I've got a sneaking suspicion the Plaintiff knew it was illegal. Most people know those "buddy passes" are for the employees friends and family only and are not to be sold. I've seen one from Delta and it states it on the back of the card (looks like a credit card) and on the form you fill out online to reserve your ticket. "This pass is not to be sold or transferred and is for the sole use of the employee to which it was issued". The Plaintiff got lucky when the Defendant admitted he didn't tell him it was illegal.

They are not 100% free; depending in the type of pass/ticket; you do pay some fee; and in this sense why would i pay this fee for you to use mine? And in more sense i dont offer those passes to any one even my own mother!
