunate! Some people that don't have good insurance that had more severe mental illness, who I have been in the hospital with, would threaten to hurt people or do something really erratic on the last day of their admission. They did this because they were scared to go home or (or back to a group home or wherever they lived) and knew they weren't ready, but their insurance wouldn't let them be in there any longer. So they did whatever it took to prove they were sick enough to stay. It is a really messed up process sometimes.

Right at the start her agent said her father wanted her money as she was becoming famous, that all he was concerned aboutwas her money making potential. If he was gaslighting her, and this has happened to me, she would have looked and acted crazy. I was lucky that my therapist took an interest and spotted the difference between gaslighting and psychosis, but not all of them do. When I first called up, the first person I spoke to thought I had psychosis and encouraged me to "play their game" which pushed me deeper into the gaslight narrative. I was referred to a second psychologist and by this time I thought I had lost my mind, I begged them to lock me up, and was told that I was being gaslit. When I figured out the gaslighter who had managed to convince several of my friends I was insane, and challenged them they screamed at me for not allowing them to be the victim. This person confessed to me, on camera that they were diagnosed NPD and had done this before. I am still recovering, but my gut says that this is what was happening to her, I remember thinking this at the time too.

I did a pharmacy internship at a level 1 psych facility and went to several court cases for patients. I was able to see the first interviews with the psychiatrist, the risk(s) to the patient and the court cases. It was very interesting to see and participate in, but I totally see where it's beneficial to society and to the patient themselves! Anyway, I agree with you 😆

earlier in the doc they mentioned that britney’s mom speculated that britney had post-partum depression. we have no way of knowing her medical conditions but maybe she suffered from post-partum psychosis at the time as well. we do know that allegedly during one of the events where she was later hospitalized she was threatening suicide so at the very least it seems that she was suffering from suicidality :( i really feel for her as someone who has suffered from depression and ptsd in my past. post-partum psychosis is a condition i didn’t know existed until recently but i think needs more awareness and destigmatization.

This could not be true but, basically I feel like this is not only tied in with her dad but also the record label she was working with which would explain why she went back to preforming, apparently she tried to put up some new songs by running into a radio station without any body guards and then shortly after she was declared to have a break down etc.I'm guessing the songs weren't on brand. There was also someone who was diagnosing her mental health that was supposed to speak in court that somehow fell from his window in a hotel two days before he was supposed to testify in court. The song was called Mona Lisa.

Yes, this is the thing - it's hard to judge from this documentary whether she was treated fairly by the court and psychological services or not, because we aren't privy to all the information they have. And that's correct because they are her private medical records. I also understand where the "free britney" people are coming from because, well, she wouldn't be the first woman to be unjustly controlled via overblown "concerns" over mental wellbeing.

Trying to find it, because I think it adds a lot of interesting context and makes it apparent that conservatorahip abuse is a problem in some states and a big $$ industry. 22:45 what I understood from what the lawyer was saying, is that one of the criteria for conservatorship being that they could be easily tricked into giving away their details etc., whereas the lawyer was painting it as that she was able to understand and express a rational, ‘sane’ enough understanding of the situation, so why should she need a conservatorship? or maybe like you’re saying that she knows she needs one but just doesn’t want it to be her dad. Would be interesting to know exactly what the lawyer meant

So Dr Honda is talking about an Ex Parte order that a person just fills out a statement and files with the court (when he’s talking about his personal experience when he couldn’t treat the children of his client). The judge doesn’t make a ruling. He just signs the order and sets a date in two weeks for a hearing. At the hearing evidence is presented by both sides and that’s when the judge makes a ruling. It most likely was a restraining order as part of the custody case. A no contact order is a criminal order. That is always part of criminal charges that are either pending or part of a conviction. A protection order is either in cases of domestic violence or to protect a vulnerable adult.

In the report they initially checked a box saying she had dementia. The next docs had that same box unchecked. How can someone this young have dementia and how can someone have dementia today and not tomorrow? Also, how can someone who has dementia do full world tours, memorise extremely intricate choreographies, be a judge on an international talent show etc?

It makes absolutely no sense. This lady Lou Taylor staked Brittany and also tried to get close to Lindsay Lohan's parents and try to get them to trap her in a convervatorship because she's a religious nut. But Lindsay's dad stepped in and stoped it all. It's so nuts all this. But this lady was able to convince Brittany's dad to go along with it all. It's insane honestly. A human rights violation happening in front of up for the last 12 years
